Reproductive Rights in International Law

Contested, Fragmented, Resilient

When it comes to the question of the legal significance of the so called bellum iustum doctrine, i.e. the idea of a just war, international lawyers start to feel uneasy. A large part of contemporary legal scholarship maintains the opinion that this doctrine was never part of international law. However, the subject remains controversial. The work in hand casts a new light on the longstanding bellum iustum - bellum legale controversy while taking into account the more recent narrative turn in international law with particular consideration of its implications on international legal theory. It is shown that any categorical denial of the just war doctrine in international law is flawed from the outset, since law is value-related.

Narratives on Just War in International Law

In the third millennium, the world is witnessing a growing gap between the development of technology – which has an exponential trend – and the development of legal and political structures – which has a linear trend. This gap, then, intertwines with the gap between Westernization and global Democratization. Europe, therefore, is facing new geopolitical threats that require, among other things, a rethinking of the role of the European Legal Scholar. The Author reframes this role starting from a reinterpretation of Legal Nihilism. On this basis, the Author argues that European constitutional doctrine should now focus primarily on the concrete conditions for the protection of European interests and values, starting with the military defence of Europe within the Atlantic Alliance. The cultural, political, and technical perspectives of European Defence are then examined. The wars and geopolitical crises of the 2020s led to a rapid Politicization of the European public sphere, which  responds to the crucial interest of the entire West. All things considered, Democracies are proving to be far more resilient than expected.

This book examines intermediate appellate courts by using the Irish Court of Appeal as a case study. The operation and contribution of intermediate appellate courts are often overlooked in legal scholarship, which tends to focus on apex courts, most frequently national supreme courts. However, intermediate appellate courts perform a series of vital functions, including error prevention, the development of doctrine, and ensuring that apex courts are free to concentrate on issues of exceptional public importance. The significance of intermediate appellate courts has increased in recent decades in tandem with an increase in the volume and complexity of litigation in many countries. The Irish Court of Appeal was established in 2014 and this enables a number of dimensions of non-apex courts to be examined, including the rationales for, and challenges of, inserting such a court into an existing and well-established legal system. Institutional aspects of the court such as the appointment and promotion of its judges and its rules on dissent are analysed. The process of 'setting up court' is described. In addition, its contribution to some areas of substantive law over the first 10 years of its operation is evaluated. Interviews with judges who have served on the Court enrich the book's account of its operation and development. In addition, comparative perspectives from Northern Ireland and England and Wales enhance the analysis of an integral part of many legal systems.
