Nordic Cooperation and the European Union

This is a study of elite English men of English law and the methods they used to retain and justify their power and privilege, through controlling the story of the legal person. It looks at how these men of legal authority thought of themselves and their institution; how they studied and explained law; and how they put themselves in the middle of it, as the standard human in need of legal regulation and protection and in charge of that regulation and protection, and assigned to women an inferior legal role and being. The main strategy used to do all this was manipulation of the concept of 'the legal person'. From the 1860s to the 1920s the courts declared that women were not 'persons' who could exercise public power - to vote, to sit in Parliament, to gain degrees, to be lawyers. Up to the end of the 20th century, and into the 21st, women's personhood remained precarious in the private sphere, for rape was excused within a marriage and female reproduction remained under state control (as it still does). The book examines the active exclusion of women from the means of making legal meaning, especially the ability to shape law's central concept and shows the epistemological effects of this sex differential of legal power which are still felt today. Leading legal thinkers who helped to masculinise the concept of the person, to the detriment of women, are still revered. Law's continuing male orientation is neither seen nor acknowledged and the legal person is treated (falsely) as if he had always been and remains anyone.

Diese Studie untersucht die Idee des "Schuldnerschutzes" im Hinblick auf ihre römischen Wurzeln und ihre Weiterentwicklung in modernen Rechtsystemen. Sie konzentriert sich auf den Begriff "favor debitoris" in den antiken Quellen selbst - bzw. auf seine Abwesenheit in denselben - und vergleicht ihn mit anderen "favores", die in den juristischen Texten nachweisbar sind. Igor Adamczyk kommt zu dem Ergebnis, dass die Römer sich von einem Prinzip des Schuldnerschutzes nicht leiten ließen. Das bedeutet aber nicht, dass sie dem Schuldner den Schutz immer absprachen, es waren vielmehr situative Rechtsmaßnahmen. 
Der Autor untersucht Beispiele solcher schutzwirkenden Rechtsinstitute in den europäischen Rechtsystemen. Dabei nimmt er vor allem die Entstehung des vereinheitlichten polnischen Schuldrechts in den Blick, das unter den Einflüssen v.a. des französischen, österreichischen und deutschen Rechts entstanden ist, die ihrerseits jeweils auf das römische Recht zurückgeführt werden können.

This book presents an insight into the relationship between liberal democratic legality and responding to extreme situations. The uneasy relationship between liberal democracy’s rule of law and extraordinary measures by government have long provided a premise for contentious legal and political discourse. It is amidst this densely treaded theme, whereby this book turns to Europe’s democratic past in an attempt to mitigate any seemingly irrevocable conflicts. Largely overlooked, and yet ultimately the primary source of the contemporary liberal democratic legal order, democracy appears as a legal reality that advocates for its own principles in response to extreme threats.
 
 From the floors of the National Convention in Paris during the French revolutionary years of the late 18th century, Roman legal principles would be espoused by Robespierre and his contemporaries when heralding in the ‘new’ legal reality of democracy. Voices from Paris and the National Assembly of today on the other hand embrace principles of canon law when advocating for extraordinary ‘necessary measures’ that ultimately rely upon a determination of the ‘public common good’ when responding to extreme situations. In recognizing the contrast between ‘democratic-revolutionary tradition’s’ reliance upon Roman legal principles, as opposed to ‘constitutional monarchy tradition’s’ reliance upon canon law principles, this book presents to the reader a unique opportunity to understand how contemporary European legal tradition ultimately arises as a result of two legal worlds.&nbsp;

Beyond Democracy's Rule of Law

Extraordinary Governance in European Legal Tradition

This book considers Section 21 of the Divorce and Matrimonial Causes Act 1857 and its significant impact on previously invisible married women in the 19th century.

Tens of thousands of women used this little-known section of the Act to apply for orders from local magistrates' courts to reclaim their rights of testation, inheritance, property ownership, and (dependent on local franchise qualifications) ability to vote. By examining the orders that were made and considering the women who applied for them, the book challenges the mistaken belief that Victorian England and Wales were nations of married, cohabiting couples. 

The detailed statistical analysis and rich case studies presented here provide a totally new perspective on the legal status and experiences of married women in England and Wales. Although many thousands of orders were granted between 1858 and 1900, their details remain unknown and unexamined, primarily because census records did not consistently record dissolved marriages and there is no central index of applications made.

Using sources including court records, parliamentary papers, newspaper reports, census returns, probate records and trade directories, this book reconstructs the successful - and unsuccessful - experiences of women applying to magistrates' courts and the Court for Divorce and Matrimonial Causes to protect their assets across regions and decades.

The Legal Image of China in Chinese Legal Tradition

This open access book offersa cultural history of lawsuits that traces the development of French performance rights from la Belle Époque, throughthe Roaring Twenties, and into thePost-War period. It does so by analysing the ways in which performers, composers, and playwrights took to French courtrooms, sought attention in mass media, and participated in political debates to claim their rights to create and control musical and theatrical performance. In 19th-century France, composers and playwrights organised in member-run societies that successfully used authors' rights legislation to curb the power of theatre managers. By the turn of the 20th century, these so-called collective management organisations had transformed French cultural industries by building out structures of royalty collection and improving litigation practices. From the café-concert culture in 19th-century Montmartre and the rise of modern celebrity culture, to mass media and radio entertainment, the book traces precedent-setting litigation that defined who creates and controls performance. The book challenges previous narratives that centre the individualisation of authors in the expansion of the international copyright regime while neglecting performers. Instead, it reveals the ways in which the personality and individuality of performers have played a constitutive role in discourses about genius, technology, and legal categories. It follows women across the course of their lives, from birth to widowhood, to show how their legal position and control over property shifted over time, depending on their social status and place within the family.
