Die Befugnisse der Strafverfolgungsbehörden für die Erhebungen von Daten bei Privaten - primär die §§&nbsp;94 ff. sowie § 161 I 1 StPO - stammen im Kern noch aus dem 19.&nbsp;Jahrhundert. Können diese in Anbetracht der Entwicklung der verfassungsrechtlichen Maßstäbe des Datenschutzrechts noch eine verfassungsrechtlich tragfähige Eingriffsgrundlage bilden? Emma Peters setzt sich mit den tatsächlichen Kommunikationsbedingungen der Informationsgesellschaft, den Reaktionen in der Praxis der Strafverfolgung im Rahmen des einfachen Rechts sowie der Rechtsprechung des Bundesverfassungsgerichts zum Datenschutzrecht auseinander. Sie zeigt auf, dass die scheinbar selbstverständlichen Ermittlungsbefugnisse zur Datenerhebung bei Privaten mit der Entwicklung des Datenschutzes in den letzten 20 Jahren, wie sie insbesondere in der Rechtsprechung des Ersten Senats des Bundesverfassungsgerichts geprägt wurden, nicht mehr ohne weiteres vereinbar sind und grundlegendem Reformbedarf unterliegen.

This book explores data science in practice through an ethnographic study at a global marketing technology and research firm. The book shows that, while businesses have embraced data science methods to understand markets and consumers, in practice they produce too much information. Consequently, they must be combined with creative practices that simplify and make sense of analytics. Cluley shows that in the age of data science, business is increasingly artistic. In this case, marketing science is more like marketing science fiction. This is essential reading for understanding contemporary data-driven business and marketing as well as social and economic relations in the age of surveillance capitalism, with lessons for academics and students of marketing, technology and data science.

Environmental degradation has been part of American life for centuries, and yet environmental journalism as a specialized reporting beat has only existed since the 1960s. In the ensuing decades, the environment has fallen in and out of favor as a priority for news organizations. Moreover, journalists who pursue environmental stories have long been dogged by a reputation that they are activists, a charge that delegitimizes their labor and further undermines the potential for news organizations to commit to reporting on environmental issues. In The Environmental Beat: Inside the Struggle to Legitimize the Environment as News, Suzannah Evans Comfort examines the circumstances under which news organizations chose to invest in environmental journalism since the early 20th century, demonstrating that a combination of external social factors and internal newsroom dynamics must occur for the environment to appear as a newsworthy topic. Comfort also examines actors on the margins of journalistic legitimacy, such as newspaper outdoor columnists who wrote on the sports pages, and environmental advocacy presses that provided a far more consistent source of environmental news making than their peers in the newsroom. These low-status actors in the journalistic field embraced advocacy and rejected both-siderism in their reporting on issues of the environment. Their consistency and longevity, even as more traditionally produced news attention waxed and waned, may provide an explanation for the perception of environmental news making as fundamentally activist. The Environmental Beat will be of interest to working journalists as well as scholars of journalism.

Every day, data is collected about how you live. This data is owned by large technology companies in the US and China. Google, Facebook, Amazon, and TikTok have become such a big part of society that important decisions are being moved from democratic assemblies to closed boardrooms. On the one hand, technology makes our lives more exciting and richer. At the same time, it can create economic disparities the world has never seen before. Technology companies are developing increasingly advanced forms of artificial intelligence that can solve key tasks, but also threaten our freedom more fundamentally than ever before in history.
Hilde Nagell shows how it is possible to return control to the people and to democracy. She has spoken with politicians, philosophers, trade unionists and technologists, and ultimately proposes a Nordic model for digitalisation and data sharing. This book is novel in that it provides insights into the effects of information provision on people's perceptions and behavioral changes during the pandemic, and provides empirical evidence on its mechanisms and policy implications from different perspectives. It compares the different characteristics and effectiveness of information sources from the government, the news media, professionals in the field (health care workers), non-professional ordinary people, and the close environment, including family, friends, and colleagues. The consumer externality is the key concept in the analyses, as it identifies the effects of one's own consumption on the actions of others in constrained situations such as pandemics. Data from surveys conducted in Japan, the United States, and Germany suggest some implications for policymaking during a pandemic. One is related to differences in the characteristics of information. For example, information from experts in the field is perceived differently than information from other sources. Similarly, information from authorized organizations such as government and the news media remains critical in an emergency. Another relates to behavioral changes caused by the provision of information. Clearly, the effects of information on behavior change depend on the characteristics of the activity being addressed. We examine the effects on out-of-home and in-home activities during the pandemic, both of which focus on leisure activities, and show that the effects of information on each activity are quite different. Overall, this book provides empirical evidence for the importance of information dissemination policies that work with appropriate information providers and take into account country-specific attitudes to information.
