Das auf mehrere Bande angelegte Werk prasentiert nahezu das gesamte deutsche Verfassungsrecht des Zeitraumes zwischen 1806 und 1918. Hiermit wird der sich gleichsam schrittweise vollziehende Ubergang von einem traditionell standischen oder gar furstlich-absolutistischen zu einem zumeist monarchisch-konstitutionellen System aufgearbeitet, dessen jaher Untergang schlielich in die nationalstaatlich-republikanisch gepragte demokratisch-parlamentarische Staatsform Weimars mundet. Mit dem Gesamtwerk steht dem Fachpublikum eine leicht zugangliche, bislang nicht gekannte Fulle von Dokumenten zur Verfugung, die fur die verfassungsrechtliche Entwicklung Deutschlands und seiner einzelnen Staaten von zentraler Bedeutung waren. Dabei wird groer Wert auf die authentische, d. h. buchstaben- und zeichengetreue Ubernahme der Texte gelegt. Dem jeweiligen Dokumententeil sind in jedem Band "Historische Einfuhrungen" vorangestellt. In diesem Rahmen werden an den einschlagigen Dokumenten orientierte (verfassungs-) rechtliche, zeitlich wie territorial ubergreifende entwicklungsgeschichtliche Darstellungen vorgenommen. In dem hier vorliegenden 3. Band werden erstmals uber 450 Verfassungsdokumente prasentiert, welche fur die verfassungsstaatliche Entwicklung des Groherzogtums Berg und des Herzogtums Braunschweig pragend waren. Begleitet wird diese Textedition durch eine ausfuhrliche historische Einfuhrung.

An influential legal scholar argues that the Supreme Court played a pivotal role in the rise of mass incarceration in America. With less than 5 percent of the world's population and almost a quarter of its prisoners, America indisputably has a mass incarceration problem. How did it happen? Tough-on-crime politics and the war on drugs are obvious and important culprits, but another factor has received little attention: the Supreme Court. Since the 1960s, the Court has repeatedly disregarded constitutional limits on the state's power to lock people away. Justice Abandoned highlights six decisions that made mass incarceration possible. These rulings have been crucial to the rise in pretrial detention and coercive plea bargaining. They have blessed disproportionate sentencing and overcrowded prisons. And they have sanctioned innumerable police stops and widespread racial discrimination. If the Court were committed to protecting constitutional rights, none of these cases would have been decided as they were. Rachel Barkow offers a roadmap for change, showing that the originalist methodology adopted by the majority of the current Court demands overturning the unconstitutional policies underlying mass incarceration. If the justices genuinely believe in upholding the Constitution, then they have little choice but to reverse the wrongly decided precedents that have failed so many Americans.

Im politischen Diskurs gibt es ein Recht auf Phantasie, Irrtum und Brüskierung der Rezipienten. Werbung ist zu Wahrheit, Substantiierung und Achtung der Rezipienten-Rechte verpflichtet. Das Bundesverfassungsgericht hat in einer Entscheidung über die Benetton-Werbung angenommen, dass beide Sprachformen durch das Grundgesetz geschützt sind. Für die Beantwortung der Frage, ob und wie Werbung als Meinung geschützt werden soll, werden das Gemeinschaftsrecht, die Europäische Menschenrechtskonvention und das US-amerikanische Verfassungsrecht herangezogen.

Im politischen Diskurs - bei der ideellen Sprache - besteht ein Recht auf Phantasie, Irrtum und Brüskierung der Rezipienten ("Soldaten sind Mörder"). In der Werbung - bei der kommerziellen Sprache - besteht eine Pflicht zur Wahrheit, zur Substantiierung und zur Achtung der Rechte der Rezipienten (unter anderem §§ 1,3 des Gesetzes gegen den unlauteren Wettbewerb). Das Bundesverfassungsgericht scheint in seiner Benetton-Entscheidung anzunehmen, dass beide Sprachformen in Artikel 5 des Grundgesetzes geschützt sind. So stellt sich die Aufgabe der Untersuchung und gegebenenfalls Auflösung von (Wertungs-)Widersprüchen. Für die Beantwortung der Frage, ob und wie Werbung als "Meinung" in Art. 5 GG geschützt werden soll, werden das Gemeinschaftsrecht, die Europäische Menschenrechtskonvention und das amerikanische Verfassungsrecht - als "Trendsetter" eines extensiven verfassungsrechtlichen Schutzes der Werbung - herangezogen.

Its findings are based on empirical research involving 280 leading constitutional cases which demonstrate that the impact of a constitutional ruling often extends far beyond the cases actually adjudicated by the courts and that it is crucial to understand how judges justify their decisions in constitutional cases. In the cases researched, the authors identify and explain the common features of the Nordic constitutional reasoning, situating the Nordic experience within a broader comparative framework. The book compares these practices with those of non-Nordic jurisdictions, analysing whether and how the approaches of Nordic supreme courts align with each other and with global trends. This is made possible through the use of a well-established conceptual and methodological framework, adapted to the Nordic context. Whether in major world powers or smaller economies, constitutions around the globe are facing increasing challenges. In the United States—a country whose judiciary often dominates discussions on constitutionalism— President Donald Trump responded to unfavourable judicial rulings by calling for the impeachment of the judges involved, expressing his demands via tweets in March 2025. In January 2025, security detail was withdrawn from Kenya’s first female Chief Justice, highlighting the growing pressures faced by judiciaries worldwide. Issues such as the judicialization of politics and the protection of human rights have become enduring concerns across nearly every country. Emerging political and legal developments continually challenge courts and constitutions, often constraining the powers of judges, politicians, and other actors—while simultaneously creating new opportunities for these same actors to expand their influence. At the heart of these shifting dynamics lies a fundamental question: who holds whom accountable, to what extent, and under what conditions? This book explores various dimensions of constitutionalism in Africa and beyond, including, but not limited to, judicial independence, the judicialization of politics, and the politicization of the judiciary. What makes this volume a must-read is its interdisciplinary and comparative approach. Most chapters go beyond merely analysing legal provisions that empower or weaken different branches of government; they also examine the social, political, and economic factors that shape constitutionalism.
