This book examines the World Trade Organisation (WTO) Dispute Settlement Understanding (DSU) from the perspective of the world's Least Developed Countries (LDCs).Ensuring predictability and stability in the rules-based international trading system requires the DSU to be accessible, efficient, reliable, and able to redress imbalances. Since the 1990s, the DSU has been the subject of review, and this book charts and explores these ongoing negotiations from the perspective of LDCs. The inability of the LDCs to fully utilise the DSU reduces their ability to redress imbalances and, by extension, their ability to fully engage in international trade and promote economic growth. This book explores the issues behind LDCs' difficulty in engaging with the DSU, with only one dispute having been brought. Arguing that WTO action alone will not address all these issues, the book advocates that the LDCs must themselves be prepared to take measures to address current weaknesses and makes recommendations as to how they may overcome some of their DSU engagement issues.The book will be of interest to researchers in the field of international trade law, international law, and dispute resolution.

This book examines the persistence of blasphemy provisions, their increasing use in post-authoritarian Indonesia and the extent to which religion has been instrumentalised for political ends justified by law.Based on empirical research and an analysis of more than a hundred court decisions that connects evidence to theoretical discussions, this book traces the evolution and dynamics of capitalism in relation to the nature of legal order and the operation of laws, particularly those related to religion. Using an interdisciplinary approach, the author offers a rich analysis of the competing discourses on blasphemy in Indonesia. The work bridges the literatures of law and other social sciences. Providing an updated analysis of Indonesian blasphemy laws, this book also aims to shed light on the dynamics of legal order that affect how and why such laws exist. Rather than merely documenting regulations on and cases of blasphemy, the study aims to further understand the operation of law as a reflection of power relations. Specifically, the book reveals that the persistence of blasphemy laws has more to do with the illiberal nature of Indonesia's legal order, which renders laws that privilege religious orthodoxy a practical instrument for religious mobilisation for political purposes, than with the cultural distinctiveness of Indonesian society or the lack of modern bureaucratic and legal institutions supporting secularisation, as many scholars have argued.Offering original contribution to scholarship on blasphemy, the politicisation of religion and illiberalism in democracies, this book will be of interest to academics in the field of Asian politics, law and Southeast Asia studies.

This book explores the intricated evolution of flexibilities in copyright law, addressing some of the most pressing challenges the copyright balance has faced in the past decades. In the digital age, copyright law's role as a regulatory framework has grown, demanding even greater clarity and flexibility regarding access and use of protected works. EU harmonization efforts have added complexity by introducing detailed rules that impact the copyright balance. This book goes beyond the existing EU copyright framework to critically analyze its current state of the art and make policy recommendations for the future. The concept of "copyright flexibilities" is examined from various angles, including rights definition, subject matter and scope of protection, copyright contracts, enforcement, exceptions and limitations, exhaustion, and the fair balance between copyright and fundamental rights.
