Why unfettered free-market capitalism endangers democracy—and what to do about it. In Private Power and Democracy’s Decline, Mordecai Kurz explores the relationship between free-market capitalism and democracy. He shows that technology has made capitalism different from what was envisioned in the Age of Enlightenment. Technology creates centers of market power and monopoly concentration that result in a society in which some people are enriched immensely while many workers’ livelihoods are often destroyed. Contrary to conventional thinking, technological competition does not remove market power, which becomes a permanent fixture of free-market capitalism. Such private power creates political inequality and generates forces that cause democracy’s decline and possible destruction. Applying these ideas to the US, Kurz shows that today’s problems begin in the 1980s with the policy of unregulated free-market capitalism. Coupled with the information technology revolution, this created a techno-winner-takes-all economy—leading to a second Gilded Age of unsustainable inequality and extreme political polarization. In the last 50 years, the economy “boomed” for some while leaving the majority of America’s workers behind. Kurz concludes that only regulated capitalism can support democracy so that the benefits of technology are more equally shared and no person’s livelihood is destroyed to enable others to be enriched. To save democracy, he proposes a “restoration-of-livelihood” policy, offering firms managerial flexibility to maintain rising productivity while ensuring that technology does not destroy the livelihood of others.

This book presents a contemporary perspective on legal rights centred on the longstanding will theory-interest theory debate. Starting with classical rights literature, central aspects of the debate in its modern idiom are contextualised within a social theory setting developed from the writings of Max Weber. The book explores the idea that the institutional and coercive character of legal enforcement necessitates viewing legal rights as a locus of social power residing within the 'institutional imagination': that is, in the decision-making of key institutional actors such as judges, prosecutors, police, governmental authorities - and ultimately supreme court judges - who routinely mobilise coercive mechanisms towards the enforcement of legal rights and powers. This marks a departure from the trend of rights literature to view legal rights largely from the standpoint of the right-holder. The book also touches on whether the emerging perspective points towards a 'third way' beyond the traditional two theoretical approaches. A major task of the study is the construction of an archetypal supreme court judge - personifying the 'institutional imagination' - fashioned, via Weberian sociology, from a critique of Ronald Dworkin's 'Herculean' judge and measured against doctrinal exegesis that draws on sources which include UK higher appellate court judgments.

This book reassesses classic Marxist theories of finance capital and uneven development in the context of the present intensified process of financialization and the accentuation of combined and accelerating uneven development. In particular, the work of Hilferding and Luxemburg is discussed and re-framed in light of both the contributions of Marx and more recent engagements by David Harvey and Neil Smith. The book explores the case of South Africa in particular in light of the combination of a rapidly financializing yet crisis-ridden South African political economy on the one hand and intensifying social inequality and political conflict on the other.&nbsp;It explores a series of strategies and possibilities that might open up trajectories for change and transformation with particular attention paid to the promises and constraints of the de-growth movement and intersectional class struggle, which will appeal to political economists, researchers, and students alongside those studying South Africa specifically. Patrick Bond is a political economist and professor at the University of Johannesburg, South Africa. He spent more than two decades teaching at the Wits University School of Governance in Johannesburg and the University of KwaZulu-Natal Centre for Civil Society in Durban. During the late 1980s he pursued doctoral studies in economic geography at Johns Hopkins University, while learning politics in the anti-apartheid, labour, student and community movements. In 1994 and 1996, he worked in the Reconstruction and Development Ministry in President Nelson Mandela’s office, drafting the democratic government’s first White Paper and a dozen other major policy documents.
