A Guide to Six Major Jurisdictions

Part of the iconic Landmark Cases series, this book brings the most significant cases in charity law together for the first time. More than four hundred years have passed since the concept of charity was first given statutory legal form in England in the Statute of Charitable Uses of 1601. This book explores the substantial body of judge-made rules and principles developed since then, highlighting a carefully curated selection of the landmark cases which have shaped charity law. Each chapter analyses one or more judicial decisions, setting them in their historical context, explaining their contemporary importance, and considering their future relevance. The selected cases cover a broad range of topics. Some go to the heart of what it means to be a charity, elucidating charity's legal definition and public benefit requirement. Others demonstrate how charity law has been shaped by its interaction with other bodies of law, including trust law, company law and equality law, and by emerging tensions between trustees' overriding duty to further the charity's purposes and broader moral obligations or ethical considerations. It is a fundamental principle of justice that a person cannot be made subject to the jurisdiction of the English court without valid notification via the service of proceedings. The procedure and law surrounding the service of documents nevertheless remains a frequently misunderstood aspect of English civil procedure. Mistakes in service can lead to satellite disputes, adverse judgments, jurisdictional challenges, lost claims, and allegations of professional negligence. Service in Civil Proceedings: Law and Practice is the definitive practitioner's text on the rules and principles governing service in civil and commercial proceedings both in and out of jurisdiction. This book analyses the extent to which the common law can accommodate the new issues arising from the AI revolution, and where legislation may instead be necessary. In doing so, the book takes into account not only doctrinal principles but also conceptual and theoretical foundations of common law. Over the next few decades, the use of AI in commercial and other transactions is likely to be one of the most disruptive influences ever to affect private law. Its impact will be wide and deep, affecting not simply the traditional areas of contract and tort but also agency, trusts, fiduciary relations and a great deal besides. The common law is known to be extremely flexible, and to some extent rules can be organically stretched and manipulated to respond to disruption of this kind. However, there is equally no doubt that such organic development is not enough on its own, and will have to be supplemented by legislative alterations and at times serious changes of thinking. This book challenges the orthodox story that products-based claims in tort were a rarity in English law prior to Donoghue because of the privity bar. Life and death are the beginning and end of the legal person: the instigator and terminator of rights, interests and obligations. Tim Robers deals with all private law declarations that, by their very nature, still require supplementation in order for the intended contractual arrangement to be concluded. In doing so, he distinguishes between "blanket" obligations (Blankettschuldverhältnisse) and "blank" declarations in the strict sense (Blanketterklärungen i.e.S.). Blanket obligations are in conflict with the contractual law requirement of certainty. Tim Robers therefore provides a detailed analysis of its content and underlying guiding principles. In addition, the author examines the three central methods by which the parties can specify their obligation: by making the determination themselves (by means of a supplementary agreement), by delegating the power of determination to one party or to a third person, and by an automated linkage to a reference value. It becomes apparent that the constellations governed by §§ 315 et seq. BGB (German Civil Code) are, in dogmatic terms, cases of permitted self-dealing (§ 181 BGB), and that automatic adjustment clauses constitute an autonomous mechanism "in between" self-determination and delegation. Tim Robers explores in depth the consequences of these findings for the interpretation of §§ 315 et seq. BGB and for the legal treatment of automatic adjustment clauses. "Blank" declarations in the strict sense-i.e., texts with gaps that are handed over to another party for completion-are likewise classified as cases of representation. On the dogmatic foundation thus established, the author develops solutions to a wide range of specific issues, for example liability where completion occurs contrary to instructions. For concealed "blank" instruments, he shows that what matters is the distinction between an agent (representative) and a messenger, and he examines this delineation in detail. Finally, the study investigates the potential of the so-called "principles of the blank declaration" for addressing case constellations specific to digitalization.
