Studien zum Internationalen Investitionsrecht | Studies in International Investment Law

In den letzten Jahren ist eine Trendwende in den internationalen Wirtschaftsbeziehungen zu beobachten: Statt weiterer Marktliberalisierung wächst die Skepsis gegenüber ausländischen Investitionen. Durch Investitionskontrollmechanismen wurden Marktzugangsbeschränkungen vor dem Hintergrund der Sicherheit und öffentlichen Ordnung geschaffen. Diese stehen jedoch in einem möglichen Spannungsverhältnis zum internationalen Investitionsschutzrecht. Die Arbeit untersucht, ob nachteilige Entscheidungen im Rahmen der Investitionskontrolle zu Investor-Staat Schiedsverfahren führen können und zeigt dabei die Grenzen staatlicher Sicherheitsinteressen im Wirtschaftsvölkerrecht auf.

Die Arbeit betrachtet und analysiert umfassend die Rechtsprechung des Europäischen Gerichtshofs zu den internen Rechtswirkungen völkerrechtlicher Normen, die im rechtswissenschaftlichen Schrifttum als dogmatisch bedenklich und politisch motiviert beschrieben wird. Insbesondere werden die vielschichtigen Gründe dafür herausgearbeitet, dass der Gerichtshof vielen völkerrechtlichen Regeln - des Welthandelsrechts, des Seerechts oder des Umweltrechts - gegenüber originärem Unionsrecht nur sehr restriktiv zur Durchsetzung verhilft. Diese Gründe werden in einen breiten unionsverfassungsrechtlichen Kontext gestellt. Abschließend unternimmt die Arbeit einen Versuch, die Dogmatik des Gerichtshofs fortzuentwickeln, um der breiten Kritik zu begegnen.

A new way to tackle the real politics of climate change through asset revaluation It’s no secret that the Paris Agreement and voluntary efforts to address climate change are failing. Governments have spent three decades crafting international rules to manage the climate crisis yet have made little progress on decarbonization. In Existential Politics, Jessica Green explains why this is unsurprising: governments have misdiagnosed the political problem of climate change, focusing relentlessly on measuring, reporting, and trading emissions. This technical approach of “managing tons” ignores the ways that climate change and climate policy will revalue assets, creating winners and losers. Policies such as net zero, carbon pricing, and offsets all cater to the losers—owners of fossil assets. Ultimately, Green contends, climate change is a political problem. Climate politics should be understood as existential—creating conflicts that arise when some actors face the prospect of the devaluation or elimination of their assets or competition from the creation of new ones. Fossil asset owners, such as oil and gas companies and electric utilities, stand to lose trillions in the energy transition. Thus, they are fighting to slow decarbonization and preserve the value of their assets. Green asset owners, who will be the basis of the decarbonized economy, are fewer in number and relatively weak politically. Green proposes using international tax, finance, and trade institutions to create new green asset owners and constrain fossil asset owners, reducing their clout. Domestic investments in green assets, facilitated by global trade rules, can build the political power of green asset owners.

How the euro survived a series of crises, and how to make it more resilient The euro has survived crises unimagined at its founding: the financial meltdown of 2007–2009, the sovereign debt crisis of 2010–2012, the pandemic, and the Russian invasion of Ukraine. The European Central Bank fought these crises with dramatic policy innovations, buying up vast amounts of debt and providing large loans to banks. But now everyone expects the ECB to intervene routinely, and the euro is more fragile as a result. Crisis Cycle recounts this history and offers recommendations for restoring a durable monetary union. Monetary and fiscal policy are intertwined, especially in a currency union like the eurozone. Member states can be tempted to borrow and spend too much, and then count on the ECB to rescue them by printing money to buy their bonds. To avoid these disincentives, the ECB was founded with a narrow mandate: use interest rates to pursue price stability, and don’t buy sovereign debt. Debt and deficit rules would keep countries from getting into trouble. The ECB’s emergency innovations brought back these disincentives. How can the EU avoid larger and larger bailouts? The authors argue that Europe needs a joint fiscal institution that can provide temporary help to sovereigns, a resolution mechanism so sovereign default is a motivating possibility, and bank reform that ensures sovereign default will not bring down the financial system. Years spent learning from a skilled master were a nearly universal experience for young workers in crafts and trade. In England, when apprenticeship reached its peak, as many as a third of all teenage males would serve and learn as apprentices. In The Market for Skill, Patrick Wallis shows how apprenticeship helped reshape the English economy. Some historians see apprenticeship as a key ingredient in the industrial revolution; others agree with Adam Smith in seeing it as wasteful and conservative.
