This volume examines judicial decisions that have shaped the law of asylum and refugee protection.

Each chapter analyses a single judicial decision and locates it in a wider legal, political and policy context, tracing its subsequent impact on refugee law and policy. Some of the decisions analysed in this collection were foundational in establishing the reach of refugee law, particularly in defining the scope of the refugee definition. Others engage with key areas of refugee rights in contexts which indicate a critical turning point in state refugee policy, such as interdiction of boats at sea, encampment and extraterritorial asylum processing mechanisms. The contributions demonstrate how refugee protection is shaped by the intersection of different fields of law, including refugee law, human rights law, and domestic constitutional provisions.

Reflecting this complexity, the collection explores decisions from the UK, Canada, USA, Kenya, Australia and Papua New Guinea, as well as regional courts including the European Court of Human Rights, Inter-American Court of Human Rights, the Court of Justice of the European Union, and decisions of the United Nations Human Rights treaty bodies. Authors include leading academics and practitioners in refugee and human rights law from a range of jurisdictions.

The Economist, Best Books of 2024 The Times, Best Ideas Books of 2024 A uniquely data-rich analysis of the British elite from the Victorian era to today: who gets in, how they get there, what they like and look like, where they go to school, and what politics they perpetuate. Are Britain's power brokers a conservative chumocracy, born to privilege and anointed at Eton and Oxford? Or is a new progressive elite emerging with different values and political instincts? In search of answers, Aaron Reeves and Sam Friedman scrutinized the profiles of over 125,000 members of the British elite from the late 1890s to today. At the heart of this meticulously researched study is the historical database of Who's Who, but Reeves and Friedman also mined genealogical records, examined probate data, and interviewed over 200 leading figures from a wide range of backgrounds to uncover who runs Britain. What they found is that there is less movement at the top than we think. Yes, there has been some progress on including women and Black and Asian Brits, but those born into the top 1 percent are just as likely to get into the elite today as they were 125 years ago. What has changed is how elites present themselves. Today's elite pedal hard to convince us they are perfectly ordinary. Why should we care? Because the elites we have affect the politics we get. While scholars have long proposed that the family you are born into, and the schools you attend, leave a mark on the exercise of power, the empirical evidence has been thin-until now.

This volume explores ethical aspects relating to claims for mitigation arising from culpable state action (or inaction). It answers the important and controversial question: to what extent should the state mitigate sentencing for defendants who have been victims of state misconduct? The volume explores the normative justifications for mitigation and answers many intriguing questions. For example, in terms of the procedural challenges, should the offender have to prove a causal link between state wrongdoing or neglect and the offending? Can a court take judicial notice of state-induced social adversity and apply this consideration to all affected offenders? Other questions relate to the implications for courts and sentencing commissions which issue guidance to courts regarding mitigation at sentencing. To what extent is the offender less culpable as a result of state misconduct, and what are the limits of any resulting sentence reductions? Do sentence reductions for state misconduct undermine proportionality, or deprecate the seriousness of the impact on the victim of crime? Should this factor be included in any sentencing guidelines or possibly even as a statutory mitigating factor? Each contribution explores a distinct, cross-jurisdictional claim for mitigation on the basis of State negligence or misconduct towards the offender. The chapters all address the appropriate response of courts at sentencing.

Sexual violence remains a pervasive reality of war. Redressing Rape in War presents an innovative medico-legal framework for redressing conflict-related sexual violence (CRSV), integrating insights from transitional justice, restorative justice, and medical scholarship. Drawing on empirical research across three diverse settings-including interviews with victims and professionals in transitional justice and healthcare-this book critically examines the evolution of existing reparative measures and advances an interdisciplinary approach to justice and redress. Through a health-centred perspective, this book explores the forensic, psychological, physical, and social consequences of CRSV, emphasising the cascading effects of embodied trauma and its impact on victims' long-term well-being. Recognising that traditional forms of reparations struggle to address the breadth of harm inflicted, this book forwards a vulnerability-based framework that enhances their effectiveness by acknowledging the relational dimensions of harm, and the role of informal and self-repair mechanisms. By reimagining rehabilitation through a medico-legal lens, it demonstrates how forensic medicine can strengthen accountability, improve reparative outcomes, and offer tangible paths to recovery centred on quality of life.
