In Private Power and Democracy’s Decline, Mordecai Kurz explores the relationship between free-market capitalism and democracy. He shows that technology has made capitalism different from what was envisioned in the Age of Enlightenment. Technology creates centers of market power and monopoly concentration that result in a society in which some people are enriched immensely while many workers’ livelihoods are often destroyed. Contrary to conventional thinking, technological competition does not remove market power, which becomes a permanent fixture of free-market capitalism. Such private power creates political inequality and generates forces that cause democracy’s decline and possible destruction. Applying these ideas to the US, Kurz shows that today’s problems begin in the 1980s with the policy of unregulated free-market capitalism. Coupled with the information technology revolution, this created a techno-winner-takes-all economy—leading to a second Gilded Age of unsustainable inequality and extreme political polarization. In the last 50 years, the economy “boomed” for some while leaving the majority of America’s workers behind. Mert Kilic provides a comprehensive analysis of the de lege lata regulation of algorithmic trading. He examines the origins, objectives, and systematic structure of the applicable legal provisions and evaluates their legal and practical effectiveness. The central guiding question is whether the current regulatory framework is both practicable and legally sufficiently precise. Beginning with the historical development of algorithmic trading, the study discusses the legislative motives and the legal-political justification for its regulation. The author defines the legal nature of the relevant provisions and explores how the concept of algorithmic trading is legally framed. In doing so, he examines whether the de lege lata definition encompasses trading via brokers, over-the-counter (OTC) transactions, or manually initiated orders, and how algorithmic trading is to be distinguished from the more specific category of high-frequency trading.
 

 As part of the analysis of existing obligations for algorithmic trading firms, potential avenues for circumvention, enforcement deficiencies, and future developments are also identified. Furthermore, the supervisory and civil law consequences of regulatory violations are presented, with particular attention to liability issues arising from damages or system disruptions. Kilic also draws a comparative analysis with U.S. regulation in order to highlight differences and identify potential reform impulses for the de lege lata framework. The study concludes with a critical assessment of the current regulation, finding that the need for regulation in algorithmic trading exists only within narrow limits and that the de lege lata framework is in part indeterminate, excessively technical, and ultimately of limited practical suitability.

The primary objective of this book is to address a formal representation of household economy in welfare economics in spatial terms. Although it has been argued since the nineteenth century that in exploring a reasonable indicator to measure the real welfare level of households, several difficulties remain to be faced in economic theory. The most relevant method in this specific topic is social welfare function. While various types of indicators were historically developed and improved as a replacement of existing economic growth indicators such as GDP and GRP using social welfare function, there still is a problem with evaluating the individual's utility as an aggregate term. As an alternative method of measuring the real welfare level of households, location theory may be a possibility for solving some potentially problematic issues. To be precise, location theory requires the inclusion of notions of transportation costs, spatially constrained internal and external economies, and other distance-related variables. From the standpoint of equality, this specific approach enables an analysis to investigate spatial differentiation. In other words, spatial differentiation of households can be interpreted as spatial consumer exclusion. Hence, the real welfare level of households can be measured by means of the accessibility of goods and services, of which there are several types, such as essential and luxury ones. As a result, spatial distribution of goods and services depending on their types can be considered a component of social welfare function. The topics addressed in the book include social welfare function in spatial terms, location theory related to firms and households, attractiveness of regions, economic and social infrastructure elements, and sustainable growth and development of regions.
