The Art, Morality and Law of War

In the late 1950s, jurists engaged in intense debates about the terminology of European law. Terms such as supranationality, confederation of states, or federal state were regarded as shaped by the nation-state and as polarizing. Linguistic innovations, distinct linguistic rules for European law, and a language of imagery and metaphor were needed. A linguistic transformation took place-a transitional period (a 
 Sattelzeit
 ) that continues to shape how we communicate about European law today. The term 
 Sattelzeit
 is coined in reference to the conceptual historian Reinhart Koselleck and denotes a particularly profound shift in language. With this European 
 Sattelzeit
 , indeterminate associative terms and modes of expression became established in European law that raise difficult questions-for example, whether European law and national law constitute one, two, or several legal orders; whether European law has its own source of law; whether it was created through an overarching act; or whether it is a "community of law." Such formulations have not only made the specialist language of European law more confusing, but presumably also more political. The approach of the present study is both historical-critical and analytical. Who used which legal expressions, for what purpose? And what are good linguistic rules for our specialist language of European law? Thorben Klünder systematizes the vocabulary of European law, traces its historical development, and offers a critique of European legal language, metaphor, and theory.

Great Debates in International Law

International trade and public health have long been in tension, with intellectual property law partially to blame. Patent protections have created strong pharmaceutical monopolies, making medicines unaffordable in many countries, blocking access to healthcare, and disrupting global supply chains. Attempts to remedy these public health failures have largely been fractured, with stop-gap efforts failing to meaningfully resolve the structural issues at the intersection between access, innovation, and regulation. Rather than treating these areas as separate domains, this book advocates for a holistic regulatory approach that centers public health while recognizing the deep interconnections with IP and trade. The authors argue that advancing innovation and global development requires recalibrating legal and policy frameworks to prioritize global public health as a necessary foundational requirement for robust trade and development. Tracing the evolution of these tensions across six chapters, the book critiques current regulatory reform efforts and proposes principles for a new public health framework: a treaty that places health not in opposition to trade and IP, but firmly at the center.

Forests are central to international security, peace, and justice, as they provide livelihoods for millions of impoverished people in developing countries. Threat's to the world's forests may result in a reduction in basic livelihood resources and will have significant consequences on a global scale. There is no existing international treaty on the protection of forests, with the result that their international protection is governed by disparate areas of international law and smaller-scale local initiatives. In this context, this book reviews the history of international law on forests, evaluating the effectiveness of the existing international legal framework to protect them. The book investigates the impact of the initiatives which have emerged in the absence of a dedicated international agreement, including Reducing Emissions from Deforestation and Forest Degradation (REDD+) and forest certification, which are assessed in the wider context of the development of international environmental law. It also considers the role of regional forest agreements in the international protection of forests. It assesses the challenges to the effectiveness of international law governing forests, in particular the disparate nature of the law as it stands, and posits that the solution can be found in existing regional agreements. It argues that a more specific international treaty, consistent with the recent decisions of international courts on environmental protection and building on the experience of regional legal instruments, may offer an effective path forward.

This book unveils gaps, inconsistencies, and barriers to accountability emerging from the intersections between IHL and ICL in the definition and treatment of indiscriminate and disproportionate attacks as jus in bello violations. The book identifies and explains the unresolved legal problems surrounding the prevention and control of indiscriminate and disproportionate attacks as international war crimes, and critically unpacks the macroscopic implications of these problems for international adjudications. It goes on to address the challenges posed by these attacks as key causes of civilian victimization in war. The author demonstrates that the Rome Statute of the ICC, legibus sic stantibus, does not allow to prosecute and punish the most recurring forms of indiscriminate and disproportionate attacks, crucially impairing the ability of this institution to pursue the objectives declared by its founding treaty. It concludes by offering two amendment proposals for the Rome Statute to bridge the gaps and overcome the antinomies identified.

Indiscriminate and Disproportionate Attacks in International Law

The China-Pakistan Economic Corridor (CPEC) represents the largest infrastructure project of its kind, spanning 3,000 km and linking two nations. This monograph is the first to provide a comprehensive analysis of the environmental governance gaps and reform pathways of the CPEC.Drawing on primary and secondary sources, project monitoring data and policy analysis, the book examines the reasons for the divergence in environmental standards between China and Pakistan. Pakistan's 27-year-old environmental legislation, fragmented provincial governance and limited regulatory capacity are inadequate for overseeing a USD 62+ billion corridor designed by a nation with advanced environmental institutions and robust enforcement mechanisms. Rather than merely critiquing current trajectories, the book proposes a three-pillar approach and a bilateral institutional framework in the form of a Joint CPEC Environmental Commission. This commission would have authority over Phase II projects (2025-2035) and could align infrastructure development with climate commitments and biodiversity protection.Through legal analysis and comparative institutional assessment, the book offers policymakers, civil society, and scholars a practical blueprint for sustainable transnational development.

Ansgar Baumgarten develops the concept of "direct indirect implementation" as a new category of European administrative execution. This form of implementation describes situations in which EU authorities apply national implementation law in order to indirectly enforce EU law. For the first time, this mechanism enables the EU to apply national law that transposes directives or specifies options contained in regulations. In doing so, it closes an existing gap and ensures the uniform and effective enforcement of the underlying EU law. It marks a new stage in the Europeanization of administrative execution and strengthens the primacy and practical effectiveness of EU law. Article 291 TFEU does not limit the delegation of executive powers. Under the principle of subsidiarity, the EU may also act in the field of implementation insofar as enforcement deficits in the member states endanger the uniform application of EU law. The principle of democracy remains safeguarded, since administrative action rests on a dual democratic foundation-both at the EU and the member state level. Looking ahead, direct indirect implementation provides a tool for enhancing the effectiveness of EU administrative enforcement, for example in the areas of European migration and cybersecurity law. It links national lawmaking with EU-level enforcement and thereby expands the EU's capacity to act - also in the interests of the member states.
