Food Innovation and Legal Challenges

This volume explores the various intellectual property dynamics that emerged during the Cold War, circa 1946-1980. This period brought about some of the most poignant moments in the development of twentieth-century international intellectual property rights, when competing economic systems recognised the value in innovation, human creativity, cinema, and international intellectual property norms and institutions. Examining these developments from a Cold War approach can say much more as it allows for the examination of processes and norms that cater to strong domestic intellectual property rules in Western capitalism while yielding to 'universal' or 'common' property norms in copyright in socialist states. This volume connects some of the different advances made in the international emergence of these competing developments regarding intellectual property rights and emphasises the role of intellectual property institutions, processes, and universalism that helped keep Cold War rivals on the same normative, foundational street for intellectual property rights. The Cold War Structure of International Intellectual Property Law, 1946-1980

This book critically examines the evolving landscape of nanomedicine and its intersection with patent law, focusing on the Indian patent system in comparison with both US and EU frameworks.Through a detailed scientific and legal analysis, this book explores whether nanomedicine inventions meet patentability criteria and examines how current regulations shape innovation in the field. It reveals that nanomedicine innovation, particularly in cancer therapeutics, is often driven by regulatory compliance rather than genuine therapeutic advancements. Empirical research, based on patent claims and prosecution histories from the Indian Patent Office (IPO), the US Patent and Trademark Office (USPTO), and the European Patent Office (EPO), highlights significant gaps in IPO Manuals and guidelines. These inconsistencies have led to the grant of low-quality patents, potentially stifling innovation and undermining India's patent regime. To address these challenges, this book proposes illustrative examples and tests for adequately examining nanomedicine patent claims, aimed at fostering high-quality patents and ensuring robust adjudication of nanomedicine inventions. Counterfeiting, AI, and the Fight to Prove What's Real

Patents play an important role in inducing the investment needed to transform basic discoveries into the practical innovations that contribute to long-term economic growth. But patents also can generate a variety of social costs which, if unchecked, can unnecessarily impede competition, inhibit innovation, impair the integrity of the marketplace, and reduce overall social welfare. 

Wrongful Patent Assertion provides the first comprehensive, comparative overview of how the world's leading jurisdictions for patent litigation employ different bodies of law and legal doctrines-including antitrust and unfair competition law, as well as other generally-applicable legal principles-to regulate the enforcement of patent rights, and how these efforts might be improved. This book concerns the often fractious interface between drug discovery and commercialisation, environmental degradation, the biodiversity crisis, the exploitation of indigenous peoples and the destruction of their culture, the right to health, inequalities of power, and the ability of the law to protect knowledge.

For millennia, medicinal plants have provided a trove of treatments for human ailments, and the key to that treasure has been the traditional knowledge of the indigenous peoples who have lived alongside these plants. More recently that knowledge has been taken, often without consent or recompense, by Western science as a springboard for the development of pharmaceutical agents. As a response to threats to biodiversity and indigenous culture, international mechanisms have created, or are creating, enforceable rights for indigenous peoples to control such knowledge.

With a background in pharmacology and molecular biology and significant experience as a lawyer in pharmaceutical and biotech patent litigation, the author brings a fresh perspective to understanding the difficulties of enforcing such rights and, in particular, examines whether there is a philosophically justifiable limit to the downstream scope of such rights.
