This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Performance as Intellectual Property is for anyone interested in the emergence of modern European cultural industries and the relationships between intellectual property systems, creativity, and art. This Palgrave Pivot offers a groundbreaking reassessment of the concept of slavery in the Bible. Taking an interdisciplinary perspective, it interweaves historical semantics with an analysis of language to argue that slavery as it is primarily understood today – as a legal institution which reduced individuals involuntarily to the status of property - was not legitimized by biblical doctrine.
 The book presents a concise, accessible argument, focused around the translation of the Bible into English and the use of the language of slavery. The term ‘slavery’, emerging in the sixteenth century, was at first used to identify a condition of dishonour, as well as a system of forced labour, and it was only in the seventeenth century that it came to be equated with the Roman institution of 
 servitus
 , and in the eighteenth with the ownership of people as property. As a result, and uniquely among studies of slavery in the Bible, this book does not seek to engage in debates about whether or not the Bible supported slavery, claiming the premise itself is mistaken. The idea that slavery was an ancient legal institution that reduced individuals involuntarily to the status of property is a product of modernity.

This book traces the legal creation of National Parks in England and Wales, considering how statute and case law shaped the different provisions within the National Park and Access to the Countryside Act 1949. National parks are often associated with hiking, holidaying, and nature but they are rarely perceived as legal spaces. Yet national parks in England and Wales only exist through the legal processes contained within the National Parks and Access to the Countryside Act 1949, a piece of legislation which is internationally unique in how it defines what a national park is. In celebrating the 75th Anniversary of the National Parks and Access to the Countryside Act 1949, the book examines the legally unique nature of national parks in England and Wales, exploring why these spaces were created in a legally distinct way. In doing so, the book takes the reader on a journey through the ever-evolving landscapes of planning law, administrative law, and property law in the 19th and 20th centuries, providing a new perspective on the enactment of national parks legislation. The Legal Creation of National Parks in England and Wales

This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Double Trouble details the legal framework that underpinned such prosecutions. As a companion volume to Double Lives: Stories of Bigamy in England and Wales, 1604-2024, it sets the offence in the context of the changing laws on marriage and divorce, and examines the consequences of bigamy for those involved, including the remedies that were available to the often-deceived second spouse. Drawing on a wide array of sources from the 17th century to the present day, including formal law reports, legal treatises, newspapers, censuses, parish registers, divorce petitions and Parliamentary debates, this book shows how bigamy should be taken seriously as an offence that all too often involved deception, abandonment and heartbreak.

Mit der Entdeckung der Veroneser Handschrift der Institutionen des Gaius 1816 wurde das wohl wichtigste selbständig überlieferte Zeugnis des römischen Rechts der klassischen Zeit zu einem Forschungsgegenstand ersten Ranges. Friedrich Carl von Savigny, der den Fund vorbereitet hatte, unterzog den Text einer tiefgehenden Analyse und hielt exegetische Vorlesungen, in denen er das Werk des römischen Juristen insgesamt und dessen einzelne Lehrsätze interpretierte. So eröffnete die Verbindung von Forschung und Lehre noch vor dem Erscheinen des Textes im Druck den Blick auf dessen Wahrnehmung durch den prominentesten Juristen seiner Zeit.
