Palgrave Advances in Criminology and Criminal Justice in Asia

This book investigates the experiences of women inmates in Alipore Women’s Correctional Home and Dum Dum Central Correctional Home in West Bengal, India. It explores their socio-economic background, the major factors that led to their incarceration, the nature of their crimes, the problems that women inmates and their children face inside the correctional homes, and their dealings with the judiciary.
Using a mixed methods framework, this volume helps us to understand how multiple hegemonies can affect the offence done by a particular woman. Through inmate interviews, this book provides a window into their struggles and decisions. The narratives contain rich information on their motives and ‘modus operandi’ and produce data on how the ‘self’ is constructed by reflecting upon the complex nature of values, identities, cultures and communities of the inmates. The analytical framework further challenges positivism in contemporary criminology. Advancing feminist criminological agendas, this book aims to help influence the creation and implementation of public policy to improve the conditions of female inmates in correctional homes in countries like India.

This volume explores ethical aspects relating to claims for mitigation arising from culpable state action (or inaction). It answers the important and controversial question: to what extent should the state mitigate sentencing for defendants who have been victims of state misconduct? The volume explores the normative justifications for mitigation and answers many intriguing questions. For example, in terms of the procedural challenges, should the offender have to prove a causal link between state wrongdoing or neglect and the offending? Can a court take judicial notice of state-induced social adversity and apply this consideration to all affected offenders? Other questions relate to the implications for courts and sentencing commissions which issue guidance to courts regarding mitigation at sentencing. To what extent is the offender less culpable as a result of state misconduct, and what are the limits of any resulting sentence reductions? Do sentence reductions for state misconduct undermine proportionality, or deprecate the seriousness of the impact on the victim of crime? Should this factor be included in any sentencing guidelines or possibly even as a statutory mitigating factor? Each contribution explores a distinct, cross-jurisdictional claim for mitigation on the basis of State negligence or misconduct towards the offender. The author reveals an intriguing transformation in education policy as the laboratory and experimentation enter and alter the domain of social governance globally. He examines the global framing of the UN Sustainable Development Goal for Education (SDG 4) and its national implementation in two South Asian countries, Bangladesh and India.The book demonstrates how global organisations such as the UNESCO Institute for Statistics, together with national governments, have designed the implementation of SDG 4 in the image of the laboratory. The author traces the preparatory history of these policy laboratories through a combined genealogy of the laboratory and experimentation. This historical excavation is conceptually captured in the notion of experimentality, where policy tasks, strategies and routines are enacted experimentally through data, indicators, statistics and innovation. Methodologically, the book pioneers a topological semiotic approach to policy sociology, focusing empirically on how time, space, materials, discourses and affect are assembled in the production, performance and signification of policy values.This book will appeal to researchers as well as graduate students of global development, education policy and South Asian studies.
