Studienarbeit aus dem Jahr 2025 im Fachbereich Jura - Steuerrecht, Note: 12,00, Ludwig-Maximilians-Universität München, Veranstaltung: Schwerpunktseminar zur Digitalisierung im Steuerrecht, Sprache: Deutsch, Abstract: KI hält zunehmend auch in der Welt des Steuerrechts Einzug. Gerade für eine funktionsfähige Verwaltung drängt sich dadurch geradezu die Frage des Einsatzes von entsprechenden Tools auf. Eine solche Methode, die im internationalen Raum zunehmend an Bedeutung an Bedeutung gewinnt, ist Predictive Analytics. Im Gegensatz dazu wird in der deutschen Steuerrechtsliteratur geradezu eine Forschungslücke in Bezug auf die rechtliche Bewertung des Einsatzes von Predictive Analytics, etwa bei Einsatz in der Finanzverwaltung, deutlich. Diese Arbeit nimmt vor diesem Hintergrund eine dogmatisch fundierte rechtliche Einordnung von Predictive Analytics im Besteuerungsverfahren vor. Das Ziel ist, einen ersten Über- und Einblick in die Problematik zu bieten und das Feld für künftigen Diskurs zu eröffnen. 

Neben einer Begriffsklärung sollen praktische Anwendungsmöglichkeiten erschlossen und rechtlich zulässig gestaltet werden. Auch auf die aktuelle Lage wird mittels eines Vergleiches zu den bestehenden Risikomanagementsystemen eingegangen. Diese weisen zwar erste Strukturen eines algorithmischen Vollzugs auf, jedoch genügen die bisher bestehenden normativen Vorgaben bei weitem nicht, um auch einen KI-Einsatz in der Steuerverwaltung sinnvoll und praxistauglich zu gestalten. 
Aus verfassungsrechtlicher Sicht wird verstärkt auf zentrale Prinzipien wie die Gesetzmäßigkeit der Verwaltung, die demokratische Legitimation staatlichen Handelns und die Rechtsanwendungsgleichheit durch algorithmische Entscheidungsprozesse eingegangen und Herausforderungen aufgezeigt. Besondere Aufmerksamkeit gilt der "Black¿Box"-Problematik sowie der Gefahr systemischer Bias, die Transparenz¿ und Kontrollanforderungen des Rechtsstaats berühren. Ergänzend werden die europarechtlichen Vorgaben - insbesondere die DSGVO und die KI¿Verordnung - als normative Leitplanken für die Entwicklung eines rechtssicheren digitalen Gesetzesvollzugs herausgearbeitet.
