For American workers, the social contract is broken. This book gives a firsthand view of where the breaks occurred, and a prescription for rebuilding it to give workers their due. With AI making the decisions and CEOs and moguls making the money, sometimes it seems that most workers today might as well be drones. If not for a long string of missed opportunities over the last 50 years, it might have been different. In Roads Not Taken, Thomas Kochan reviews the turning points where the social contract fractured and broke, reducing workers’ voices as well as their compensation, benefits, and status. And in the lessons learned from these historical examples, he identifies the foundation for building a new labor relations system that ensures workers will share in the benefits from AI and puts America on course for an innovative and durable social contract at work. As a longtime advisor to government, labor, and management leaders, Kochan offers an eyewitness perspective on the mounting mistakes made in America’s labor relations system beginning, roughly, with Ronald Reagan’s firing of striking air traffic controllers in 1981. This book presents an in-depth interrogation of the theory and application of the Basic Structure Doctrine in the Federation of Malaysia. The Basic Structure Doctrine, famously introduced in the 1973 Indian Supreme decision of Kesavananda Bharati v State of Kerala AIR - which held that certain core or fundamental features in the Constitution of India could not be amended by Parliament even if it met all procedural requirements - was initially rejected when it was first argued in Malaysia in the 1975 case of Loh Kooi Choon v Government of Malaysia and lay dormant for the next three decades. Judicial winds shifted in 2010 when Malaysia's apex court, the Federal Court, cited Kesavananda with approval in the case of Sivarasa Rasiah v Badan Peguam Malaysia &amp; Anor, and observed that it was 'clear from the way in which the Federal Constitution is constructed that there are certain features that constitute its basic fabric' and that 'any statute (including one amending the Constitution) that offends the basic structure may be struck down as unconstitutional.' In a quick succession of cases, the Federal Court cemented this doctrine in Malaysia's jurisprudence and deployed it to defend the court's judicial power. These widely-publicised cases generated much debate beyond the legal fraternity and judiciary and often polarised different sectors of Malaysian society. This book examines the interaction between Islam and private international law in Asia. The analysis distinguishes between Muslim-majority and non-Muslim jurisdictions. Among the former, a further distinction can be drawn between Muslim-majority jurisdictions where Islamic law continues to exert a strong influence on both substantive and procedural law (including Pakistan, Bangladesh, Indonesia, and Brunei), and those where the law has been largely secularized (such as Kazakhstan, and Uzbekistan). Among the latter, non-Muslim jurisdictions can likewise be divided into two groups: those with a significant Muslim minority, often granted a certain degree of judicial or legal autonomy (such as India, the Philippines, and Thailand); and those where Muslims constitute only a small minority and where no special legal or judicial framework exists (including Japan, South Korea, Taiwan, and China). In Muslim-majority jurisdictions, the main question concerns the influence of Islamic law on the private international law treatment of cross-border cases. In non-Muslim jurisdictions, the main question concerns the acceptance of foreign law based on or influenced by Islamic law or judgments rendered in application of such laws. The chapters put the question of the interrelation between Islam and private international law in its broader theoretical context, examining the differences and similarities between the various approaches and proposing suggestions that bridge the gap between sometimes opposing approaches. The book sheds light on the multifaceted interrelation between Islam and private international law in Asia from both a theoretical and practical angle. A revelatory financial history showing that today's massive Islamic finance industry was preceded by decades of Muslim interest banking across Eurasia and Africa. Since the 1970s, the now multi-trillion-dollar Islamic finance industry has offered interest-free banking to Muslims around the world. Its proponents maintain that Islamic law strictly forbids all forms of financial interest. Many academic accounts echo this perspective, assuming that before the 1970s, Muslims either avoided interest banking out of deep-seated religious hostility or practiced it in defiance of religious stricture. Yet as Michael O'Sullivan argues, these narratives overlook rich traditions of Muslim interest banking that preceded Islamic finance. In the early twentieth century, the first modern Muslim-owned interest banks appeared across Eurasia and Africa-from India to the Ottoman Empire, Tsarist Russia, Habsburg Bosnia, Tunisia, Egypt, Iran, Palestine, and Indonesia. Viewed as a solution to Muslim economic distress, these banks intensified debates among Muslims about both the Islamic legal tradition and acceptable economic practices. While interest banks raised suspicions among some Islamic legal scholars, others explicitly defended their legality and encouraged Muslim entrepreneurs. Ultimately, O'Sullivan shows that the Islamic finance industry's commitment to interest-free banking was a product of contingency as much as principle. It was a combination of bank failures, high rates of indebtedness, and changing religious interpretations that eventually led many Muslims to reject interest banking and demand a replacement more commensurate with an "Islamic economy." Even so, the religious debates inaugurated by the first Muslim interest banks persist to this day.
