This book traces the legal creation of National Parks in England and Wales, considering how statute and case law shaped the different provisions within the National Park and Access to the Countryside Act 1949. National parks are often associated with hiking, holidaying, and nature but they are rarely perceived as legal spaces. Yet national parks in England and Wales only exist through the legal processes contained within the National Parks and Access to the Countryside Act 1949, a piece of legislation which is internationally unique in how it defines what a national park is. In celebrating the 75th Anniversary of the National Parks and Access to the Countryside Act 1949, the book examines the legally unique nature of national parks in England and Wales, exploring why these spaces were created in a legally distinct way. In doing so, the book takes the reader on a journey through the ever-evolving landscapes of planning law, administrative law, and property law in the 19th and 20th centuries, providing a new perspective on the enactment of national parks legislation. In presenting the National Parks and Access to the Countryside Act 1949 as part of a wider system of legal change, the book encourages the reader to think differently about national parks, emphasising the inherently legal nature of these spaces. This book is the perfect companion for any reader seeking to understand how national parks in England and Wales legally came to be.

Defining a Landscape

The Legal Creation of National Parks in England and Wales

This volume of the Netherlands Yearbook of International Law (NYIL) examines general principles of law, which, alongside treaties and customary international law, traditionally form one of the three formal sources of international law, as enshrined in Article 38 of the Statute of the International Court of Justice (ICJ). The contributions in this volume are situated in the wider discussion on general principles reignited by the recent ILC reports and the reports of the Special Rapporteur on the matter. It aims to be part of a renewed wave of engagement with both the substance and methodology surrounding this mercurial formal source of international law.
Diverse functions are attributed to general principles by scholarship and case law: they are a source of various rules which merely form an expression of them; guidelines for a framework for interpretation/application of other rules; lacuna-filling norms; a source of interpretation of treaties and custom; a means for developing new treaties and custom; a supplemental source to treaties and custom; and even a modifier of treaties and custom. ‘General principles’ are here examined through various areas of international law, revealing their deep connections with other sources, overarching concepts such as time and change, and their diverse manifestations across the field.
As a double-blind peer-reviewed publication, NYIL offers a forum for the publication of scholarly articles of a conceptual nature in a varying thematic area of public international law. In addition, as of 2012 each volume includes a section entitled ‘Dutch Practice in International Law', which replaces the section previously dedicated to Documentation. The NYIL has been published under the auspices of the T.M.C. Asser Instituut since 1970.

By focusing specifically on election law, Rebe reveals a consistent pattern of partisanship on the Court. The findings controvert popular perceptions of non-biased decision-making and notions of fundamental fairness. The aggregate analysis shows that justices vote along party-lines in a majority of election law cases, and consensus-building is rare when there is a contentious electoral issue at stake. Exploring topics such as gerrymandering, campaign finance, voter ID laws, and presidential immunity, Rebe demonstrates that Supreme Court decisions often conflict with principles of stare decisis, originalism, and judicial restraint. Rebe also conducts a content analysis of the most controversial election law cases of the past twenty-five years, including Crawford v. Marion County, Citizens United v. FEC, Shelby County v. This cutting-edge collection is a riposte to the deep assumption that law should be written exclusively for and by the reasonable person, as the person to whom law is addressed and by reference to whom laws are designed and calibrated. The book looks at how the social dimension of the human experience is central to human existence: connections with other people shape our lives in profound ways. While law confers formal status on certain relationships and intervenes to remedy serious injustices that occur, it does not generally concern itself with the individual as a person formed through those and other relationships. It is most often addressed to the individual, on the assumption that individuals are rational autonomous agents. It poses a deep challenge to that assumption. First, the collection opens space for conversation on the social dimension of the human experience in the context of law by critically considering existing conceptual tools that could support such a conversation, e.g., community, solidarity, associations,collective rights, and cosmopolitan law. Second, the collection takes an inventory of the extent to which law currently takes the social dimension of personhood into account in fields as diverse as criminal culpability, natural resources law, human rights, company lawand administrative justice.
