The main theme of the book confronts the complex reality, that while it is proper to think of two separate trades in arms--legal and illegal--in practice there is a considerable overlap between the two. Drawing on a wide range of primary sources, Phythian argues that the lessons of the most important and extensive cases of the last 20 years suggest that a significant element of the illicit trade in arms has in fact been sanctioned at some level of government in the pursuit of broader security or geopolitical ends.

Offering a concise, yet thorough, introduction to the illicit arms trade, the main theme of this significant volume confronts the complex reality that while it is proper to think of two separate trades in arms, legal and illegal, in practice there is a considerable overlap between the two. Although this overlap is sometimes distinguished by referring to 'black' (wholly illegal) and 'grey' (semi-legal) markets, this book situates all of these transactions along a continuum under the banner of the 'illicit arms trade'. Drawing on a wide range of primary sources, Mark Phythian argues that the lessons of the most important and extensive cases of the last fifteen to twenty years suggest that a significant element of the illicit trade in arms has in fact been sanctioned at some level of government, in the pursuit of broader security or geopolitical ends.

The History and Theory of International Law

A Sociology of International Investment Law applies methods associated with the sociologist Max Weber to illuminate aspects of international investment law - a regime made up of thousands of treaties that protect foreign investors from state action diminishing the value of their investments. By applying many of Weber's key themes associated with legal modernity - legitimacy, rationality, domination, bureaucracy, and charisma - the book conscripts tools of analysis that enable the testing of many of investment law's operating assumptions. A Sociology of International Investment Law Law is premised on the belief that theory informs practice and that enlisting aspects of Weber's work illuminates the contemporary practice of, and debates over, international investment law. Utilizing Weber's themes and methods, results in a deeper appreciation of the connections of international investment law has with classical social theory. The book also reveals how the field fails to measure up to many of the analytical challenges that Weber's sociological interventions provoke. This book offers an exploration of the commonalities, differences, and blind spots shared by this relatively new international legal field with one of the most influential theorists of modernity. This book is concerned with the practical, ethical and political realities of critical research around state punishment. By definition, critical research is a dynamic and political process which recognizes the broad structural contexts within which human action takes place. Critical researchers argue for a more dynamic and reflexive approach to research, and have duties to expose oppressive structures and practices, make audible voices that are habitually silenced, and empower and emancipate marginalized groups and individuals. In Private Power and Democracy’s Decline, Mordecai Kurz explores the relationship between free-market capitalism and democracy. He shows that technology has made capitalism different from what was envisioned in the Age of Enlightenment. Technology creates centers of market power and monopoly concentration that result in a society in which some people are enriched immensely while many workers’ livelihoods are often destroyed. Contrary to conventional thinking, technological competition does not remove market power, which becomes a permanent fixture of free-market capitalism. Such private power creates political inequality and generates forces that cause democracy’s decline and possible destruction. Applying these ideas to the US, Kurz shows that today’s problems begin in the 1980s with the policy of unregulated free-market capitalism. Coupled with the information technology revolution, this created a techno-winner-takes-all economy—leading to a second Gilded Age of unsustainable inequality and extreme political polarization. In the last 50 years, the economy “boomed” for some while leaving the majority of America’s workers behind. Kurz concludes that only regulated capitalism can support democracy so that the benefits of technology are more equally shared and no person’s livelihood is destroyed to enable others to be enriched. To save democracy, he proposes a “restoration-of-livelihood” policy, offering firms managerial flexibility to maintain rising productivity while ensuring that technology does not destroy the livelihood of others.
