A Comparative Study

The Law of Economic Regulation provides a detailed analysis of the law specific to economic regulation and the practice of that law. This book is unique in dealing with the key elements of economic regulation - such as rule-setting, regulatory investigations and disputes, enforcement and appeals on a cross-sector basis, offering a resource to practitioners in each sector who currently have few efficient options to see how other sectors deal with a specific issue. Cambridge Studies in Constitutional Law

This book examines how constitutional courts can sustainably contribute to advancing democratic norms in hybrid regimes, i.e. regimes that are neither fully democratic nor fully authoritarian. Using a comparative approach analysing cases from across the globe, particularly from Hong Kong, Pakistan, and Uganda, Julius Yam makes the case that courts can assume a democracy-enhancing role to mitigate the problems arising from hybrid regimes. The book reveals the challenges faced by courts in performing such a role. It also proposes a adjudicative framework that systematically integrates principled judging with judicial strategy, and suggests non-adjudicative techniques that judges can adopt to reinforce democracy. While theoretical in substance, this book is informed by empirical studies and draws on a wide range of disciplines, including law, political science, sociology and psychology. The book will be a key resource to judges, academics, and practitioners who are interested in the study of democracy and courts. What happens when Western law is no longer the default referent for legal modernity? This is a deceptively simple question, but its implications are significant for such fields as comparative law, international law, and law and development. Whereas much of comparative law is predicated on the idea that modern law flows West to East and North to South, this volume proposes the paradigm of 'Inter-Asian Law' (IAL), pointing to an emerging field of comparative law that explores the legal interactions between and among Asian jurisdictions. This volume is an experimental and preliminary effort to think through other beginnings and endings for law's movement from one jurisdiction to another, laying the grounds for new interactions between legal systems. The Cambridge Handbook of AI and Technologies in Courts

From a leading historian, the story of how entrepreneurial Jewish immigrants transformed commercial banking and enabled the economic and social advancement of Jews in America. What are immigrants to do when business opportunities abound in their new home, but banks refuse essential financial support? How could they make the journey in the first place without helping hands? In this lively history, Rebecca Kobrin chronicles the turn-of-the-twentieth-century Jewish immigrants who stepped up by doing the lending themselves. Arriving from the Russian Empire and settling primarily in New York, they made livelihoods by assisting fellow Jews so they could purchase passage to the United States and, after arriving, obtain credit that other lenders would not dare provide. Credit to the Nation traces the novel practices of bankers who not only enabled the flourishing of American Jewry but also revolutionized the US financial industry. Drawing on previously unexamined archival materials in Russian, Yiddish, German, and English, Kobrin tells a story that is also crucial to the history of New York, as immigrant bankers' financing of real estate transformed wide swathes of the city. Lenders drove a boom in the prices of tenement buildings, but heavy speculation eventually precipitated the downfall of immigrant banking. Kobrin notes in particular the case of the Bank of United States--a private lender catering primarily to Jewish businessmen--which the Federal Reserve refused to bail out from bankruptcy in 1930. Immigrants' grasping for credit, and the rise and fall of immigrant banks, gave way to a contemporary banking industry that, ironically, refuses credit to today's immigrants. Kobrin reminds us that now, as before, the denial of credit pushes entrepreneurial Americans into unregulated money-lending and the trap of endless debt.

The law codes in the Middle East North Africa (MENA) region are a well-crafted blend of civil and Islamic law in which civil law principles do not violate Islamic provisions. Yet, common law principles derived either from English common law or Islamic customary usages remain unidentified and thus ignored. Here, this complex scenario is rectified through a comparative analysis of the primary data (e.g. cases, statutes and arbitral award decisions), adding common law and uncodified Islamic custom to MENA law codes. The purpose of this comparative analysis is to allow common legal principles found in civil, common and Islamic law to be distilled in order to create a new, harmonised international commercial arbitration law code (HICALC) or uniform Arab arbitration law (UAAL) for adoption in the MENA region, where these principles already greatly influence the legal systems and can be readily assimilated into a harmonised or uniform code. The work demonstrates that this new code would lead to improved arbitral award enforcement in the MENA.

A Model Harmonised International Arbitration Law Code for the Middle East and North Africa

African Women in Law is the first empirical study to offer a comprehensive and contextually rich portrait of African women in the legal profession. Drawing on 153 interviews across six countries, 249 survey responses from 21 countries, and secondary literature from 15 countries, this groundbreaking book explores the representation of women in the bar, bench, and legal academia. It traces historical developments, examines current realities, and sets the stage for future research. Introducing the HISP framework-History, Institutions, Social (norms), and Position(ality)-the book analyzes how structural forces shape women's roles in law. Through original concepts such as exclusion versus accommodation, racehorses versus workhorses, and the women's other-bar and other-bench, it challenges conventional narratives and highlights the diverse experiences of African women in law. The volume also builds on matri-legal feminist theory to offer a fresh lens for understanding gender and justice in African contexts. Rejecting essentialist approaches, the book argues that there is no single narrative of the lived experiences of African women in law. Instead, it reveals how women have emerged from the margins of a male-dominated field to assume leadership roles, often through innovative strategies that overcome systemic barriers. As the first comparative study of its kind, African Women in Law establishes a vital foundation for future scholarship and inspires new questions, methods, and theories for exploring law, gender, and governance across the continent.

Title 40 presents regulations governing care of the environment from the 14 subchapters of Chapter I and from the provisions regarding the Council on Environmental Quality found in Chapter V. Programs addressing air, water, pesticides, radiation protection, and noise abatement are included. Practices for waste and toxic materials disposal and clean-up are also prescribed. Additions and revisions to this section of the code are posted annually by July. Publication follows within six months.

The Rule of Law in Context

This book investigates core legal-political cultural myths of the Australian nation by canvassing, challenging and recasting some of the well-understood debates around, and invocations of, 'the rule of law' in Australia. It foregrounds one of the most enduring and prominent manifestations of these debates: claims to state sovereignty and rule of law in a system that has an incoherent legal foundation in its intentional ignorance of, and arbitrary violence perpetrated against, First Nations, their people, their sovereignty and their law. It examines the claims and celebrations of colonial rule of law achievements; constitutional rule of law protections; and the rule of law as tool to delineate and circumscribe the role of judges in the State. It presents a survey of the constitutional and legal principles and institutions and explores the socio-political aspects of rule of law in the country and how rule of law is experienced.
