This open access book collects 11 reimagined judgments from the UK and challenges anthropocentrism in legal decision-making across a range of legal areas.

It draws from a range of Earth law approaches including rights of nature, animal rights, environmental human rights, well-being of future generations, ecocide, and reinterpretations of existing legal principles.

There is an urgent need to transform our legal institutions and cultures to foster healthier relationships between people and planet. The book explores how relationships between people, place, and the more-than-human world are produced, transformed, and destroyed through law, the limits of current law and the potential for positive transformation. A paradigm shift towards planetary, ecological and multispecies approaches offers possibilities for envisioning what the future of legal decision-making could look like.


Beyond the judgments, the book critically reflects on the developing field of Earth law and its potential for reshaping legal reasoning in the UK and beyond. It also offers possibilities for the future of Earth law from scholarly, educational, and policy perspectives within legal practice, training and education.

An influential legal scholar argues that the Supreme Court played a pivotal role in the rise of mass incarceration in America. With less than 5 percent of the world's population and almost a quarter of its prisoners, America indisputably has a mass incarceration problem. How did it happen? Tough-on-crime politics and the war on drugs are obvious and important culprits, but another factor has received little attention: the Supreme Court. Since the 1960s, the Court has repeatedly disregarded constitutional limits on the state's power to lock people away. Justice Abandoned highlights six decisions that made mass incarceration possible. These rulings have been crucial to the rise in pretrial detention and coercive plea bargaining. They have blessed disproportionate sentencing and overcrowded prisons. And they have sanctioned innumerable police stops and widespread racial discrimination. If the Court were committed to protecting constitutional rights, none of these cases would have been decided as they were. Rachel Barkow offers a roadmap for change, showing that the originalist methodology adopted by the majority of the current Court demands overturning the unconstitutional policies underlying mass incarceration. If the justices genuinely believe in upholding the Constitution, then they have little choice but to reverse the wrongly decided precedents that have failed so many Americans.

I am writing to recommend John Taglianetti for a research position at your University.I have had the great pleasure to know and collaborate with John over the last several years. We have worked together on numerous projects surrounding the "life without parole" issue in Pennsylvania. Both of us have spent a great deal of time (John more than me) helping incarcerated "lifers" do three things: 1) try to navigate the commutation process in Pennsylvania 2) advocate for changes in the Pennsylvania laws as they relate to LWP 3) assist inmates who achieve commutation with re-entry into society. In 2016, he and I worked together on a documentary film, "The Mayor of Grater ford," which highlighted the issues of death by incarceration."John Taglianetti is one of the fiercest, most dedicated advocates for incarcerated senior citizens that I have ever met. He was a prime architect in the formation of the Gray Panthers of Grater ford, a group of incarcerated senior citizens with LWP sentences. He has used countless hours and his own funds to further the cause of justice for these inmates. In addition, he has studied researched, and written of the subject of the archaic sentencing practices in the state of Pennsylvania. I've been inspired and have learned a great deal from John commitment and dedication to the cause of improving the Corrections system.I highly support John's efforts to create a more just, equitable criminal justice system. In 20 Bänden beleuchtet das hochkarätige Herausgeber- und Autorenteam das Strafgesetzbuch und das Völkerstrafgesetzbuch in all ihren Facetten und in bemerkenswerter Tiefe. Neben der Kernmaterie widmet sich das Standardwerk der Entstehungsgeschichte, Reformvorschlägen und rechtsvergleichenden Überlegungen. Die Einbeziehung von Erkenntnissen aus Nachbardisziplinen wie der Kriminologie und dem Völkerstrafrecht rundet die Darstellung ab. Der Großkommentar gibt den aktuellen Erkenntnisstand in Rechtsprechung und Literatur vollständig wieder und zeigt Wege zur Lösung auch stark umstrittener sowie komplexer Rechtsfragen auf. Er bietet damit Hilfe bei der Lösung selbst entlegener Probleme, die in anderen Werken kaum berücksichtigt werden. Begründet wurde der damals einbändige Kommentar im Mai 1916 in Leipzig von Ludwig Ebermayer, Adolf Lobe und Werner Rosenberg. Band 8 umfasst die Erläuterungen zu den im Siebten Abschnitt des Besonderen Teils des Strafgesetzbuchs geregelten Straftaten gegen die öffentliche Ordnung.

Mit der Markets in Crypto-Assets Regulation (MiCAR) wurden in der EU eigene Regelungen für den Kryptomarkt geschaffen. Dazu gehören auch Vorschriften zum Verbot von Marktmissbrauch. Diese sollen künftig von den Strafvorschriften des Kryptomärkteaufsichtsgesetzes (KMAG) in Bezug genommen werden. Vor diesem Hintergrund untersucht die Arbeit zunächst, inwieweit das geltende Marktmissbrauchsstrafrecht auf den Handel mit sog. Krypto-Token Anwendung findet. Unter Berücksichtigung der gewonnenen Erkenntnisse werden dann Regelungsmöglichkeiten im künftigen Recht sowie die gesetzgeberischen Bestrebungen kritisch gewürdigt.

This open access book establishes, analyses and systemises the challenges that AI evidence poses to fundamental rights and principles of criminal procedure, as well as the rule of law. Taking a four-part approach, distinguished experts contribute chapters on the six examined countries (Germany, Luxembourg, the Netherlands, France, England and Wales, and the US) that provide the basis for the comparative analysis and the development of concrete policy proposals.
