Eine rechtsökonomische sowie rechtsgebietsvergleichende Untersuchung

In vielen gesellschaftlichen Debatten sind zwei unversöhnliche Lager entstanden, die im Feind-Freund-Schema denken und handeln, die aber zu Gemeinsamkeit und Kompromiss nicht mehr in der Lage sind. Das trägt verhängnisvoll zur Delegitimierung unserer demokratischen Institutionen bei.&nbsp;
 
 Gerade angesichts der Herausforderung der Dekarbonisierung und der weltpolitischen Lage mit aggressiven autokratischen Regimen auf dem Vormarsch können sich die demokratischen Wohlstandsnationen Europas und Nordamerikas eine solche Selbst-Schwächung nicht leisten. Eine Stärkung des sozialen Vertrauens und Zusammenhalts ist notwendig, um die Zukunft zu bestehen. Hierbei kommt der Wirtschaft eine Schlüsselrolle zu. Wir brauchen eine Ökonomie der Versöhnung.&nbsp;
 
 Die Geschichte insbesondere des New Deals und der sozialen Marktwirtschaft hat gezeigt: Es ist möglich, über große wirtschaftspolitische Programme nicht nur gesellschaftliche Spaltung zu überwinden, sondern auch Frieden zu sichern. Diese Programme sind heute nicht wiederholbar – unabdinglich wird aber sein, in sozialen Zusammenhalt gezielt zu investieren. Es geht nicht bloß um materielle Besserstellung, sondern um umfassende gesellschaftliche Teilhabe und soziale Anerkennung aller gesellschaftlichen Gruppen.&nbsp;

How Humans Tried, Failed, Succeeded, and Built Our World

This volume explores the state of representative democracy on the global stage. It does this against the backdrop of crises such as the USA Capitol attack on 6 January 2021, recent refusals to accept election results in various countries, and attempts to restrict the voting franchise, as well as longer-term trends such as the rise of populism and declining trust in political elites. The first substantive chapter examines representative democracy in theory, history and practice today. Taking the representative model as their point of departure, the subsequent chapters explore a range of themes in relation to this model. The contributions include timely reappraisals of democracy in countries, such as the UK and USA, with old, well-established democratic structures, as well as analyses of the state of democracy in regions such as Africa, Asia and South America, where democracy has had a more chequered history. Across all of its chapters, the book invites readers to rethink fundamental questions about representative democracy: Why is it valuable? How should it be organised? Do steps need to be taken to strengthen representative democracy, and if so, what are those steps? The volume's target audience - politicians, public servants and interested members of the public - are provided with arguments and evidence to form their own views at a time when the ideals and practices of representative democracy are being challenged around the world, and new ideas and initiatives to revitalise it are being debated and implemented.

Democracy in Crisis?

For centuries, the Latin notarial system has evolved in response to society's growing demand for legal certainty. Yet the increasing complexity of economic relations calls for a new stage in that evolution: a notarial system capable not only of ensuring legal certainty but also of realizing its full institutional potential to promote economic efficiency in private legal relationships through enhanced governance, conflict prevention, and the preservation of the contractual rationale built throughout the notarial process, so that disputes, when unavoidable, may be resolved consistently with the parties' legitimate choices, interests, and objectives.
 
 This book argues that such evolution requires neither abandoning nor replacing the historical foundations of the Latin notariat, but reinterpreting them in light of contemporary economic challenges. It introduces the Law-and-Economics Notary as the central institutional figure of the Law-and-Economics Notarial Paradigm, a new theoretical framework explaining how the civil-law notarial system can meet growing demands for economic efficiency while preserving the principles that have historically defined its identity.
 
 The book demonstrates that the Law-and-Economics Notary represents a new understanding of the notarial function. Public faith is conceived not only as an instrument of documentary authentication but also as a mechanism of private governance capable of structuring incentives, reducing transaction costs, mitigating information asymmetries and behavioral biases, strengthening trust among economic actors, and fostering more efficient, predictable, and socially beneficial legal relationships.
 
 Developed independently through the integration of law, economics, and notarial practice, the Law-and-Economics Notarial Paradigm later proved to converge with the evolutionary direction reflected in the studies and institutional agenda of the International Union of Notaries. This independent convergence confirms its capacity to explain and operationalize institutional transformations already emerging across the modern civil-law notariat.
 
 By integrating law, economics, and contractual governance, this book offers a new understanding of the notarial function and a coherent paradigm for the evolution of the Latin notarial system. Rather than replacing its traditional foundations, it demonstrates how they can be reinterpreted and further developed, thereby contributing to legal certainty, economic efficiency, preventive justice, and, ultimately, to economic development.

This book assembles critical contributions on the work of TRS Allan, the Professor Emeritus of Jurisprudence and Public Law at the University of Cambridge, whose leading work in legal and constitutional theory spans almost 45 years. Allan has charted a distinctive path for legal, political, and moral theory and practice and has become a highly significant figure in the UK and in common law/parliamentary systems around the world. His ideas challenge established opinions about constitutional law within these systems as well as established views about the rule of law from more abstract or philosophical perspectives. Allan claims that law and morality find an inherent connection through the rule of law. He argues that there is a connection that flourishes in common law jurisdictions because although Parliament has sovereign legislative powers, its laws gain their full legal meaning only through an interpretive lens. This lens seeks to reconcile sovereign will with legality's basic moral ideals, especially the idea that law must be general and capable of guiding behaviour and thus respectful of the equality and dignity of its subjects. Allan's scholarship is powerful yet controversial, and it has inspired 20 leading scholars from the UK, Canada, Australia and New Zealand to engage with the central themes of his work. This book challenges the near-universal acceptance of a US-style, Western constitutional paradigm as the best basis for comparative constitutional studies. It does so on three main grounds: anachronism, 'othering' and cultural specificity. Main pillars of 'convergent constitutional theory' are rooted in the revolutionary, late-eighteenth century - a lost world; constitutional arrangements that deviate from the paradigm are often branded as 'outliers' or even as not constitutional at all; and the foundations of the paradigm in liberal democracy give no space for other forms of constitutionalism. Whatever the attractions of convergent theory as a normative ideal of good government, for the purposes of understanding, analysing and explaining constitutional systems it is far from ideal. This book discusses and questions: convergent theory's weddedness to writing as the technology of constitution-making; its image of a constitution as fundamental law; its idea that a constitution expresses the 'sovereignty of the people'; its use of tripartite separation of powers as the basic principle of institutional design; its relative neglect of administrative law; its association of 'rights' with judicially enforceable bills of rights; and its obsession with a vaguely specified concept of 'democracy'. It makes suggestions for alternative, preferable methods of understanding, analysing and explaining constitutions, and governmental and constitutional systems.

Six national case studies - Australia, Ireland, Canada, Aotearoa New Zealand, UK and USA - reveal the heterogeneity of the Anglosphere as an imagined democratic space. Viewed in the round, pandemic responses ranged from the chaotic to the internationally lauded, although even the latter have featured acute deficiencies in democratic practice, which underscores the need to gather the lessons learned. Yet, in all states, the public and political temptation to simply move on, in an act of communal forgetting and collective return to "normalcy," presents a real risk of failing to prepare for more democratic future crisis responses. This collection takes the long view, approaching its subject from multiple perspectives that examine the heterogeneity of the Anglosphere as an imagined democratic space. Taking a cross-disciplinary approach and bringing together both leading and emerging experts on democracy, constitutionalism, and the rule of law, this book powerfully combines the insights of retrospective analysis with future-focused contemplation of where our democracies are heading.
