Crompton Lucy: Gender, Care and
Financial Remedies on Divorce

Gender, Care and Financial Remedies on Divorce

An Untold Story of Invisible Work

In Lawful Repair, Danish Sheikh asks what happens when queer people, confronted by a law that criminalizes their intimate lives, work creatively within its own forms to enact the law they need in the here and now. Drawing on queer theorist Eve Kosofsky Sedgwick's account of reparative reading and on the work of legal humanists Patricia Williams, Robert Cover, and James Boyd White, Sheikh examines the work of dissenters against Section 377, India's colonial-era sodomy law. Through playful and generative experiments with contracts, affidavits, and rewritten judgments, these dissenters turn the law's constraints into resources for hopeful legal futures. Combining memoir, critical theory, and theater, Sheikh interweaves practices of dissent with his own lived experience of repair work, showing how queer people extract sustenance from a culture whose avowed desire has often been to harm them. Sheikh demonstrates that law remains too vital a resource to cede and that the creative forces of queer dissent can keep law's imaginative possibilities alive.

Reimagining Law Through Queer Dissent

Lawful Repair

How the great political thinkers have persistently warned against the dangers of economic inequality

Economic inequality is one of the most daunting challenges of our time, with public debate often turning to questions of whether it is an inevitable outcome of economic systems and what, if anything, can be done about it. But why, exactly, should inequality worry us? The Greatest of All Plagues demonstrates that this underlying question has been a central preoccupation of some of the most eminent political thinkers of the Western intellectual tradition.

David Lay Williams shares bold new perspectives on the writings and ideas of Plato, Jesus, Thomas Hobbes, Jean-Jacques Rousseau, Adam Smith, John Stuart Mill, and Karl Marx. He shows how they describe economic inequality as a source of political instability and a corrupter of character and soul, and how they view unchecked inequality as a threat to their most cherished values, such as justice, faith, civic harmony, peace, democracy, and freedom. Williams draws invaluable insights into the societal problems generated by what Plato called "the greatest of all plagues," and examines the solutions employed through the centuries.

An eye-opening work of intellectual history, The Greatest of All Plagues recovers a forgotten past for some of the most timeless books in the Western canon, revealing how economic inequality has been a paramount problem throughout the history of political thought.

FROM THE SUNDAY TIMESBESTSELLING AUTHOR OF MONEY: A USER'S GUIDEWe vow for richer for poorer. We sacrifice for our children, we give back to our parents. Because in true love and family matters, money's irrelevant and it would be terrible to suggest otherwise. Right? So why - in the privacy of the therapy room - does money emerge as one of the biggest causes of tension for modern couples? Why is it cited as the major factor in family estrangement between parents, children, and siblings? Why is there a trend for the 'Bank of Mum and Dad' to go to court to retrieve loans they regret handing over?In MONEY: A USER'S GUIDE, Laura showed us how to save into a pension and understand investment. This time, she delves into the really complex stuff - a non-judgemental examination of whether there is a "right" way to share our money with those we love, and what everyone else does behind closed doors. A book that none of us want to admit we need. How do you decide who picks up the bill, or what goes in the joint account? Is your partner being generous or controlling? Is this house mine if your parents paid most of the deposit? How much are you prepared to spend to have a baby? When should we give money to our kids, our mum and dad, our siblings, our community? Should they pay us back? What does everyone else do? Why don't we know? And why does it feel so agonisingly awkward to ask? This is a book of personal finance advice told through real stories about other people's modern money and relationship dilemmas.Laura speaks to financial advisers and wealth managers, marriage counsellors and matchmakers, philosophers, religious leaders, funeral directors and divorce lawyers, to get to the bottom of the questions that can be much more fundamental to our wealth and happiness than where to put our savings.

We vow for richer for poorer. We sacrifice for our children, we give back to our parents. Because in true love and family matters, money's irrelevant and it would be terrible to suggest otherwise. Right?

The Modern Money Questions That Could Save Your Relationships

"In one wide-ranging volume, Lambert and the country reporters demonstrate that law can not only keep up with technological change, but can in fact stay well ahead by anticipating upcoming questions. This comprehensive comparative reference will be invaluable for lawyers and students." (Professor Joshua Fairfield. Washington and Lee University School of Law, Review of a previous edition) Bringing together a global team of authors, the International Handbook of Social Media Laws covers the law relating to social media across 34 countries in total. From influential social media defamation cases in Australia, to tweeting from court, and regulations enforced by the UK's Online Safety Act 2023, this book clearly articulates the main legal issues and developments across various legal jurisdictions, to ensure a company's social media presence is fully compliant with the law of each country. The third edition has been fully updated to incorporate new criminal and civil case law, and covers topics including: - Online abuse, online bullying and cyberbullying laws - Laws or rules specific to children and social media - Bans or restrictions on the use of, or access to, the internet or social media, including the influential TikTok, Inc. v. Garland case in the US - Use of social media as evidence in courts - Hacking and data breach laws. Contributors to the volume each provide coverage of their own country, ensuring the volume is both authoritative and practical. Countries represented include: Argentina, Australia, Belgium, Brazil, Bulgaria, China, Czech Republic, Denmark, El Salvador, Estonia, Finland, France, Germany, Greece, Hungary, India, Ireland, Italy, Malta, Mexico, New Zealand, Norway, Senegal, Serbia, Singapore, Slovenia, South Africa, Spain, Sweden, Switzerland, Taiwan, United Kingdom, United States and Uruguay. International Handbook of Social Media Laws

Reciprocity begins with a simple but unsettling question: why have we come to believe that human beings are naturally self-interested, competitive and acquisitive? This galvanising, perspective-shifting book dismantles the myth of Homo economicus to show us the way towards a world whose realities align with our true selves.Drawing on a variety of disciplines, including anthropology, archaeology, evolutionary biology, psychology, economics and social epidemiology, Richard Wilkinson demonstrates that the characteristics which we assume to be our human nature are in fact effects of the market societies we live in. He traces how various systems of exchange have created profoundly different forms of social life throughout the course of history, shaping our behaviours, motivations, and the kinds of people we become. Though it may often feel like it, the avarice and oppressions that defines the twenty-first century are not an unchangeable reality we simply have to live with. The book explains why inequality, status competition and consumerism hold so much power over us and reveals the depths to which these forces are entwined with the ever-rising crises of mental illness, political polarisation and environmental destruction. Rather than asking how we can make individuals behave better, it makes a compelling case for restructuring our societies to make life happier, meaningful and more fulfilling for one and all.Rigorously researched, bracingly practical and full of passion and hope in equal measure, Reciprocity offers a bold reinterpretation of the world we live in. It equips us with the necessary tools to look beyond and remake it in our very own, amiably human image.

Reclaiming Our Humanity from the Market

For decades, LGBTI people simply did not exist in the language of international human rights law. No treaty named them, and no UN body addressed their demands. They had been written out of the universal promise of human rights. Based on archival research in Amsterdam and London, three years of participant observation at the UN, and in-depth interviews with activists, diplomats, and UN officials, Queer International Activism tracks the strategies, coalitions, and creative advocacy efforts through which LGBTI activists gradually inserted themselves into the world's most powerful human rights institutions. The book traces five distinct ways in which queer civil society organizations worked to reshape human rights subjecthood: reframing the meaning of universality; drafting their own international legal instruments; forging coalitions inside UN bodies; confronting the colonial assumptions embedded in global sexuality politics; and leveraging personal relationships and individual identity to open doors that formal institutional rules kept closed. But this is not a straightforward victory narrative. The power queer activists have won is real but precarious, built on relationships and opportunity rather than on deep institutional change, and the influence activists have gained depends on conditions that can disappear. As opposition to LGBTI rights escalates across the globe, this book underscores the urgency of understanding how queer activist changed the trajectory of human rights law, and how fragile these victories remain.

Crafting New Subjects of Human Rights

Queer International Activism

This book reimagines gender-based poverty in urban areas as a human rights issue, offering a transformative legal framework to address one of the most pressing and overlooked challenges of our time. More than half the world's population now lives in cities, with women comprising a growing share of the urban population/residents/people living in urban areas. Yet gender-based poverty remains a persistent and under-addressed issue in international human rights law. No existing convention explicitly tackles the intersection of gender, poverty, and urbanisation. This book breaks new ground by arguing that gender-based poverty in urban areas can - and should - be recognised as a human rights violation. Drawing on legal theory, feminist legal studies, and international human rights frameworks, the book critiques current legal approaches that treat poverty as a social or moral issue, rather than a structural and multidimensional injustice. It advances Sandra Fredman's four-dimensional model of substantive equality - disadvantage, recognition, participation, and transformation - as a more effective legal lens. Focusing on the right to adequate housing, the book explores how states' obligations to respect, protect, and fulfil can be clarified and strengthened through this model. It also examines how principles of equality and non-discrimination interact with progressive realisation and economic, social, and cultural rights. By bridging theory and practice, and incorporating perspectives from the Global South, the book offers a timely and original contribution to human rights law. It provides legal professionals, scholars, and development practitioners with a powerful framework for embedding gender equality in urban policy and advancing social justice through law.

The Right to Adequate Housing

Human Rights Obligations and Gender-Based Poverty in Urban Areas

This edited collection investigates the religious roots of marriage and divorce in Catholic, Protestant, and Orthodox nations across Europe and shows how their laws have evolved and diverged, from 1700 through to the present day. The eighteenth century was a pivotal period for the rules governing marriage and divorce, with the authority to establish and adjudicate on them shifting from church to state. The Formation and Dissolution of Marriage, Religious Roots, and Diverging Histories evaluates these historical developments, paying particular attention to the waxing or waning influence of religious institutions, values, and norms, and asking what other proposals for reform might have been on the agenda. As Volume 1 of A History of Family Law in Europe, this book examines how, and to what extent, marriage and divorce are regulated in the written texts of Europe's various religious traditions. The contributors analyse each system's teachings on marriage formation, marital impediments, and dissolubility, including ideas on the socially binding character of those precepts. Jurisdiction-specific chapters focusing on countries across Northern, Central, Southern, and Eastern Europe explore the regulation of marriage formation and dissolution in the context of religion and other cultural influences. The Formation and Dissolution of Marriage, Religious Roots, and Diverging Histories brings together the insights of an international team of leading marriage-law scholars from across Europe, and is a significant resource for scholars of family law, legal history, and the history of religion.

Feminist Frontlines traces the evolution of the "sex wars," a series of feminist intellectual entanglements about the relationship between law, gender, and equality, from the late 1970s to early 1990s, in contemporary debates about campus sexual violence policy in Canada and the United States – what critics have called the "return of the sex wars" or "new sex wars" at colleges and universities. Legal expert Daniel Del Gobbo employs a combination of legal doctrinal analysis, intellectual history, comparative analysis, and feminist and queer legal theory, while using the restorative justice process conducted at the Dalhousie University Faculty of Dentistry in 2014–15 as a central case study. The book focuses on the role of consensual dispute resolution (mediation and restorative justice) in addressing sexual harm. Del Gobbo argues that the polarization of the "return of the sex wars" has prevented some feminist lawmakers and policymakers from engaging with progressive, anticarceral, and complainant-centred policy models, including consensual dispute resolution, which challenge the primacy of formal courts and tribunals. Ultimately, Feminist Frontlines argues that it should be possible for feminist lawmakers and policymakers to come together by instituting the "plural process" model of campus sexual violence reform. The plural process model recognizes that both formal and consensual options, properly administered by feminist experts, can promote gender equality on campus, and this book seeks to bring about that change.

Feminist Frontlines explores how the feminist “sex wars” from the 1970s to 1990s are reflected in modern debates about sexual violence policy at colleges and universities. It argues for a “plural process” model that negotiates between these historical feminist imperatives to promote gender equality on campuses today.

Human Rights Law in Perspective

This book offers an analysis of how the European Court of Human Rights engages with identity and emotion, revealing both the promise and the limitations of human rights law in addressing the complexities of human experience. The book explores how human rights law, often framed as universal and abstract, responds to deeply personal questions of identity, belonging, and emotional impact. Based on a systematic study of over 3,300 judgments, the book shows how the European Court of Human Rights has increasingly made identity central to its reasoning - particularly in cases involving sexuality, ethnicity, and family life. In these areas, the Court acknowledges how state actions shape emotions such as fear, humiliation, and dignity. Yet, in other domains - migration, religion, professional life - the Court avoids emotional engagement, leading to troubling inconsistencies. The book argues that when emotions are excluded from legal reasoning, individuals are reduced to formal entities, stripped of depth and interiority. Combining doctrinal analysis with insights from social theory and psychology, the book presents a new framework for understanding how emotions and identity interact with law. It traces the evolution of identity references across categories and highlights the Court's uneven treatment of emotional harm. This timely and original contribution speaks to legal scholars, practitioners, and theorists interested in human rights, identity politics, and the emotional dimensions of law. It calls for a more responsive and empathetic human rights jurisprudence - one that reflects the lived realities of those it seeks to protect.

Ius Gentium: Comparative Perspectives on Law and Justice

The contemporary significance of the subject “Social Rights, Inequalities and Affirmative Action” is indisputable. In periods of social polarization, conflict and crisis, it is imperative that the obligation of our societies to protect and promote social rights is addressed and acknowledged. It is also necessary to recognize the way in which social rights are jeopardized by inequalities that impede the cultivation of robust social relationships and to document instances of the implementation of affirmative actions in this scenario. The aims of this work are as follows: firstly, to establish general topics (part I); secondly, to undertake more specific investigations within the primary topic (part II); and thirdly, to address the challenges posed by the technological transition currently taking place in society, which has significant consequences for social rights, (in)equality, and affirmative action (part III). The study is organized into three sections corresponding to these targets. For the purposes of this study, the analysis will commence, in the Part I of this book, at the genesis of the debates, as outlined in the chapter concerning the old and the new forms of racism. This contribution is followed by a chapter on the growing recognition of intersectional discrimination in European and global human rights frameworks and by another on structural discrimination and the function of the law against unjust enrichment. To further explore and expand upon the subjects addressed in the preceding chapters, the final chapter of Part I of this book delves into the topic of affirmative action in the United States. The second part of this work is dedicated primarily to specific forms of affirmative action, thereby deepening the discussion initiated in the first part of this book. The initial topic examines the way in which the pandemic has impacted specific social groups and led to the emergence of health disparities in the UK. The subsequent chapter is devoted to an examination of the alterations in the benefits of minimum income support in Brazil in recent years. The fourth chapter undertakes a detailed investigation of a specific affirmative action program for children and adolescents with the objective of reducing violence in urban areas. The final chapter conducts an analysis of ageing, public policies and inclusion in Brazil. The third and final section is dedicated to an examination of the challenges faced by our technological societies. The field of “Social Rights, Inequalities and Affirmative Action” is set to be impacted by the regulation of artificial intelligence, the increasing digitalization of activities, and the development of new tools designed to enhance the efficiency of the social state. The initial chapter of the concluding section deals with the regulation of artificial intelligence in Brazil and the impacts of neurotechnology. The second study examines conservative digitalization and structural inequalities in Latin American information societies, while the final study focuses on the emergence of the social digital state and the use of instruments that produce inequality and discrimination.
