Wissenschaftlicher Aufsatz aus dem Jahr 2019 im Fachbereich Jura - Rechtsphilosophie, Rechtssoziologie, Rechtsgeschichte, , Sprache: Deutsch, Abstract: Die Strafform des „Säckens“, aus dem römischen Recht übernommene Hinrichtungsart, die 1532 in die „Carolina“ übernommen worden ist und meistens an Frauen praktiziert wurde, die – ja zumeist in der persönlichen Not – ihre Kinder getötet haben, lässt heute viele Fragen offen. Das Hinzunehmen einer Menagerie von Tieren (Hund, Hahn, Schlange und Affe) in den mit der Delinquentin unterzutauchenden Sack stößt heute auf Unverständnis. Es war aber gesetzlich verankert, und die Gerichte hatten sich – mit wenig Spielraum – daran zu halten. Die hier beschriebene Strafform ist die am wenigsten studierte oder ergründete Art und Weise, Angeklagte in früheren Zeiten vom Leben zum Tode zu bringen. Die Hintergründe sind heute fast ausschließlich nicht mehr nachvollziehbar, sie bleiben im Dunkeln. Die Zahl der überlieferten Fälle ist übersichtlich. Weshalb die Mütter ihre Kinder getötet haben – ungewünschte Schwangerschaften, Vergewaltigungen durch Haus- und Hofherren, Behinderung beim Beibringen des Lebensunterhaltes – wird nirgends deutlich. Gnade war selten, die Richter waren dem Buchstaben des Gesetzes verpflichtet.
