This book explores a normative and regulatory pathway for Africa's venture into outer space. It situates African space law and policy within the continent's regionalist vision and mission under Agenda 2063 while also engaging in a comparative analysis with global models to suggest new legal standards, investment approaches, and institutional measures that can be adopted incrementally by the Member States.The volume emphasises how space is no longer an aspirational luxury but a critical infrastructure for food security, climate resilience, education, medicine, and continental cohesion. It proposes the idea of 'Outer Space Pan-Africanism' as an essential lens for interpreting and shaping the political economy of outer space law and policy in Africa. It defines this 'Outer-Space Pan-Africanism' as a set of six principles based on Pan-African solidarity in outer space initiatives, technological self-reliance, equitable access to space benefits and alignment with global space law and policy. Through case studies of South Africa, Kenya, Nigeria, Algeria, Angola and Egypt, the book discusses how divergent legal and policy models interact with regional development objectives. At the same time, it also examines the significance of benchmarks drawn from the European Union (EU), Latin America and the Caribbean, the Arab World, and the Association of Southeast Asian Nations (ASEAN) in illuminating transferable lessons in funding mechanisms, governance, technology transfer and phased integration.This book will be useful for postgraduate students, researchers and academics interested in space law, international economic law, development economics and political economy, international relations and regional integration in Africa.

It explores the key issues for business and human rights in Africa and asks how and to what extent are the UN Guiding Principles changing the law and policy in Africa or the behavior of businesses operating in the continent? The book examines both the international and regional legal and policy initiatives on business and human rights in Africa and how these initiatives are being implemented in selected countries.

One of the most significant debates in international human rights law and in international law generally in the 21st century is about the responsibility of businesses for human rights in their areas of influence. The last decade witnessed significant, arguably monumental, development in global norms pertaining to the human rights obligation of businesses. Of particular significance is the emergence of a distinct business and human rights agenda driven by two normative instruments: the 2008 Protect, Respect and Remedy: a Framework for Business and Human Rights and the 2011 UN Guiding Principles on Business and Human Rights.Business and Human Rights in Africa raises interesting questions about the legitimacy and long-term viability of the business and human rights agenda in Africa, and in developing countries more generally. Whilst liberal cosmopolitanism is organized around the abstract individual, and constitutional cosmopolitanism is organized around the achievement of a formal arrangement, innate cosmopolitanism, is organized around a naturally-occurring collective whole: comprising all of humanity at any point in time, and understood as a historical phenomenon capable of exhibiting a will, interests or ends of its own. As such, innate cosmopolitanism is, he argues, is the leitmotif of international law. The book thus brings to light an ill-appreciated stream of cosmopolitan normativity in international law, and subject it to critique.

This book brings to light a neglected program of cosmopolitan normativity in international law – innate cosmopolitanism – that holds special significance in this time of competing efforts to define and direct an expanding global public order. Beginning from an intentionally broad use of the term cosmopolitan, derived from etymological roots in the cosmo-polis, Geoff Gordon draws out the main streams of thought associated with cosmopolitanism over time in discourses of international law and politics. The two best-recognized are liberal cosmopolitanism and constitutional cosmopolitanism. And, In addition to these, he introduces a third: innate cosmopolitanism. This book challenges the view that legal positivism should be reduced to a conceptual analysis of legal validity. Instead, Elena Namli reclaims legal positivism as a theory of the relationship between law, morality, and politics. Presenting novel interpretations of the classical works of Herbert L. A. Hart, Joseph Raz, and Jürgen Habermas, Namli frames legal positivism as a theory that makes possible a moral and political critique of valid law. Moreover, this book defends the dialectical relationship between law, politics, and morality by combining a positivist approach to legal validity with a constructivist ethical theory which strengthens the critical potential of legal positivism. Legally valid norms may not always be morally justified, but understanding the moral quality of legal regulations is essential for comprehending modern law.
