Transforming the Trade Landscape

This "open access" book presents the Proceedings of the First International Conference “A Digital Europe for Citizens”, which was organised by the Jean Monnet Module DigEUCit, “A Digital Europe for Citizens. Constitutional and Policymaking Challenges” and the CIJ (Centre for Interdisciplinary Research on Justice, Faculty of Law, University of Porto). It focuses on three main topics – data governance, digital markets, and digital services – and brings together chapters written by legal experts who address the EU’s accomplishments and future perspectives on the ongoing Digital Revolution, as well as the impact of digitalisation on the EU. Comparisons with other legal systems are also included.&nbsp;
 
 Adopting a holistic perspective with a focus on citizens, the book contends that constitutionalism must also be viewed in its role of ensuring democracy, an open and inclusive society, and a fair economy. It pursues an original, cross-sectoral and cutting-edge approach. In addition to discussing fundamental values and principles, the contributing authors address concrete and practical questions that arise from the EU’s policy and legal framework. The aim is to bring constitutionalism to the digital stage and to advance solutions and a proper framework, building on solid foundations. This comprehensive work will be of interest to legal scholars, academics, researchers and practitioners in the areas of European and constitutional law, data protection, competition and consumer law, as well as a larger audience of policymakers and digital entrepreneurs.

A Digital Europe for Citizens

Noch nie in einer Friedensphase hat das Thema Geld so viel Verunsicherung hervorgerufen wie heute. Obwohl Deutschland im Wohlstand lebt, beschleicht viele Menschen das Gefühl, dass der Wert unseres Geldes permanent schwindet. Gleichzeitig wird ohne Not Bargeld infrage gestellt und immer häufiger thematisieren Medien das totale Ende des Bargelds.

Die Sorge um die Zukunft des Geldes kommt nicht von ungefähr: In vielen Ländern ist eine massive Bargeldeinschränkung längst Realität. Die vorläufige Spitze markiert Indien. Hier wurden über Nacht 86 Prozent des Bargeldbestands der Rupien faktisch aus dem Verkehr gezogen. Bis gestern noch offizielles Zahlungsmittel, heute schlagartig wertlos - und auch das Geld in der Eurozone ist vor so einem Schicksal nicht gefeit.

Was ist also die Zukunft des Geldes - als Tausch- und Zahlungsmittel sowie Möglichkeit der Wertaufbewahrung? Wie werden wir einmal bezahlen? Welche Formen stehen uns offen? Und welche werden uns aufgezwungen - durch den Staat oder gar die Umstände, etwa Krisen und Katastrophen, wenn der Geldautomat oder das Onlinekonto nicht mehr funktionieren?

&lt;p&gt;Der Digital Markets Act (DMA) dient der Ex-ante-Regulierung großer digitaler Plattformen, die eine Gatekeeper-Funktion haben. In her PhD thesis, Giulia Aurélie Sonderegger analyses killer acquisitions, which, in short, are acquisitions that aim to pre-empt potential future competition at an early stage. While this phenomenon was originally discovered in pharmaceutical markets, this thesis exclusively discusses killer acquisitions in the context of digital markets, thereby primarily focusing on the current European Merger Control Regulation (EUMR). The main research question is whether the EUMR is appropriate to tackle killer acquisitions occurring in digital markets, and if not, in what ways it needs to be amended to better address the challenges in the future. To tackle this question, the author assesses both the economic and legal effects of killer acquisitions on merger control in digital markets and, based on her findings, suggests amendments to the current European merger control regime. For a more comprehensive analysis, this thesis also includes an assessment of the recently enacted Digital Markets Act (DMA) to ascertain whether this regulation may serve as an additional tool to remedy such transactions.
