Dieses Buch setzt sich umfassend mit Geschlechterstereotypen und ihrer Bedeutung für den völkerrechtlichen Menschenrechtsschutz von Frauen auseinander. Es untersucht erstmals Art.¿5 lit.¿a der UN-Frauenrechtskonvention (CEDAW) vollständig nach den völkerrechtlichen Auslegungsregeln und arbeitet dabei die verschiedenen Pflichtenarten sowie die Regelungsziele heraus. Deutlich wird, dass Art.¿5 lit.¿a CEDAW im Rahmen des völkerrechtlichen Menschenrechtsschutzes eine Norm darstellt, die bestehende Gesellschaftsstrukturen und Geschlechterverhältnisse verändern will.
In diesem Zusammenhang geht das Buch auch auf die Vereinbarkeit des Islam mit der menschenrechtlichen Geschlechtergleichheit ein und erläutert die zugrunde liegenden Konzepte sowie die damit verbundenen Spannungsfelder. Should deep seabed mining (DSM) stop or proceed? The international community is now facing a difficult choice. No matter what decision is made, environmental consideration is the core of the issue. This book tackles the compelling question of how to secure the marine environmental protection in DSM from an international law perspective. It deals with two major research questions: What are the international environmental requirements of participants - the contractor, the sponsoring State and the International Seabed Authority (ISA)? What are the legal consequences for them when environmental damage occurs? In doing so, it analyses the international DSM legal regime and general international environmental principles, observes the functioning of the ISA, and draws on law and practice of various environmental treaty mechanisms. The examination reveals the potential practical difficulties as well as fundamental obstacles in the application of international environmental rules and principles in the specific context of DSM.

Since the Chinese Civil Code came into force in 2021, it is still at an early stage of comparing Australian contract law and contract law principles in the Chinese Civil Code. To date, there are few systematic studies on the comparison of contract law in Australia and in China. The existing literature on the comparison is much more based on the old Chinese contract law of 1999. In addition, the existing literature on Australian contract law generally lacks a comparative dimension, particularly with China. The standard Australian contract law books and articles contain little reference to what similar problems might be conceived of or dealt with in a civil law jurisdiction like China. In the case of the Chinese Civil Code, although there are useful works on its legislative provisions, theories and doctrines, the contents of those works may not be readily comprehensible by an Australian lawyer or scholar unless set in a comparable context. This book seeks to fill this gap in the existing literature.

This book will also provide a comparison and analysis of Chinese and Australian contract law to show international legal scholars and practitioners not only the judicial interpretation and application of contract law rules in China but also the scholastic understandings of and approaches to the comparison of it with a common law jurisdiction, such as Australia. Another aim of the book is to lay a foundation to commence a long-term project to comprehensively compare selected areas and topics in Australian contract law and Chinese contract law, such as damages.

Adopting a multidisciplinary approach to climate adjudication, this book addresses how adjudicators decide cases by considering the influence of psychology, philosophy, legal education, film, literature, political economy, political ecology, judicial appointments, history, and climate science on their decision-making and ultimately on the (inconsistent) outcomes in climate cases. Drawing upon the humanities, science of climate change and/or social sciences to identify extra-legal factors that may drive the decision-making processes and outcomes of climate cases, this book uses case studies from different jurisdictions across the globe, addressing climate cases decided or pending in Africa, Asia, Europe, Latin and North America, and Oceania.
