Musical Traces of a Lost Past

Sexual violence in conflict, often referred to as conflict-related sexual violence (CRSV), refers to some form of sexual and/or reproductive violence perpetrated against women, men, girls and boys that is directly or indirectly related to the conflict. This includes rape, sexual slavery, forced prostitution, forced pregnancy, forced abortion, enforced sterilisation, forced marriage, and any other form of sexual violence of comparable gravity. The perpetrators of CRSV vary between each case and include state and non-state armed groups, including terrorist organisations. This book examines some of the recent manifestations of sexual violence as atrocity crimes, and especially, prohibited acts to bring about genocide, the responses to these crimes, and issues that continue to be neglected, including in relation to the duty to prevent. The work structures the discussion around the prevalence of CRSV, its use as a tool of genocide, and other international crimes, and the failures of legal and institutional responses. By combining thematic chapters on international law and accountability with case studies, the study provides a balance between theoretical critique and empirical analysis. It further engages with the debates on what is needed to bring about change, looking at specific policy and law reforms. The work also examines the way forward, including recommendations to introduce an international convention specifically focused on CRSV, and a permanent mechanism on CRSV. The book will be of interest to academics, researchers and policy-makers working in the areas of International Criminal Law, International Humanitarian Law, Human Rights Law, Constitutional Law, Legal History, Security Studies and Genocide Studies.

Are Britain's power brokers a conservative chumocracy, born to privilege and anointed at Eton and Oxford? Or is a new progressive elite emerging with different values and political instincts? In search of answers, Aaron Reeves and Sam Friedman scrutinized the profiles of over 125,000 members of the British elite from the late 1890s to today. At the heart of this meticulously researched study is the historical database of Who's Who, but Reeves and Friedman also mined genealogical records, examined probate data, and interviewed over 200 leading figures from a wide range of backgrounds to uncover who runs Britain. What they found is that there is less movement at the top than we think. Yes, there has been some progress on including women and Black and Asian Brits, but those born into the top 1 percent are just as likely to get into the elite today as they were 125 years ago. What has changed is how elites present themselves. Today's elite pedal hard to convince us they are perfectly ordinary. Why should we care? Because the elites we have affect the politics we get. While scholars have long proposed that the family you are born into, and the schools you attend, leave a mark on the exercise of power, the empirical evidence has been thin-until now.

In the face of the largest displacement crisis on record even the most optimistic view of the future suggests that in the years ahead, more and more people will migrate in order to survive. The world requires places where refugees and other migrants forced to leave their homes have the opportunity to work, study, create, start businesses, and rebuild new lives for themselves and their families. Free Global Cities can deal with this growing global crisis in a completely new way. They are autonomous, self-governed subnational entities that provide a safe environment and rule of law that will create wealth and prosperity for its residents as well as for the nations hosting them. Such a model would contribute significantly to handle the largest migration crisis in history, which the world will be experiencing in the coming decades.

Armed conflict today involves a plethora of non-State actors including armed groups, private military companies, and hackers operating in the cyber domain. Frequently, these non-State actors act in a way that violates international law, for example by harming civilians, and they commonly act with the benefit of some form of State support. This raises critical questions about State responsibility. Attribution of Non-State Actor Conduct During Armed Conflict explores when and how international law attributes non-State actor conduct to a State, thereby triggering that State's international responsibility. Focusing on the six rules of attribution outlined in the International Law Commission's Articles on State Responsibility, the book provides a rigorous analysis of their practical application in the context of armed conflict. Using detailed case studies from the conflicts in Syria, Ukraine, and the Democratic Republic of the Congo, it examines each of the rules of attribution in turn, demonstrates when they would apply, and evaluates their effectiveness in holding States accountable for non-State actor conduct performed on their behalf. Critically assessing the legal and practical limitations of existing frameworks, the book argues that the predominant interpretation of the rules of attribution leaves an accountability gap, which enables States to act via proxy in a manner they could not lawfully operate via their own State organs. Combining doctrinal clarity with real-world relevance, it investigates how the inadequacies in the regulation of States' support to non-State actors in conflict situations should be remedied.
