Global Challenges in the Environmental Humanities

Adopting a multidisciplinary approach to climate adjudication, this open access book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania. Thai Private International Law

This book employs deductive and inductive reasoning within traditional civil law normative analysis, supplemented by legal historical sociology research methods, to precisely trace the developmental trajectory and societal operational patterns of the law of obligations. Based on this, it derives both the intrinsic and extrinsic systems of the General Provisions on Obligations. By elucidating the contextual significance and systemic functions of the General Principles of Obligations, this monograph achieves theoretical integration between the Contract Law and Tort Law sections of the Chinese Civil Code, thereby enhancing the code's systemic efficacy. From historical, systemic, and functional perspectives, it comprehensively analyzes the legislative and academic origins of the General Principles, their internal and external frameworks, and their roles in value coordination and normative unification. It simultaneously demonstrates how internal system values achieve coherent integration, how external system efficacy is maximized, and the mediating role of flexible system theory in reconciling conflicts between the two. Furthermore, adopting a micro-level perspective, the book explores the normative functions of the General Principles of Obligations as manifested in doctrines such as unified restitution claims, joint and several liability, and competing claims on a debt. This book examines how various methods of digital communication have entered the domain of EU Civil Procedure, with a primary focus on the service of documents, electronic submissions, the taking of evidence, and videoconferencing. It offers a comprehensive overview of legal issues surrounding the use of digital technology in the aforementioned areas and draws insight from the national legal doctrines of 15 EU Member States and select candidate countries. On the one hand, the research employs the comparative legal method to draw conclusions on commonalities and differences, as well as prospects for future approximation of laws. On the other hand, the book addresses open issues at the EU (supranational) level. The research is rooted in the observation that a paradigm shift from traditional to digital means of communication between courts and other judicial partakers is currently taking place. This shift is manifested through a variety of technologies and affects a wide legal landscape. The EU is heralding the incorporation of these developments in its latest legislation on cross-border disputes. The research deals with analyzing both existing (digital and traditional) and prospective means of communication in national and cross-border disputes. It traces their legal foundations, historical evolution, regulatory context, and real-world impact, showing how each system addresses the complex challenge of safeguarding children in digital environments.Through accessible analysis, the book explores key issues including parental consent, age thresholds, and the effectiveness of age-verification and assurance mechanisms. The roles, responsibilities, and rights of parents, alongside the duties of data controllers, are examined in detail. It also highlights the gap between legal requirements and their practical enforcement, supported by case law and real-world examples, including social media practices such as child influencers and parental sharing. Taken together, these analyses examine whether current approaches adequately protect children’s best interests in digital environments.Moving beyond critique, the book calls for a shift toward more child-centered regulatory approaches. This book connects European private international law with decolonial theory. Decolonial theory calls for alternative modes of producing legal knowledge - ones that give greater weight to the worldviews of formerly colonised peoples across the globe, including in Europe. At the same time, private international law has been described as a particularly suitable field for welcoming more otherness (altérité) in European law. This book therefore develops a decolonial theory of European private international law. To do so, it begins with Western court cases involving what the author terms a 'conflict of worldviews': a clash between the legal frameworks governing the dispute and the worldviews of the formerly colonised parties involved, referred to here as 'postcolonised worldviews'. Through three case studies - respectively addressing religious arbitration, Indigenous sacred land, and faith-based politics - the book demonstrates that courts routinely overlook these conflicts. As a result, the claims of formerly colonised parties are inadequately addressed. To remedy this structural discrimination within European private international law, the book proposes a pluralised theory of choice of court, foreign law, and international jurisdiction, more empowering of the postcolonised worldviews present in the case studies, and supportive of the emancipation of vulnerable identities among postcolonised people. This is an important work, thought-provoking and challenging, which should be read by private international law and comparative law scholars, and more generally by legal and non-legal scholars interested in legal theory and decoloniality.
