Die neue EU-Richtlinie über die Corporate Sustainability Due Diligence (CSDDD) ist bereits in Kraft und wird nach den jüngsten Änderungen auf EU-Ebene schrittweise ab 2028 für große Unternehmen und Konzerne EU-weit anwendbar. &nbsp;Sie verpflichtet Unternehmen, Menschenrechts- und Umweltstandards entlang ihrer gesamten Wertschöpfungskette zu prüfen, Risiken zu mindern und Abhilfe zu schaffen – mit Geldbußen bis zu 3 % des weltweiten Nettojahresumsatzes.
Für die Compliance-Welt markiert die CSDDD einen Paradigmenwechsel: Während sich Compliance bislang vor allem auf die eigene Organisation und den Selbstschutz konzentrierte, verlangt die Richtlinie nun Verantwortung über die Unternehmensgrenzen hinaus. Unternehmen müssen nicht nur ihr eigenes Verhalten steuern, sondern auch prüfen, wie ihre Geschäftspartner, Lieferanten und Auftragnehmer mit Menschenrechten, Umwelt und Ethik umgehen und welche bislang wenig beachteten Risiken in der Lieferkette bestehen. Auch Unternehmen, die nicht direkt CSDDD-pflichtig sind, werden diese Anforderungen in der Praxis zu spüren bekommen: CSDDD-pflichtige Kunden werden mit Nachdruck versuchen, Verantwortung und Pflichten weiterzugeben sowie Audit- und Kontrollrechte, Informationspflichten, Geschäftspartnerprüfungen und Compliance-Standards bei ihren Lieferanten einzufordern.
Dieses Buch zeigt, wie Unternehmen die CSDDD rechtlich fundiert, praxisorientiert und zugleich wirtschaftlich sinnvoll umsetzen können. Es verbindet juristische Anforderungen mit praktischen Leitlinien aus Compliance-, Risiko- und Nachhaltigkeitsmanagement und macht deutlich: Lieferkettensorgfalt ist keine Bürde, sondern eine strategische Chance.
Ausgehend von der historischen Entwicklung (Rana Plaza, Deepwater Horizon, UN-Leitprinzipien) werden die zentralen Pflichten der Richtlinie (Risikomanagement, Prävention, Abhilfe, Berichterstattung) erläutert und in konkrete Handlungsschritte übersetzt – inklusive Governance-Strukturen, Vertragspraxis, Due-Diligence-Tools, Schulung und Stakeholder-Kommunikation. Dabei werden immer wieder Unternehmensbeispiele und praktische Referenzen herangezogen, um zu zeigen, wie Unternehmen vergleichbare Herausforderungen bereits adressiert haben oder welche Lehren sich aus prominenten Fällen ziehen lassen. Ein eigenes Kapitel zeigt, wie Unternehmen durch glaubwürdige Umsetzung Vertrauen, Reputation und Wettbewerbsvorteile aufbauen.
