Introduction to Criminal Justice ISE

This book brings to light a neglected program of cosmopolitan normativity in international law - innate cosmopolitanism. Whilst liberal cosmopolitanism is organized around the abstract individual, and constitutional cosmopolitanism is organized around the achievement of a formal arrangement, innate cosmopolitanism, is organized around a naturally-occurring collective whole: comprising all of humanity at any point in time, and understood as a historical phenomenon capable of exhibiting a will, interests or ends of its own. As such, innate cosmopolitanism is, he argues, is the leitmotif of international law. The book thus brings to light an ill-appreciated stream of cosmopolitan normativity in international law, and subject it to critique.

This book brings to light a neglected program of cosmopolitan normativity in international law – innate cosmopolitanism – that holds special significance in this time of competing efforts to define and direct an expanding global public order. Beginning from an intentionally broad use of the term cosmopolitan, derived from etymological roots in the cosmo-polis, Geoff Gordon draws out the main streams of thought associated with cosmopolitanism over time in discourses of international law and politics. The two best-recognized are liberal cosmopolitanism and constitutional cosmopolitanism. And, In addition to these, he introduces a third: innate cosmopolitanism. Whilst liberal cosmopolitanism is organized around the abstract individual, and constitutional cosmopolitanism is organized around the achievement of a formal arrangement, innate cosmopolitanism, is organized around a naturally-occurring collective whole: comprising all of humanity at any point in time, and understood as a historical phenomenon capable of exhibiting a will, interests or ends of its own. As such, innate cosmopolitanism is more central to the historical narrative of international law than either liberal or constitutional cosmopolitanism. It is, he argues, is the leitmotif of international law. Clarifying, consolidating – and critiquing – cosmopolitan thought, the book thus brings to light an ill-appreciated stream of cosmopolitan normativity in international law, and subject it to critique. It will be of huge interest to specialists and students of international law and politics, and especially those concerned with ideas and theories of global order or international society.

Many laws penalize conduct not because it is inherently wrongful but because the government has prohibited it. Criminalizing Disobedience examines this important yet underexplored aspect of modern criminal law. Such "disobedience offenses" include: administration of justice crimes (contempt, obstruction of justice, perjury); failure-to-assist crimes (hindering prosecution, receiving stolen property, money laundering, failure to register or to report); regulatory offenses (involving, for example, environmental, drug, or medical device laws); preventive offenses (attempt, possession of weapons or drugs); and national security offenses (treason, espionage, export control and sanctions violations). What unifies these otherwise disparate offenses is that their core wrong lies in noncompliance with legal directives, not in unjustifiably harming or endangering others. The principal reason to refrain from such conduct is simply that the government has said not to do it. By contrast, laws against, say, murder or rape prohibit conduct that is morally wrongful even in the absence of legal prohibition. This book addresses the important normative and conceptual questions these laws raise: How should disobedience be understood? Is it blameworthy to disobey the state? In what ways does the state criminalize and punish disobedience? What should be the limits to the state's power to demand obedience and punish disobedience? Criminalizing Disobedience explores these questions across a range of legal domains and develops a philosophically sophisticated framework for evaluating such laws. In the process, it sheds new light on longstanding questions of political obligation, criminalization, and punishment. It will be of interest to scholars of criminal law, the administrative state, law and philosophy, and political philosophy.

This book examines how constitutional courts can sustainably contribute to advancing democratic norms in hybrid regimes, i.e. regimes that are neither fully democratic nor fully authoritarian. Using a comparative approach analysing cases from across the globe, particularly from Hong Kong, Pakistan, and Uganda, Julius Yam makes the case that courts can assume a democracy-enhancing role to mitigate the problems arising from hybrid regimes. The book reveals the challenges faced by courts in performing such a role. It also proposes a adjudicative framework that systematically integrates principled judging with judicial strategy, and suggests non-adjudicative techniques that judges can adopt to reinforce democracy.
