This collection explores the relationship between race, racism, and human rights law. It seeks to illuminate, in particular, how the European Court of Human Rights articulates the category of race, how human rights are experienced (differently) by racial minorities, and whether the European Convention on Human Rights has the tools to recognise and address racial harms. By centring race, it considers how Convention rights would look through the lens of race and ultimately interrogates if human rights law is part of the solution or part of the problem. In pursuing these inquiries, the collection brings together two fields of scholarship that have largely developed independently of each other, namely law and race, and European human rights law. Drawing upon rich expertise from theorists and human rights scholars, it is the first of its kind to systematically analyse race and racism in relation to a wide range of themes in European human rights law, including state violence, terrorism, privacy, protest, migration, hate speech, religion, domestic abuse, reproductive freedom, medicine, education, and climate change.

Law and politics, indeed, can have a relevant function in preventing the diffusion of bad and wrong gender stereotypes.&nbsp;"Stereotypes have been and remain a notion central to feminist/ gender inquiry. This edited volume brings forth original perspectives from a wide range of scholars from multiple and diverse angles. The editors, Condello and Wagner, distinguish between the frameworks of mythos, logos and nomos to show how stereotypes are entrenched in cultural narratives, normative systems and language. Authors in the volume explore how stereotypes influence policy, cultural norms and personal identity causing discrimination and exclusion. The volume aptly underscores the importance of recognizing how race, class, ethnicity, religion amongst other identities intersect with power and play out in areas like the media, education and law.&nbsp; The various chapters reflect on the importance of interdisciplinary approaches to make sense of the persistence of stereotypes. This book analyzes the legal tensions that exist in the economy that purports to "reanimate" the dead using postmortem digital technologies. Technological reanimation has proven to be big business, with many notable commercial entities investing in this "afterlife economy". Postmortem technologies convincingly replicate the appearance, physiognomy, conversation styles, and thought patterns of a deceased individual by generating digital copies that act in their stead. In the entertainment industry, new works can be created with dead celebrities through a postmortem copy that is managed by their representatives. The result is an economy in which the dead are offered as a product or service to consumers, with some having their artistic legacies extended past death through an "afterlife career". Many stakeholders stand to benefit from such a lucrative afterlife economy, but the law is simply not prepared for the issues that will arise with this exploitation of the dead. Reanimation requires the exploitation of one's reputation, persona, artistic works, and personal data. However, the corresponding legal protections are either nonexistent, inapplicable, or inconsistent across borders - depending on which posthumous interest is analyzed. In response, and by studying the contours of the existing legal protections in the afterlife economy, this book proposes a system rooted in the "shared ownership" of one's postmortem copy and the responsible "stewardship" of legacies through fiduciary duties.Law and the Digital Reanimation of the Dead will be of considerable interest to scholars working in the areas of entertainment law, intellectual property, and law and technology, as well as others with professional interests in the area.

Misuses of Comparative Law in International Development examines how comparative law has been deployed by international organizations, governments, and NGOs to legitimize legal reforms that entrench inequality and reinforce power hierarchies. These reforms often align development agendas with neoliberal and authoritarian logics. The book exposes the flawed assumptions-such as convergence, efficiency, and legalism-that underpin transnational reform projects like the World Bank's indicators and the harmonization initiatives of the EU and OECD. It shows how these frameworks misrepresent local contexts and silence alternative legal traditions. Introducing a new typology of misuse-from cannibalization to epistemic impoverishment-it reveals how comparative law frequently operates as a tool of domination rather than emancipation. This book is the first study to consider findings from sociology, legal anthropology, ethnology, legal pluralism, comparative law and theology in order to gain a better understanding of the diverse cultures of global Catholicism and the cross-cultural challenges arising from Roman Catholic canon law within the local churches. The author, renowned for her work at the intersection of socio-legal studies and canon law, examines the latter as a distinctive example of a European religious legal system that cuts across the myriad legal cultures of the local churches. In light of findings on legal transfer and legal colonialism, and by examining canon law within the emerging field of social and cultural studies approaches to law, her book sheds light on how canon law is imposed upon and received by the local churches around the world. It analyses the challenges and problems arising from the law’s transcultural claims within these churches. Based on these observations, the study discusses the critical stance of canon law within contemporary Catholicism and the current debates on a synodal reform of the church and its law.&nbsp; The book adopts different perspectives: As a sociological study, it describes the contemporary Eurocentrism of global canon law and the conflicts arising from it. As a theological study, it presents ecclesiological reasons for challenging the hegemony of global legislation. As a study of canon law, it suggests ways in which legislation could permit greater diversity while maintaining the unity of the universal church. By analysing canon law as a specific example of a religious legal order with cross-cultural ambitions and global claims, the book also contributes to the study of transnational law in general by illustrating the typical problems that accompany transnational legal regimes in both secular legal systems and religious groups.
