Library of Selected Cases from the Chinese Court

This book includes focal and vital cases tried by presiding justices, guiding cases from the Supreme People's Court, and cases discussed at the Joint Meetings of Presiding Judges from various tribunals. This book is divided into three sections, including Cases by Justices, Guiding Cases, and Typical Cases, which will introduce readers to Chinese legal processes, legal methodology, and ideology in an intuitive, clear, and accurate manner.

This book presents cases selected by the trial departments of the Supreme People's Court of China from their concluded cases. In order to give full weight to the legal value and social function of cases from the Supreme People's Court, and to achieve the goal of "serving the trial practices, serving economic and social development, serving legal education and legal scholarship, serving legal exchanges among Chinese and foreign legal communities and serving the rule of law in China," the China Applied Jurisprudence Institute, with the approval of the Supreme People's Court, opts to publish Selected Cases from the Supreme People's Court of the People's Republic of China in both Chinese and English, for domestic and overseas distribution.

Selected Cases from the Supreme People’s Court of the People’s Republic of China

The German-Japanese Colloquium on Administrative Law institutionalizes and strengthens the long-standing connection between German and Japanese administrative law scholarship. This volume brings together the contributions of the 2nd German-Japanese Colloquium on Administrative Law, which took place at the University of Tokyo in April 2025, two years after the inaugural event in Heidelberg in 2023. This volume focuses on administrative procedures in transition, taking into account governmental, administrative, and judicial aspects. New requirements for efficiency, transparency, and participation are changing the structure of procedures and challenging the legal systems of both countries. The following topics are covered in detail: administrative court legal protection between subjective legal defense and objective legal control, functions of administrative procedures in transition, errors and consequences of errors in administrative procedures, and administrative functions of the government. Further attention was paid to the current reform discussions on the acceleration of administrative procedures in Germany and on informal administrative action in Japan.

Einheitliche Vorgaben für die Cybersicherheit
Mit dem Gesetz über Cyberresilienz (Cyber Resilience Act - CRA) werden zum ersten Mal spezifische Cybersicherheitsanforderungen für den gesamten Lebenszyklus eines digitalen Produkts in einem Regelwerk EU-weit verankert. Betroffen sind materielle digitale Produkte und nicht eingebettete Software. Damit erfasst die unmittelbar geltende Verordnung sowohl Hardware als auch Software in ihrem gesamten Lebenszyklus. Nur zwei Jahre haben die Anwender:innen Zeit, sich auf die Regeln einzustellen.

Der neue Großkommentar
Der "NK-CRA" von Schröder/Hartl erscheint zeitnah zum Inkrafttreten der Verordnung und ermöglicht eine praxisorientierte und zugleich wissenschaftlich fundierte Anwendung des "CRA". Er erläutert die Neureglungen präzise und verständlich, zeigt auf, wie die juristischen Probleme in der Anwendung liegen, und präsentiert tragfähige Lösungen.

Eini Haaja is Research Manager at the Pan-European Institute (PEI) at Turku School of Economics and Postdoctoral Researcher at Turku Institute for Advanced Studies (TIAS) at the University of Turku in Finland. She has specialised in International Business with an emphasis on the business developments in the Baltic Sea and Barents Sea regions. She has been involved in several industry-academia research projects and has published research on opportunities, risks and business network dynamics amidst changes in business environment, most recently focusing on the multi-layered challenges in pursuing green transition.
Anna Karhu is Research Manager at the Pan-European Institute (PEI) in Turku School of Economics, University of Turku. Her research focuses on the intersection of business and policy. Specifically, she studies how these two actor groups interact in business environment transformations. She has studied these dynamics through institutional change perspective in context of pharmaceutical industry, international retailing and trade policy systems.

Die Arbeit untersucht die Völkerrechtskonformität der stratosphärischen Aerosolinjektion (SAI) als Geoengineering-Technologie zur Minderung gravierender Klimaschäden, die jedoch selbst mit erheblichen ökologischen Nebenwirkungen verbunden ist. Vor diesem Hintergrund wird analysiert, inwieweit SAI-Forschung und -Einsatz durch bestehende völkerrechtliche Normen reguliert oder begrenzt sind. SAI zielt darauf ab mittels reflektierender Materialien einen 'künstlichen Sonnenschirm' in der Stratosphäre zu errichten, um einen weiteren Temperaturanstieg zu verhindern. Die Untersuchung zeigt, dass Völkergewohnheitsrecht und zentrale internationale Abkommen bereits einen engen normativen Rahmen bilden, der den Einsatz von SAI-Technologien erheblich einschränkt.

Drawing on selected case studies and doctrinal analysis, it examines how litigation funding has evolved from a traditionally prohibited practice into an increasingly visible, yet still contested, feature of contemporary civil justice. As litigation costs continue to rise and collective redress mechanisms expand, TPLF has emerged as a practical means of enabling claims that might otherwise never reach the courts. At the same time, courts and policymakers remain cautious about third-party involvement in litigation, particularly where questions of control, transparency, fairness, and public policy arise. The lack of clear and consistent legal standards across jurisdictions has produced fragmented regulatory approaches and ongoing legal uncertainty, especially in relation to champerty, claim assignment, and the proper scope of judicial oversight. The book explains how and why courts in different EU jurisdictions permit, limit, or refuse claims involving TPLF, and clarifies the legal reasoning and policy considerations that underpin these decisions. It also addresses the particular challenges posed by funded collective and competition actions, where courts must carefully balance improved access to justice against the risk of excessive commercialisation of litigation.
