Our oceans are suffering under the impacts of climate change. Despite the critical role that oceans play in climate regulation, international climate law and the law of the sea are developed as two different, largely separate, legal regimes. The main objective of this book is to assess how the law of the sea can be interpreted, developed and applied to support the objectives of the United Nations Climate Regime. By identifying the potential and constraints of the law of the sea regime in supporting and complementing the climate regime in the mitigation of and adaptation to climate change, this book offers a new perspective on the law of the sea and its capacity to evolve to respond to systemic challenges, and its potential to adapt and ensure a resilient and sustainable future.

The Business of Outer Space assesses selected legal issues associated with commercial space activities. The book begins by explaining the historical background that has given rise to the diverse and expanding contemporary commercial space industry, including important milestones that have facilitated the growth of the industry. The book explains the various segments or categories that make up the commercial space industry including their associated goods and services. This provides the reader with the context needed to comprehend the growth and diversification of commercial space activities from space manufacturing to satellite data services.&nbsp;The book continues with&nbsp;a&nbsp;series of topical case studies of relevance to various space activities. For example, the book dedicates&nbsp;a&nbsp;chapter to examining the close connection that exists between commercial and military space activities and analysing how dual-use technologies offered by commercial entities have an important role to play in military space operations. The book continues with&nbsp;a&nbsp;deep dive into the emerging connections between the artificial intelligence industry and space industry, and the risks and opportunities therein.&nbsp;A&nbsp;significant and timely case study within the book is the regulation of satellite (mega) constellations. This case study examines commercial and regulatory issues associated with the deployment of satellite constellations, paying close attention to how current international space legal frameworks might regulate such activities. Of particular relevance to many space businesses is the topic of intellectual property. The book described in detail the application of patent law in the context of space activities and discusses how international space law and certain domestic laws may provide greater certainty for space actors with regards to intellectual property and space activities. Humanity in the twenty-first century faces serious global challenges and crises, including pandemics, nuclear proliferation, violent extremism, refugee migration, and climate change. None of these calamities can be averted without robust international cooperation.&nbsp;Yet, national leaders often assume that because their states are sovereign under international law, they are free to opt in or out of international cooperation as they see fit. This book challenges conventional wisdom by showing that international law requires states to cooperate with one another to address matters of international concern-even in the absence of treaty-based obligations. Within the past several decades, requirements to cooperate have become firmly embedded in the international legal regimes governing oceans, transboundary rivers, disputed territories, pollution, international security, and human rights, among other topics. Whenever states address matters of common concern, international law requires that they work together as good neighbors for their mutual benefit. International law requires that, before any new weapon is developed, purchased or modified, the legality of its use must be determined. This book offers the first comprehensive and systemic analysis of the law mandating such assessments - Article 36 of the 1977 Additional Protocol I to the Geneva Conventions. Underpinned by empirical research, the book explores the challenges the weapons review authorities are facing when examining emerging military technology, such as autonomous weapons systems and (autonomous) cyber capabilities. It argues that Article 36 is sufficiently broad to cover a wide range of military systems and offers States the necessary flexibility to adopt a process that best suits their organisational demands.
