"La gravedad de las penas debe ser relativa al estado de la nación misma. Más fuertes y sensibles deben ser las impresiones sobre los ánimos endurecidos de un pueblo recién salido del estado de barbarie. Al feroz león, que se revuelve al golpe de un arma limitada, lo abate el rayo. Pero a medida que los ánimos se suavizan en el estado de sociedad, crece la sensibilidad, y creciendo ésta, debe disminuirse la fuerza de la pena, siempre que quiera mantenerse una relación constante entre el objeto y la sensación." Este tratado está considerado como uno de los libros más influyentes en la reforma del antiguo derecho penal continental.
