Law and politics, indeed, can have a relevant function in preventing the diffusion of bad and wrong gender stereotypes.&nbsp;"Stereotypes have been and remain a notion central to feminist/ gender inquiry. This edited volume brings forth original perspectives from a wide range of scholars from multiple and diverse angles. The editors, Condello and Wagner, distinguish between the frameworks of mythos, logos and nomos to show how stereotypes are entrenched in cultural narratives, normative systems and language. Authors in the volume explore how stereotypes influence policy, cultural norms and personal identity causing discrimination and exclusion. Die Arbeit analysiert unter Einbeziehung des Privatschulbeschlusses des BFH und der Vorgaben des AEAO, in welchen Fällen Privatschulträger trotz der Erhebung von Schulgebühren den Anforderungen des § 52 Abs. 1 S. 2 AO genügen. Für Ersatzschulen knüpft die Untersuchung dabei maßgeblich an das Sonderungsförderungsverbot an, dessen Voraussetzungen ausführlich erörtert werden. Hingegen steht im Fall von Ergänzungsschulen der Ausgleich zwischen dem Interesse an der allgemeiner Zugänglichkeit und dem Finanzierungsbedarf der Schulen im Mittelpunkt der Analyse. Ergänzend zieht die Arbeit das Charity Law in England und Wales heran, um Parallelen und Unterschiede im Umgang mit sozialer Exklusion durch Schulgebühren aufzuzeigen.

An influential legal scholar argues that the Supreme Court played a pivotal role in the rise of mass incarceration in America. With less than 5 percent of the world's population and almost a quarter of its prisoners, America indisputably has a mass incarceration problem. How did it happen? Tough-on-crime politics and the war on drugs are obvious and important culprits, but another factor has received little attention: the Supreme Court. Since the 1960s, the Court has repeatedly disregarded constitutional limits on the state's power to lock people away. Justice Abandoned highlights six decisions that made mass incarceration possible. These rulings have been crucial to the rise in pretrial detention and coercive plea bargaining. They have blessed disproportionate sentencing and overcrowded prisons. And they have sanctioned innumerable police stops and widespread racial discrimination. If the Court were committed to protecting constitutional rights, none of these cases would have been decided as they were. Rachel Barkow offers a roadmap for change, showing that the originalist methodology adopted by the majority of the current Court demands overturning the unconstitutional policies underlying mass incarceration. If the justices genuinely believe in upholding the Constitution, then they have little choice but to reverse the wrongly decided precedents that have failed so many Americans.

A groundbreaking challenge to a core principle of constitutional law, arguing that congressional action is not limited by the legislative branch's textually enumerated powers. Every law student learns that the federal government is constrained to act only according to its enumerated powers, meaning that Congress can do what the Constitution expressly authorizes it to and nothing more. Yet Richard Primus contends that this longstanding orthodoxy--allegedly required by the text of the Constitution, the Framers' vision, and the logic of federalism--is fundamentally flawed. Through careful analysis of legal text and history, and of the structure of American federalism, The Oldest Constitutional Question argues for broad congressional authority. In particular, Primus shows that the primary function of enumeration is to rule listed powers in, not to rule other powers out. In practice, enumeration does little to limit Congress. But most constitutional lawyers--including many Supreme Court justices--think this means something has gone wrong, such that the courts must aggressively strike down federal laws. Primus's meticulous examination explodes the prevailing view. The constitutional system does place limits on Congress, and crucially so, but the enumeration of powers is not, and never has been, a sensible means for creating and enforcing those limits.

Le 18 août 2020, des soldats quittent le camp de Kati pour se rendre au palais de Koulouba. Chef du Comité national pour le salut du peuple, le colonel Assimi Goïta contraint le Président Ibrahim Boubacar Keïta à démissionner et instaure une Charte de Transition à valeur constitutionnelle qui complète la Constitution. Mais la coexistence des deux textes aboutit à une
situation juridique à la fois absurde et intenable, si bien que, pour rester au pouvoir, la junte viole la loi fondamentale de 1992 à plusieurs reprises. Finalement, celle-ci est réduite à néant et la IIIe République prend fin. Le Mali renoue définitivement avec la dictature militaire après des décennies de démocratie. Cet essai vise à expliquer un tel échec qui repose sur des pratiques historiques inhérentes à l'Afrique de l'Ouest francophone et au Mali, sur l'action anticonstitutionnelle des putschistes et sur le rôle ambigu des membres de la Cour constitutionnelle. Enfin, l'ouvrage propose des idées pour garantir la viabilité d'une nouvelle Constitution manifestement nécessaire.

Der Klimawandel und die Wohnungsnot prägen die Stadtentwicklungspolitik auf internationaler, europäischer, nationaler und kommunaler Ebene wie kaum ein anderes Themenpaar. Sie schlagen sich unmittelbar in der Bauleitplanung, der Raumordnung sowie im Bauplanungs- und Bauordnungsrecht nieder und stellen das öffentliche Baurecht vor tiefgreifende neue Herausforderungen.
Die Neuauflage des Lehrbuchs trägt diesen Entwicklungen Rechnung. Sie berücksichtigt die seit 2022 erfolgten Änderungen des Baugesetzbuchs und des Raumordnungsgesetzes, insbesondere durch das Gesetz zur Digitalisierung im Bauleitplanverfahren, das Wärmeplanungsgesetz sowie das Gesetz zur Beschleunigung des Wohnungsbaus und zur Wohnraumsicherung. Vertieft behandelt werden zudem die Neue Leipzig-Charta und die Territoriale Agenda 2030 als zentrale Leitdokumente einer gemeinwohlorientierten Stadtentwicklungspolitik sowie aktuelle Fragen einer sozialen Bodenpolitik.

Angesichts des dynamischen Wandels des öffentlichen Baurechts vermittelt das Lehrbuch eine systematische und dogmatisch fundierte Durchdringung des Stoffes und erleichtert Studierenden den Zugang zu Struktur und Zusammenhängen des Fachs.

Die derzeit dominanten Themen Klimawandel und Wohnungsnot schlagen sich auch in den aktuellen Festlegungen des Baurechts nieder. Betroffen sind dabei insbesondere die Bauleitplanung sowie auf regionaler Ebene die Raumordnung.
Die Ende 2020 als politisch-strategisches Leitdokument für eine gemeinwohlorientierte Stadtentwicklungspolitik konzipierte Neue Leipzig-Charta und ihr raumordnerisches Seitenstück, die Territoriale Agenda 2030, werden als Rahmen der deutschen Stadtentwicklungspolitik in der Neuauflage ebenso behandelt, wie die Auseinandersetzung um eine soziale Bodenpolitik.
