The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.

This book provides a comprehensive analysis of how the influence of China's economic emergence has reshaped the definition of SOEs in regional and bilateral trade and investment agreements. This inquiry unfolds through a meticulous examination of how the legal concept of SOE in regional and bilateral trade and investment agreements involving the USA, the EU, and Japan undergoes adaptation and reform in response to China's impact, resonating with their repercussions on third countries. The book argues that China has instigated a paradigm shift in the global regulatory landscape on SOEs, compelling the USA, the EU, and Japan to embrace a novel regulatory pattern. Their response takes the form of structural revisions to the legal definition of SOEs embedded within regional and bilateral trade and investment agreements.
A key contribution of this book is to indicate how their response takes the form of structural revisions to the legal definition of SOEs embedded within regional and bilateral trade and investment agreements. It points out a progressive convergence between the USA, the EU, and Japan towards the use of the legal framework of ownership and control to legally define SOEs in regional and bilateral trade and investment agreements. This convergence has caused the spread of the ownership and control framework as a new international regulatory pattern to the definition of SOE. The USA, the EU, and Japan have been employing the framework in agreements with a range of economies from both the Global North and South.
The framework of ownership and control has been introduced as a legal tool designed to make the regulation upon SOEs more rigid and restrictive. However, more recent domestic policies by the USA, the EU, and Japan point to increased State intervention in the economy. The book thus asserts that China's influence extends beyond its active policies and practices. The USA, the EU, and Japan are reshaping the overall framework governing the legal concept of SOEs in response to China. Regulatory clauses devised to address China's challenges have been implemented in diverse contexts, impacting countries with much more diverse domestic institutions.
Despite China's economic clout driving the current international push for SOE regulation, the book suggests there are relevant clues that the emerging framework could fail to account for the diverse contexts and objectives of developing nations.This raises concerns about the potential inequities and inefficiencies of applying a China-centric framework to the Global South.&nbsp;While the book does not argue for an immediate impact on the development of Global South economies, it opens research paths on how the spread of the ownership and control framework could curb legitimate development policies.

Drawing on experiences from Sub-Saharan African countries, the book demonstrates how various economic activities impact the protection of human rights in Sub-Saharan Africa. The book explores the core concepts and principles, theory and practice, accountability mechanisms, and key challenges to the protection of human rights in Sub-Saharan Africa in the era of global economic development. It also shows the ways in which human rights law and development can be used to obtain relief for the victims of environmental degradation or adverse effects of climate change in Africa. Exploring the New Horizons of International Law Concerning Globalization of Economy

This book provides a comprehensive review of Chinese trademark law, policy and practice with the updated materials since the reform of Chinese trademark law in 2019. It provides a clear explanation and insightful opinions on Chinese law from a comparative and international law perspective. It draws on the author's 16 years of experience in teaching, researching and practicing trademark law as a scholar in a prestigious Chinese law school and as an expert consultant to the Trademark Office, courts and companies. The book analyses trademark registration (conditions and procedures) and protection (scope of rights and enforcement procedures) with theoretical criticism and practical advice. On trademark registration, it has paid special attention to two prominent issues of interest to researchers and practitioners: problems in trademark registration due to the Chinese Trademark Office's strict examination of distinctiveness, public order and morality, and the risk of conflict with earlier trademarks, and difficulties in combating trademark squatting. On trademark protection, it has presented the constant and productive reforms of the Chinese trademark law, which strengthen the sanction of trademark infringement and the policies that motivate judges to significantly increase damages to trademark owners. The book has also described the characteristics of the Chinese administrative and judicial systems, where applicable, in which trademark law is applied.
