Insurance Companies as Symbolic Regulators

The Law of Financial Crime

Following the events of 9\11 individual countries and the international community became increasingly concerned about how best to prevent the funding of terrorist groups. Alternative remittance systems such as Hawala, where money is moved informally between a network of brokers in the Middle East, north Africa and south Asia have been identified as a potential source of terrorist financing leading to calls for greater regulation of such alternative remittance systems.This book analyses the risk such alternative remittance systems pose in terms of terrorist financing, offering a detailed overview of the historical origins and methods of operation of alternative remittance systems or informal value transfer systems. The factors that have come to ensure that these systems have remained operationally viable in modern times are identified along with the risks they present balanced against an overview of their actual misuse for illicit purposes to date. The book presents a detailed critique of the UK framework for the regulation of these systems drawing where possible on existing data to assess the use and effectiveness of these measures in practice. A range of options for mitigating risks associated with specific remittance corridors is considered ranging from initiatives that promote remittances through the banking sector, to efforts to mitigate risk and the impact on the delivery of UK overseas development aid. The book concludes with key recommendations as to the effectiveness of the current regulatory framework within the UK viewed from the perspective of international efforts to secure the regulation of these systems, and in stemming terrorist finance as part of national and international counter-terrorism policy.

Sexual harassment between doctors is a common problem hiding in plain sight. There have been prevalence studies across the world, across contexts and across disciplines and although definitions,methodologies and results vary, the prevalence of sexual harassment inmedicine continues to be unacceptedly high.Harassment is more common when the survivor is still in training, and it is more likely to be experienced by doctors who live with multiple marginalisations. This book combines expert analysis and commentary from multiple interdisciplinary perspectives. It privileges the voices of survivors, whose rich experience helps to inform our understanding of a complex problem. With contributing authors from Austria to Zambia, the book spans multiple languages, sociocultural contexts, and academic disciplines and offers unique globally contextualised perspectives. The Deepfake Dilemma

The U.S. Constitution is silent about a right to privacy, yet the Supreme Court determined in the 1965 reproductive rights case Griswold v. Connecticut, that such a right is inferred from the Bill of Rights. The reasoning in the landmark case hinged on an unexpected word – penumbra. The Court concluded, in other words, that the unmentioned right to privacy resides in the shadows of the amendments. But this was not the first time penumbral imagery was used in legal writings, and its broader cultural usage dates back much further. Jared Schroeder's The Penumbra Problem provides a much-needed – and quite colorful – social and cultural history of the term. The penumbra concept, it turns out, wasn't an accidental choice but instead a well-selected term with centuries of transnational history. Schroeder tells its story through two intertwining narratives: first, how the word penumbra transcended its oblique scientific origins to become a distinct cultural concept; and, second, the parallel story of its evolving use in legal thought. The book tracks back and forth in time, creating an unexpected lineage of people and works who became unwitting champions of the penumbra concept, including mathematician Johannes Kepler, feminist activist Estelle Griswold, British thinker Robert Hooke, and lexicographer Noah Webster. Pairing these stories with the writings of great legal thinkers such as Willam Douglas and Oliver Wendell Holmes, Schroeder is able to construct a kind of etymological love letter to this obscure concept. Not everyone has supported the privacy precedent, though, and it is no exaggeration to say that it is in danger today. Schroeder's clever, utterly unique history is, at its core, a call to redouble efforts to save the right to privacy. He argues that we must understand its ponderous, indeed uncertain, origins to fully appreciate the precarity in which it exists today, and only then can we adequately fight for it.

Governing AI is about getting AI right. Building upon AI scholarship in science and technology studies, technology law, business ethics, and computer science, it documents potential risks and actual harms associated with AI, lists proposed solutions to AI-related problems around the world, and assesses their impact. It is a call to think inside and outside the box. Governing AI

This book explores the relationship between copyright law, online anonymity, and creative user-generated content (CUGC). Presenting original empirical findings, the book evaluates the co-existence of copyright law and normative systems regulating a CUGC landscape made up of artists, photographers, and writers, and makes novel recommendations for copyright reform. It takes a multi-jurisdictional approach across Anglo-American and EU legal systems, using the UK, USA, and Germany as representative jurisdictions for legal analysis. Qualitative findings are drawn from creators and communities on Reddit and 4chan. Copyright subsists in much CUGC, but pervasive anonymity makes it difficult for the law to regulate it effectively. Simultaneously, anonymity offers creative benefits in a way that highlights flaws in traditional justifications of copyright. Comparisons between community norms and copyright law identify practical differences but also fundamental compatibilities in terms of ownership expectations. However, the simultaneous existence of legal and normative enforcement mechanisms complicates matters for creators and potential users, with negative implications for creativity and copyright law. While existing reform efforts have made suggestions to create a UGC exception, these overlook and undermine the role of CUGC creators as copyright holders. This can be addressed through the consideration of a framework of supplementary CUGC guidelines when developing such reforms. This valuable resource for researchers and students provides a distinct perspective in framing CUGC creators as copyright holders, examining online anonymity as a pivotal factor influencing regulation.

Copyright and Anonymity in the Creative User-Generated World

This book is the first investigation of the relationship between EU digital sovereignty and sustainability strategies. Fentanyl is a first-person, insider account of how the crisis consumed the Biden Administration amid a series of other national security emergencies. It follows Jake Braun, a senior White House official, and his colleagues while they scramble to respond to the epidemic. As Mexican cartels ruthlessly executed their most radical transformation in 50 years, Braun and his colleagues architected the first U.S. government wide strategy to combat fentanyl in history. The effort brought him to Mexico to meet with Mexican agents who kick down cartel doors for the U.S. government there. He also spent time with data analytics wizards buried in nondescript offices in Virginia suburbs that hunt down Chinese fentanyl precursor chemicals on the Dark Web. He even takes a detour to gather intelligence from Russian migrants in U.S. detention facilities that migrated through cartel-controlled areas of Mexico. In the process, Braun uncovered the remarkable transformation cartels in Mexico underwent over the last 50 years. They morphed from narco-empires the size of Fortune 50 companies specializing in marijuana and cocaine to ones specializing in human migration and, separately, fentanyl. After much painstaking effort, the Biden Administration successfully executed the most sweeping takedown of cartel leadership and fentanyl infrastructure since the crisis began. Due to the efforts of heroic agents, intelligence officers and national security experts, the leviathan U.S. government is now marshaled in ways never before imagined against the Chinese chemical companies and cartels propagating the fentanyl epidemic.
