Informal Decision Making in the European Community Under the Luxembourg Compromise

The Law That Never Was

This volume explores the various intellectual property dynamics that emerged during the Cold War, circa 1946-1980. This period brought about some of the most poignant moments in the development of twentieth-century international intellectual property rights, when competing economic systems recognised the value in innovation, human creativity, cinema, and international intellectual property norms and institutions. Examining these developments from a Cold War approach can say much more as it allows for the examination of processes and norms that cater to strong domestic intellectual property rules in Western capitalism while yielding to 'universal' or 'common' property norms in copyright in socialist states. This volume connects some of the different advances made in the international emergence of these competing developments regarding intellectual property rights and emphasises the role of intellectual property institutions, processes, and universalism that helped keep Cold War rivals on the same normative, foundational street for intellectual property rights. Global Value Chains and the Law

From the financial crisis to the refugee crisis, and from the rule of law backsliding to the COVID-19 pandemic, European values have come under strain over the last decades. This book contributes to an already vivid discussion about the status and salience of the rule of law and other European values. The collection’s chapters explore the intrinsic connection between the rule of law and values such as democracy and justice and highlight various threats to the rule of law both at the national and supranational level. Mirroring the multi-faceted debate about the rule of law and European values, the contributions have been divided into four parts. &nbsp;The first part explores the use of the rule of law as a distinct value at the European level and its general implications for the European structure. It investigates the ways in which the rule of law and its various elements operate in association with other values, while noting how certain approaches to the rule of law might contribute to its erosion. &nbsp;Against this background, the second part examines the state of the rule of law across the Union. Looking at the rule of law and its manifestations in different European countries, this part contextualises the various approaches of the rule of law on the ground, thus facilitating a deeper practical understanding of the rule of law. Moving beyond classical notions of the rule of law, chapters in Part 3 relate the ideal to values such as justice and solidarity. Exploring how the rule of law can facilitate broader EU goals and aspirations in different European spaces, from its on-the-ground operation in judicial matters to the pan-European, the contributions draw out the link between the rule of law and sustainability, solidarity, and mutuality. &nbsp;The final part associates democracy with the rule of law, suggesting that threats to democracy are often indistinguishable from threats to the rule of law. Drawing from examples during the COVID-19 pandemic and responses to it, the chapters stress the salience of seeing the erosion of the rule of law through the lens of democratic values. Not only do the various parts of the book offer a broad, inter-disciplinary analysis of the ways in which various values relate to each other, but they also stress how actions linked to the safeguarding of values at the central European level affect and are affected by the national level. As such, the volume constitutes an important addition to the expansive literature in the area of European studies and European values.&nbsp;

This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Performance as Intellectual Property is for anyone interested in the emergence of modern European cultural industries and the relationships between intellectual property systems, creativity, and art. This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Double Trouble details the legal framework that underpinned such prosecutions. As a companion volume to Double Lives: Stories of Bigamy in England and Wales, 1604-2024, it sets the offence in the context of the changing laws on marriage and divorce, and examines the consequences of bigamy for those involved, including the remedies that were available to the often-deceived second spouse. Drawing on a wide array of sources from the 17th century to the present day, including formal law reports, legal treatises, newspapers, censuses, parish registers, divorce petitions and Parliamentary debates, this book shows how bigamy should be taken seriously as an offence that all too often involved deception, abandonment and heartbreak.
