A People’s History

"In one wide-ranging volume, Lambert and the country reporters demonstrate that law can not only keep up with technological change, but can in fact stay well ahead by anticipating upcoming questions. This comprehensive comparative reference will be invaluable for lawyers and students." (Professor Joshua Fairfield. Washington and Lee University School of Law, Review of a previous edition) Bringing together a global team of authors, the International Handbook of Social Media Laws covers the law relating to social media across 34 countries in total. From influential social media defamation cases in Australia, to tweeting from court, and regulations enforced by the UK's Online Safety Act 2023, this book clearly articulates the main legal issues and developments across various legal jurisdictions, to ensure a company's social media presence is fully compliant with the law of each country. The third edition has been fully updated to incorporate new criminal and civil case law, and covers topics including: - Online abuse, online bullying and cyberbullying laws - Laws or rules specific to children and social media - Bans or restrictions on the use of, or access to, the internet or social media, including the influential TikTok, Inc. v. Garland case in the US - Use of social media as evidence in courts - Hacking and data breach laws. Contributors to the volume each provide coverage of their own country, ensuring the volume is both authoritative and practical. Countries represented include: Argentina, Australia, Belgium, Brazil, Bulgaria, China, Czech Republic, Denmark, El Salvador, Estonia, Finland, France, Germany, Greece, Hungary, India, Ireland, Italy, Malta, Mexico, New Zealand, Norway, Senegal, Serbia, Singapore, Slovenia, South Africa, Spain, Sweden, Switzerland, Taiwan, United Kingdom, United States and Uruguay. This title is included in Bloomsbury Professional's Intellectual Property and IT online service.

Asian Cities and the International Legal Order

For decades, the US assumed ideas would naturally flow from research into commercialization. That assumption no longer holds. As Anne Marie Knott shows, the US innovation system is no longer fit for purpose in an age of great-power rivalry. Since 1980, American R&D productivity has fallen dramatically, while China has become far better at turning R&D into growth. Why? Because the two countries operate from fundamentally different models of innovation. The United States follows a 'river' logic: produce frontier science and trust the market to carry discoveries downstream. China follows a 'lake' logic: absorb, develop, diffuse, and capture value. Drawing on new empirical research and a widely applicable measure of R&D productivity, Knott challenges seven myths shaping US innovation policy and offers a reform agenda built less on new spending than on using existing tools far more effectively. The result is a provocative account of innovation, growth, and national power.

Celebrated for its natural beauty and its abundance of wildlife, the Mekong river runs thousands of miles through China, Myanmar, Laos, Thailand, Cambodia, and Vietnam. Its basin is home to more than 70 million people and has for centuries been one of the world's richest agricultural areas and a biodynamic wonder. Today, however, it is undergoing profound changes. Development policies, led by a rising China in particular, aim to interconnect the region and urbanize the inhabitants. In this new and comprehensively updated edition of Last Days of the Mighty Mekong, Brian Eyler gives his first-hand account of the impact on the river of the tumultuous political period since the book's original publication. From the lockdowns of the COVID-19 pandemic and a devastating drought to the increasing political tensions and resource competition between China and Trump-era America, Eyler recounts his own increasing involvements in international efforts to protect this precious and delicate environment. Along the way he meets the region's diverse peoples, from villagers to community leaders, politicians to policy makers. Through conversations with them he reveals the urgent struggle to save the Mekong and its unique ecosystem.

This wide-ranging intellectual and media history traces China's emergence as a modern state in which boundaries blur between art and design, education and psychological conditioning. Tracking the parallel development of set design and social engineering from the 1920s to the 1960s, Background Matters examines the concept of huanjing (environment), a neologism introduced at the turn of the twentieth century that evoked heated intellectual debates and inspired frenzied aesthetic experimentation. Weihong Bao shows how efforts to reshape the mind consolidated the idea and art of environment by advancing a new theoretical notion of set design: both as aesthetic organization across film, theater, radio, and television and as social experimentation in worldmaking across geopolitical and transnational contexts. Inventive and breathtaking in scope, this book radically rethinks environment not as an external object but as the nexus of mind, medium, and society.

How should the Arctic be viewed in the 21st century? In this book, a leading commentator assesses the competing players for the Arctic, looking at broad questions of governance and security. The author challenges the view that the Arctic is a passive space which is the focus of competitive advances from superpowers, arguing that it is more correctly understood as a dynamic pluriverse. Drawing on international law, international relations and diplomacy, this is an important re-assessment of the Arctic and its position in geo-politics.

How has fashion become such an important signifier of French nationhood? How has fashion journalism been used to mediate political ideologies like fascism? These questions and more are answered in the first book to comprehensively explore the interactions between fashion, the media, soft power, and nationhood. With a geographically diverse range of case studies and a unique focus on fashion journalism, Fashion and Power covers the origins of the relationship between fashion, cultural power, and national identity in 'courtly' societies, through the Cold War to the identities of emerging fashion nations such as China and Nigeria. Examining figures from 'La Jeune Fille Américaine' to First Ladies, Nelson Best argues how, in Susan Kaiser's words, 'representations of nation are built on the backs of women's bodies.' By exploring fashion journalism as a discourse of cultural power that shapes the identity of nations in different times and places, Fashion and Power reveals the contingency of these power relations and the possibility of their renegotiation. This accessible and highly engaging book is an invaluable resource not only for fashion studies students but also for those in media and cultural studies and anyone interested in fashion, identity, and power.

How the social organization of Europe and China shaped their divergent economic and political trajectories over the past millennium In the eleventh century, when Europe was still backward and poor, China was a rich and sophisticated civilization. Yet Europe became the birthplace of democracy and the Industrial Revolution, driving the Great Enrichment, while China stagnated until the end of the twentieth century and was always ruled by autocracies. Two Paths to Prosperity traces the emergence of two very different social organizations in premodern China and Europe--the clan and the corporation--showing how they were key factors in the economic and political divergence of these two great civilizations. In this landmark book, three leading economists offer a bold new account of why Europe and China evolved along such different trajectories. In the early Middle Ages, public goods like risk sharing, religious worship, education, and conflict resolution were provided by nonstate organizations in both societies. China increasingly relied on kin-based cooperation within clans, while weaker kinship ties in Europe gave rise to corporations such as guilds, universities, and self-governing towns. Despite performing similar functions, clans and corporations were built on very different principles--with lasting consequences until today. Providing a novel answer to a fundamental question in economic and political history, Two Paths to Prosperity shows how extended kinship in Chinese society facilitated the consolidation of autocracy and hindered innovation and economic development, and how corporations in Europe influenced emerging state institutions and set the stage for the Industrial Revolution.

Reciprocity begins with a simple but unsettling question: why have we come to believe that human beings are naturally self-interested, competitive and acquisitive? This galvanising, perspective-shifting book dismantles the myth of Homo economicus to show us the way towards a world whose realities align with our true selves.Drawing on a variety of disciplines, including anthropology, archaeology, evolutionary biology, psychology, economics and social epidemiology, Richard Wilkinson demonstrates that the characteristics which we assume to be our human nature are in fact effects of the market societies we live in. He traces how various systems of exchange have created profoundly different forms of social life throughout the course of history, shaping our behaviours, motivations, and the kinds of people we become. Though it may often feel like it, the avarice and oppressions that defines the twenty-first century are not an unchangeable reality we simply have to live with. The book explains why inequality, status competition and consumerism hold so much power over us and reveals the depths to which these forces are entwined with the ever-rising crises of mental illness, political polarisation and environmental destruction. Rather than asking how we can make individuals behave better, it makes a compelling case for restructuring our societies to make life happier, meaningful and more fulfilling for one and all.Rigorously researched, bracingly practical and full of passion and hope in equal measure, Reciprocity offers a bold reinterpretation of the world we live in. It equips us with the necessary tools to look beyond and remake it in our very own, amiably human image.

FROM THE SUNDAY TIMESBESTSELLING AUTHOR OF MONEY: A USER'S GUIDEWe vow for richer for poorer. We sacrifice for our children, we give back to our parents. Because in true love and family matters, money's irrelevant and it would be terrible to suggest otherwise. Right? So why - in the privacy of the therapy room - does money emerge as one of the biggest causes of tension for modern couples? Why is it cited as the major factor in family estrangement between parents, children, and siblings? Why is there a trend for the 'Bank of Mum and Dad' to go to court to retrieve loans they regret handing over?In MONEY: A USER'S GUIDE, Laura showed us how to save into a pension and understand investment. This time, she delves into the really complex stuff - a non-judgemental examination of whether there is a "right" way to share our money with those we love, and what everyone else does behind closed doors. A book that none of us want to admit we need. How do you decide who picks up the bill, or what goes in the joint account? Is your partner being generous or controlling? Is this house mine if your parents paid most of the deposit? How much are you prepared to spend to have a baby? When should we give money to our kids, our mum and dad, our siblings, our community? Should they pay us back? What does everyone else do? Why don't we know? And why does it feel so agonisingly awkward to ask? This is a book of personal finance advice told through real stories about other people's modern money and relationship dilemmas.Laura speaks to financial advisers and wealth managers, marriage counsellors and matchmakers, philosophers, religious leaders, funeral directors and divorce lawyers, to get to the bottom of the questions that can be much more fundamental to our wealth and happiness than where to put our savings.

Constitutionalism in Asia

This book presents an in-depth interrogation of the theory and application of the Basic Structure Doctrine in the Federation of Malaysia. The Basic Structure Doctrine, famously introduced in the 1973 Indian Supreme decision of Kesavananda Bharati v State of Kerala AIR - which held that certain core or fundamental features in the Constitution of India could not be amended by Parliament even if it met all procedural requirements - was initially rejected when it was first argued in Malaysia in the 1975 case of Loh Kooi Choon v Government of Malaysia and lay dormant for the next three decades. Judicial winds shifted in 2010 when Malaysia's apex court, the Federal Court, cited Kesavananda with approval in the case of Sivarasa Rasiah v Badan Peguam Malaysia & Anor, and observed that it was 'clear from the way in which the Federal Constitution is constructed that there are certain features that constitute its basic fabric' and that 'any statute (including one amending the Constitution) that offends the basic structure may be struck down as unconstitutional.' In a quick succession of cases, the Federal Court cemented this doctrine in Malaysia's jurisprudence and deployed it to defend the court's judicial power. These widely-publicised cases generated much debate beyond the legal fraternity and judiciary and often polarised different sectors of Malaysian society. This collection of essays responds to this extremely important debate on the limits of constitutional amendments as a form of constitution-making in Malaysia by considering the theory behind the Basic Structure Doctrine and critically examining how it has been harnessed by the Federal Court and by other political actors - most notably Islamists and secularists; and royalists and republicans - on the ground.

*A New York Times Notable Book * A Financial Times Best Book of the Year 'A learned, formidable and vivid story... Readers around the world will study and ponder this monumental work of history, agreeing and arguing with it, all the while affirming its generational importance, for decades to come' The New York Times 'Epic... Read this book and you will learn innumerable things you did not previously know culled from places you have never been' Financial Times A brilliant global narrative that unravels the defining story of the past thousand years No other phenomenon has shaped human history as decisively as capitalism. It structures how we live and work, how we think about ourselves and others, how we organise our politics. Sven Beckert situates the story of capitalism within the largest conceivable geographical and historical framework in this fascinating new book.Capitalism, argues Beckert, was born global. Emerging from merchant communities across Asia, Africa and Europe, capitalism's radical recasting of economic life rooted itself only gradually. Then it burst onto the world scene, as European states and merchants built a powerful alliance that would propel them across the oceans. This epic drama corresponded at no point to an idealised dream of free markets. All along, state-backed institutions and imperial expansions shaped its dynamics.Capitalism decentres the European perspective, highlighting agency, resistance, innovation and ruthless coercion around the world through to the present with the rise of Asian economies, particularly China. Sven Beckert doesn't merely add up capitalism's debits and credits in this monumental book, but allows us to think afresh about the past to help us re-imagine the future.
