Human Rights Law in Perspective

This book offers an analysis of how the European Court of Human Rights engages with identity and emotion, revealing both the promise and the limitations of human rights law in addressing the complexities of human experience. The book explores how human rights law, often framed as universal and abstract, responds to deeply personal questions of identity, belonging, and emotional impact. Based on a systematic study of over 3,300 judgments, the book shows how the European Court of Human Rights has increasingly made identity central to its reasoning - particularly in cases involving sexuality, ethnicity, and family life. In these areas, the Court acknowledges how state actions shape emotions such as fear, humiliation, and dignity. Yet, in other domains - migration, religion, professional life - the Court avoids emotional engagement, leading to troubling inconsistencies. The book argues that when emotions are excluded from legal reasoning, individuals are reduced to formal entities, stripped of depth and interiority. Combining doctrinal analysis with insights from social theory and psychology, the book presents a new framework for understanding how emotions and identity interact with law. It traces the evolution of identity references across categories and highlights the Court's uneven treatment of emotional harm. This timely and original contribution speaks to legal scholars, practitioners, and theorists interested in human rights, identity politics, and the emotional dimensions of law. It calls for a more responsive and empathetic human rights jurisprudence - one that reflects the lived realities of those it seeks to protect.

This wide-ranging intellectual and media history traces China's emergence as a modern state in which boundaries blur between art and design, education and psychological conditioning. Tracking the parallel development of set design and social engineering from the 1920s to the 1960s, Background Matters examines the concept of huanjing (environment), a neologism introduced at the turn of the twentieth century that evoked heated intellectual debates and inspired frenzied aesthetic experimentation. Weihong Bao shows how efforts to reshape the mind consolidated the idea and art of environment by advancing a new theoretical notion of set design: both as aesthetic organization across film, theater, radio, and television and as social experimentation in worldmaking across geopolitical and transnational contexts. Inventive and breathtaking in scope, this book radically rethinks environment not as an external object but as the nexus of mind, medium, and society.

Background Matters: Volume 9

Social Science for Social Justice

Cultural appropriation is one of the most contested issues of our time - but what does it actually feel like to have your culture taken, repackaged, and sold back to you? In this book, Rina Arya moves beyond familiar debates to place the lived experiences of minoritised communities at the centre of the discussion. Drawing on postcolonial theory, lived religion, cultural studies, and her experiences as a British South Asian, she examines how cultural forms are commodified, transformed, and returned to their communities with renewed authority. Arya argues that the deepest harms of cultural appropriation are not only economic or representational but also psychological, reshaping how people understand their culture and identity. Combining rigorous scholarship with personal testimony, this book challenges readers to rethink who has the authority to define culture - and what is lost when that authority shifts away from the communities from which culture originates.

Critical Memory Studies

This open access book proposes slow memory as a new framework for understanding how remembrance operates across time, urging scholars and practitioners to resist the acceleration that characterizes both contemporary scholarship and public memory cultures. The authors explore the theoretical foundations of slow memory, emphasizing themes of deep time, intergenerational justice, and contested memory regimes. The collection focuses on the fields of environment, (de)industrialization, welfare, politics, and conflict to examine how gradual transformations impact the present through remembrance practices at different tempos. It advocates for a deceleration of scholarly and commemorative practices to develop ethical, sustainable, and inclusive engagements with the past. By foregrounding slowness as a conceptual and methodological tool, and slow memory as a "connective concept," this book offers a vital framework for scholars, policymakers, and practitioners seeking to rethink the temporalities of remembrance in an era of rapid transformation. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com. This publication is based upon work from COST Action CA20105 on Slow Memory, supported by COST (European Cooperation in Science and Technology). COST is a funding agency for research and innovation networks. Our Actions help connect research initiatives across Europe and enable scientists to grow their ideas by sharing them with their peers. This boosts their research, career and innovation.

Slowing Down Memory Studies

"In one wide-ranging volume, Lambert and the country reporters demonstrate that law can not only keep up with technological change, but can in fact stay well ahead by anticipating upcoming questions. The Legal Pluralism of Heritage: Restitution and the Normative Knowledge of Communities of Origin explores one of the most urgent debates in international cultural heritage law today: the role of Indigenous laws and local norms about material culture in the restitution process. In an era of rising claims for restitution, this book examines how diverse legal and normative orders engage with communities seeking the return of cultural objects held in museums, private collections, and institutions worldwide. It argues that restitution processes need to consider the normative knowledge of communities of origin. Moving beyond conventional legal analysis, the volume includes theoretical interventions and case studies from (international) law, anthropology, archaeology, history, museum studies, art history and Indigenous legal studies, and from all five continents. It offers a new framework for understanding restitution not merely as a legal process, but as a dialogue between legal systems and the knowledge traditions of the communities to whom heritage belongs.Timely and thought-provoking, this book is an essential resource for researchers and practitioners in international law, legal history, historical anthropology, and cultural heritage studies.
