Die Panikstörung gehört zu den Angststörungen und kommt relativ häufig vor. Derecho aplicado a la función policial

La formación en Derecho penal resulta esencial para la labor diaria de las Policías Locales. A diferencia de otros cuerpos de la Administración Pública, la Policía trabaja a pie de calle, en contacto directo e inmediato con los conflictos que pueden llegar a convertirse en procedimientos penales, como pueden ser peleas en la vía pública, violencia en el ámbito familiar, delitos contra la seguridad vial, delitos contra el patrimonio, desórdenes públicos, etc. Cada identificación, cacheo, detención o atestado tiene consecuencias jurídicas que, si no se ajustan a la Constitución y a la ley, pueden provocar la nulidad de las diligencias, la absolución de personas que sí cometieron un delito o, incluso, la depuración de responsabilidades del propio agente.

En ese contexto, el Derecho penal se estudia aquí como una herramienta de trabajo imprescindible: por un lado, es el instrumento más severo de control social (penas, medidas de seguridad); por otro, es un Derecho de garantías, que limita el poder punitivo del Estado mediante principios como legalidad, culpabilidad o proporcionalidad. La dogmática penal española, recogida en manuales de referencia como Derecho penal. Parte general de Mir Puig o Muñoz Conde, concibe el delito, de forma clásica, como una acción u omisión típica, antijurídica, culpable y punible; esta definición no es solo teórica: ofrece un esquema ordenado para valorar, paso a paso, si los hechos que un agente presencia o documenta son realmente delictivos y qué consecuencias pueden tener. 

La jurisprudencia reciente ofrece además criterios específicos de interés para la Policía Local: decisiones del Tribunal Supremo sobre la valoración del uso de la fuerza en intervenciones policiales, la existencia de un plus de antijuridicidad cuando el agente abusa de su posición, o sobre la diferencia entre dolo eventual e imprudencia consciente en delitos del tráfico y agresiones. 

Este manual, por tanto, no pretende convertir al Policía Local en penalista, sino proporcionarle un lenguaje común con jueces, fiscales y letrados, y las herramientas básicas para trabajar con mayor seguridad jurídica. Cada intervención policial es, en el fondo, un punto de contacto entre la realidad social y el sistema penal: cuanto mejor conozca el agente los conceptos básicos de Derecho penal, más eficaz y más garantista será su actuación al servicio de la comunidad.
