Das Nebenstrafrecht ist keineswegs Nebensache: Betäubungsmittelstrafrecht, Ausländerstrafrecht, Verkehrsstrafrecht, Waffenstrafrecht und Wehrstrafrecht haben in der Strafrechtspraxis eine wichtige Bedeutung. Seit einigen Jahren wird Nebenstrafrecht an Universitäten gelehrt, bisher fehlte es aber an Ausbildungsliteratur. Der Band füllt diese Lücke und stellt das Nebenstrafrecht systematisch anhand vieler Beispiele dar: im 1. Teil die übergreifenden Fragen wie etwa Irrtumsfragen, im 2. Teil die praktisch bedeutsamsten Gebiete des Nebenstrafrechts.

Das Nebenstrafrecht ist in der Strafrechtspraxis keineswegs Nebensache: Betäubungsmittelstrafrecht, Ausländerstrafrecht, Verkehrsstrafrecht, Waffenstrafrecht und Wehrstrafrecht haben als wichtigste Gebiete des Nebenstrafrechts eine eminent praktische Bedeutung. In der Ausbildung wurde dieses Thema hingegen lange vernachlässigt. Seit einigen Jahren wird Nebenstrafrecht an den Universitäten gelehrt und gelernt. Bislang fehlt es aber an Ausbildungsliteratur. Diese Lücke füllt das vorliegende Buch. Es richtet sich an Studenten, Referendare und Berufseinsteiger. Im ersten Teil des Buchs werden die übergreifenden allgemeinen Fragen des Nebenstrafrechts wie etwa Verwaltungsakzessorietät oder Irrtumsfragen dargestellt. Der zweite Teil des Buchs behandelt die praktisch bedeutsamsten Gebiete des Nebenstrafrechts. Anhand vieler Beispiele werden die Grundstrukturen der einzelnen Rechtsgebiete anschaulich erläutert. Literaturhinweise ermöglichen eine vertiefte Beschäftigung mit Einzelfragen.

Beyond the Gavel: A Paradigm Shift in Global Criminal Justice

This book argues that corporate harms can and should be conceptualised as horrific because they are novel forms of damage on an unprecedented scale.There is long-term recognition of widespread, systemic harms caused by corporations and the relative dearth of response by the criminal legal system. This book argues that the harms caused by corporations generate a category crisis for criminal law. Leaving aside the difficulties that criminal law has in conceptualising the corporation as a criminal legal subject, corporate harms in and of themselves raise categorical challenges because they are beyond the imagination of the criminal law in terms of magnitude, size, type, and quality. Corporate harms tend not to be the subject of criminal law because they are too vast, too diffuse, and too disturbing for existing legal categories. Drawing on criminal law, criminology, cultural legal studies, and horror as both genre and affect, this book reconceptualises corporate harm through the lens of horror. It argues that corporate violence is structurally horrific in its scale, temporality, spatial reach, ordinariness, and institutional betrayal.This book will appeal to scholars and students with relevant interests in legal theory, law and literature, criminal law, criminology, and cultural studies.

Der Narrenturm ist ein bedeutendes Denkmal in der Geschichte der Medizin im ausgehenden 18. Jahrhundert. Gegründet wurde er 1784 für die Unterbringung von psychisch kranken Menschen. Im Jahr 1971 wurde hier das Pathologisch-anatomische Bundesmuseum untergebracht, das 2012 als pathologisch-anatomische Sammlung im Narrenturm in das Naturhistorische Museum Wien eingegliedert wurde.
Das Buch beschreibt die Geschichte des Narrenturms und die historische Entwicklung der Sammlung und bietet einen einzigartigen Einblick in die medizinische Geschichte und Pathologie im 18. Jahrhundert bis zur Gegenwart. Weitere Kapitel widmen sich dem ethischen Umgang mit Humanpräparaten sowie der Obduktion im Wandel der Zeit - von der Leichenfledderei zur High-Tech-Virtopsie. Ein großer Schwerpunkt ist speziellen Exponaten gewidmet, die die Entwicklung der medizinischen Wissenschaften und die Veränderungen in der Behandlung von Krankheiten über die Jahrhunderte hinweg dokumentieren, wobei die großen Seuchen der Pest und Cholera nicht zu kurz kommen.

This book offers a groundbreaking perspective on the use of documentary evidence in legal proceedings.
 
 In its first part, the book presents a critical overview of the current state of legal scholarship and jurisprudence concerning documentary evidence. It argues that, particularly in civil law jurisdictions, the law often rests on two flawed assumptions: that documents are sensory equivalents and that they are objective, with self-evident meaning that requires no interpretation or intersubjective validation. The result, in the author's view, is a legal culture that treats documentary evidence as a kind of objective "gold standard," obscuring the subjectivity and interpretive work that actually goes into creating and evaluating such evidence.
 
 The second part draws on general epistemology and semiotics to challenge these assumptions. It explores the role of context, the differences between human testimony and machine-generated evidence, and the need for comprehensive evidentiary sets. Through a semiotic lens, it examines various types of signs and the processes of representation and interpretation that underlie each type of documentary evidence.
 
 Building on these theoretical foundations, the third part proposes a new framework for understanding documentary evidence. It emphasizes the need for understanding the “physiological” functioning of each type of document and considers factors such as the nature of the sign, potential pathological or physiological alterations, and whether the source is human or mechanical.
 
 Finally, offers both theoretical insights and practical recommendations for all actors involved in the admission, production, and evaluation of documentary evidence—judges, lawyers, prosecutors, and others—providing tools for a more critical, contextual, and accurate approach to legal proof.
