This is the second part of a 2-volume set which presents an in-depth investigation into the canon of constitutionally conforming interpretation. This second volume builds upon the insights of the first volume, which includes national reports on the use of constitutional interpretation. In Volume 2, the analysis is extended beyond the national context, discussing its application in the supranational and international contexts, including in EU law and the domestic use of international law. It presents several critical perspectives, challenging the legitimacy of constitutionally conforming interpretation, and looks at the invisible constitution, constitutional amendments, and the impact of legalism. The volume is rounded off by three comparative analyses, which formulate universally applicable insights. Together with Volume 1, this book fills an important gap in legal scholarship and sets the stage for cross-national discourse on this critical legal method.

Constitutionally Conforming Interpretation – Comparative Perspectives

This book is the first collection of essays on Bernard Williams' moral and political philosophy to shed light on the nature of law, and key legal concepts. By the time of his death in 2003, Williams was widely regarded as the most important moral philosopher of his generation. Surprisingly, his work is still largely under-discussed in legal theory. This book aims to fill this gap with brand new discussions from scholars both from law and philosophy. The first part of the book focuses on Williams' work on responsibility and regret and its implications for law. Drawing from Ancient Greek authors, Williams maintained that luck might play a key role in our practices of responsibility and that some dimensions of responsibility are tied to the notion of having a character. What we do - intentionally or not - might affect our understanding of ourselves and of our place in the world. How do those ideas help us in making sense of legal responsibility? How broader concerns about our practices of responsibility impact the law? Those are some of the questions addressed by the authors in this part. The second part looks at how Williams' understanding of philosophy can shape the way we do jurisprudence. Williams' work on the methodology of philosophy combines resources from analytical philosophy, continental authors, history, and literature. He understood philosophy as a humanistic discipline. The authors in the second part of the book draw from Williams' work, notably his innovative take on the genealogical method, to discuss how we could practice legal philosophy in this same spirit.

This book explores the major theories of common law adjudication and presents a new theory of adjudication. It shows that the existing major theories of common law adjudication each capture only part of what occurs in actual court proceedings. It presents a new theory of adjudication that incorporates both useful and modified elements of these theories. The new theory itself comprises two parts: first, an attitudinal aspect based on institutional values; and second, a number of practical and theoretical factors which give concrete expression to those values. Throughout the book, the author draws on his prior experience both as a law professor and as a judge in his country's highest appellate court in order to provide a unique perspective that illustrates this new theory.

This book offers a novel jurisprudential account of law by arguing for a conceptual understanding of participation as foundational to a general explanation of law and legitimate authority. In doing so, the book challenges dominant accounts, arguing that the existing failure to separate an explanation of law's authority from the concept of its legitimacy has left a general explanation of law incomplete. From this, the book argues, both general jurisprudence and broader society have suffered. This is especially so for societies that tend to fall outside the Euro-American concern of much mainstream analytical jurisprudence. The historical experience of such societies, however, reveals much of normative and analytical significance. Bringing together normative, historical archival, and case study analysis, the book develops a positive account of law that highlights the importance of participation as a multifaceted process in the continuous historical development of law and legal system in any society. This account, the book argues, is crucial to a more complete explanation of law's authoritative function and normative legitimacy. The book's account of participation, further, foregrounds a broader and more normatively robust understanding of the relationship between a general explanation of law and other philosophically fundamental ideals, namely: freedom, justice, democracy, and deliberation. The book's examinations, which integrate arguments from scholarship in African political philosophy with mainstream arguments in analytical jurisprudence, lead it to new and original answers to longstanding questions in legal philosophy about the nature of law's authority, it's legitimate justification and, the grounds also, for collectively disobeying it.

From a renowned legal scholar, a tour d'horizon of the Supreme Court's gradual erosion of constitutional rights and limitations on federal power. Ambitious and erudite, The Power Revolution is the magnum opus of one of our most incisive constitutional scholars. For decades, Philip Hamburger has been a shrewd analyst of mounting federal power-in particular, the growth in executive power enabled by a virtually unfettered administrative state. Here, he widens his lens, detailing the larger historical processes by which the Supreme Court has watered down individual rights while aggrandizing itself and the other federal branches. Hamburger locates the key sites of constitutional erosion. Of profound importance has been the Court's removal of limits on Congress's power to tax and spend, achieved by eliminating the requirement that such legislation benefit all citizens, as opposed to special interests. Meanwhile, adopting progressive arguments, the Court has nurtured runaway expansion of the "necessary and proper" clause, judging more and more actions permissible. Then too, the Court has repeatedly increased its authority to act through discretion, to the point of placing its own precedents above the Constitution. And there is that administrative state, empowered through the unconstitutional delegation of substantive powers and, today, serving as the unilateral arbiter of access to critical government grants and licensures. Hamburger shows how new interpretive methodologies have become dependable vehicles for these constitutional subversions. The Power Revolution calls for a revival of "natural law positivism," the eighteenth-century baseline in natural law from which deviation can be justified, Hamburger argues, only by consent of the people. That is a tall order, but it will take bold efforts to restore the Constitution the justices have denied us, one decision at a time.

This book defends the relational approach to law. It begins by exploring how law is constituted in the context of either rational or reasonable conduct. Having identified reasonableness as the unifying theme of natural law theories, it argues that the form and authority of law originate in the practical resolution of a moral antinomy that these theories leave unaddressed. The reasonableness of law lies in the structure and principles of relations in which rights are correlated with obligations and powers with liabilities. Rather than descending upon us from above in the form of directives, law emerges from our interactive efforts to cope with persistent moral disagreements. Ultimately, the relational approach views the legal rules governing our interactions as expressions of a common will. The book concludes that, unsurprisingly, modern constitutionalism represents a thoroughly pragmatic and most defensible conception of the authority of law.
