The Protection of Indigenous Knowledge in Africa

This open access book addresses the application of EU fundamental rights law by national courts. It offers a unique insight into the case law of courts in three EU Member States (Belgium, Germany and the Netherlands) as regards mutual trust and fundamental rights. Through a thorough analysis of over 1000 national court judgements from the last ten years, the book enables readers to view EU law from the perspective of national judges.
The book focuses on decisions regarding transfers under the Dublin Regulation and the European Arrest Warrant. These particular cases require national judges to balance the EU legal principle of mutual trust with individual fundamental rights. This is a demanding task due to the differences in approach between the Court of Justice and the European Court of Human Rights, as well as the inherent tension between the principle of mutual trust and fundamental rights. The book investigates how national judges navigate the differences in applicable laws (EU law, ECHR law, national law) in Dublin and EAW cases. Moreover, it dissects how and when national judges decide to allow or refuse a transfer, along with their legal reasoning. Finally, the manner in which national courts have utilised the preliminary reference procedure in these cases is considered.
This book will appeal to anyone interested in understanding how EU law works in practice and in the role of national courts, as it explains how national judges may approach similar questions of EU law differently. For students and researchers, the book serves as an important example of EU legal research, employing a systematic analysis of national case law. Finally, it aids practitioners in understanding how national judges approach Dublin and EAW cases and the reasoning behind their decisions to refuse or allow a transfer.&nbsp;

This book examines the practice of geo-blocking, which can be defined as the restriction of access to a digital product on the Internet based on the user’s geographical location. With the increased use of the Internet, particularly the growing consumption of digital products, the issue of geo-blocking has become more prominent and integrated into daily life. This study analyses geo-blocking practices under the European Union copyright law, focusing specifically on the Geo-blocking Regulation. Although the Geo-blocking Regulation aimed to resolve the issue of cross-border access to online products, it did not cover copyright-protected products. Consequently, copyright-protected digital products within the European Union may still be subject to geo-blocking, despite the goal of creating a Digital Single Market in the European Union. The geo-blocking debate is examined from various perspectives, exploring the most balanced approach that would support the proper functioning of the European Union internal market while respecting the interests of copyright holders, other rightsholders and users. This book assesses the need to include copyright-protected products within the scope of the Geo-blocking Regulation. To do so, it delves into the copyright law aspects of geo-blocking, particularly territorial licensing, the existing European Union legal framework regarding cross-border access to digital products, the competition law implications of this issue, and the circumvention of geo-blocking measures. In its final analysis, the book concludes that including copyright-protected digital products within the scope of the Geo-blocking Regulation would benefit users, copyright holders, and the internal market’s proper functioning, albeit with certain limitations.

This book provides the first comprehensive comparative and empirical analysis of the state of harmonisation in EU copyright law in the 27 Member States, and the UK, at the level of national courts. For 3 decades, the EU has harmonised many aspects of copyright law via EU legislation and the case law of the Court of Justice of the EU (CJEU). However, it is not known whether national courts actually comply with it, as a comprehensive analysis of the national case law has not yet been done. This book addresses this major gap in the literature. In the book, a lawyer and a statistician analyse some of the most recent decisions on EU copyright law issued by the 27 Member States and the UK (pre- and post-Brexit), using doctrinal and quantitative methodologies. The main research question addressed is whether there is disharmony in the national case law and whether this is owed to Members States' misimplementing EU copyright legislation, lack of clarity of EU legislation and/or case law, or national courts being unaware, misinterpreting or resisting CJEU case law.
