Rechtskommunikation im offenen Verfassungsstaat

Successful communication is one of the prerequisites for a functioning constitutional state. Law lives through communication. The meaning of a constitutional provision, and its legal and factual effects, are revealed in a negotiation process involving a wide range of actors. All contributions in the open society of constitutional interpreters must be communicated: only through communicative exchange does the meaning of a legal text and what is implied between the lines unfold. This volume brings together practical, academic, and interdisciplinary perspectives on successful constitutional law communication and experiences from its failure. The contributions discuss the divergent languages of constitution and society, the design of judgments, formal and informal communication between branches of government, and the constitutional law discourse across jurisdictional and linguistic boundaries.
