This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. Performance as Intellectual Property is for anyone interested in the emergence of modern European cultural industries and the relationships between intellectual property systems, creativity, and art. This book offers a comprehensive reconstruction of proportionality in constitutional law, tracing its trajectory from its origins in Prussian administrative law and German constitutional adjudication to its contemporary application across diverse legal systems. Against the conventional approaches that equate proportionality with the weighing of competing values, it argues that this test was originally conceived as a dogmatic instrument for the protection of rights, not as a balancing technique. Through a detailed comparative analysis of the German and Brazilian experiences, the book reconstructs how proportionality gradually shifted from a strict limit on state power to an open formula of judicial discretion, and proposes a coherent model to restore its normative function. The book critically re-examines the philosophical and theoretical assumptions that transformed proportionality into an indeterminate balancing exercise and reconstructs it as a structured dogmatic test defined by constitutional parameters of protection. Engaging with authors such as Robert Alexy, Bernhard Schlink and Ralf Poscher, it maps how proportionality became the dominant method of constitutional adjudication and how that dominance produced both methodological uncertainty and jurisprudential uniformity. Finally, it proposes a theoretical framework that distinguishes proportionality in the singular, as a general abstraction, from proportionalities in the plural, calibrated to the specificities of each right, context and mode of judicial review. This plural and context-sensitive approach restores the analytical precision that contemporary constitutional law often lacks. By combining historical analysis, comparative dogmatics and legal theory, the study contributes to current debates on the legitimacy and limits of judicial review, the boundaries of fundamental rights and the crisis of constitutional interpretation in modern democracies.

What goals are still feasible for the politics of emancipation on a ruined planet? This is where we are. How apprenticeship shaped the English economy Apprenticeship dominated training and skill formation in early modern Europe. Years spent learning from a skilled master were a nearly universal experience for young workers in crafts and trade. In England, when apprenticeship reached its peak, as many as a third of all teenage males would serve and learn as apprentices. In The Market for Skill, Patrick Wallis shows how apprenticeship helped reshape the English economy. Some historians see apprenticeship as a key ingredient in the industrial revolution; others agree with Adam Smith in seeing it as wasteful and conservative. Wallis shows that neither of these perspectives is entirely accurate. He offers a new account of apprenticeship and the market for skill in England, analyzing the records of hundreds of thousands of individual apprentices to tell the story of how apprenticeship worked and how it contributed to the transformation of England. Wallis details the activities of apprentices and masters, the strategies of ambitious parents, the interventions of guilds and the decisions of town officials. He shows how the system of early modern apprenticeship contributed to the growth of cities, the movement of workers from farms to manufacturing and the spread of new technologies and productive knowledge. In this groundbreaking study, Wallis argues that apprenticeship succeeded precisely because it was a flexible institution which allowed apprentices to change their minds and exit contracts early. Apprenticeship provided a vital channel for training that families could trust and that was accessible to most young people, whatever their background.

This is a study of elite English men of English law and the methods they used to retain and justify their power and privilege, through controlling the story of the legal person. It looks at how these men of legal authority thought of themselves and their institution; how they studied and explained law; and how they put themselves in the middle of it, as the standard human in need of legal regulation and protection and in charge of that regulation and protection, and assigned to women an inferior legal role and being. The main strategy used to do all this was manipulation of the concept of 'the legal person'. From the 1860s to the 1920s the courts declared that women were not 'persons' who could exercise public power - to vote, to sit in Parliament, to gain degrees, to be lawyers. Up to the end of the 20th century, and into the 21st, women's personhood remained precarious in the private sphere, for rape was excused within a marriage and female reproduction remained under state control (as it still does). The book examines the active exclusion of women from the means of making legal meaning, especially the ability to shape law's central concept and shows the epistemological effects of this sex differential of legal power which are still felt today. Leading legal thinkers who helped to masculinise the concept of the person, to the detriment of women, are still revered. Law's continuing male orientation is neither seen nor acknowledged and the legal person is treated (falsely) as if he had always been and remains anyone.
