This book offers the first ever in-depth analysis of the emerging constitutionalism in South Sudan and the challenges it faces. The book critically analyses the constitution-making processes that occurred in South Sudan between 2005 and 2011, finding, among other things, that there was a failure of constitutional discourse, particularly in relation to the 2011 drafting process of the Transitional Constitution. It goes on to analyse how the constitution is being implemented. It finds that, despite the clear division of powers and functions between the national government and the sub-national governments, what has emerged in South Sudan in the post-constitution-making period is a form of coercive centralism where the national government controls much of the political decision-making process. This has had serious implications for democracy, constitutionalism, and the rule of law. Finally, bearing in mind the failure in both how the transitional constitution was made and how it is being implemented, the book undertakes a critical analysis of the proposed process for drafting a new constitution for South Sudan. It identifies serious shortcomings and proposes how these could be addressed to enhance the process.

Emerging Constitutionalism in South Sudan

Pulitzer Prize–winning former Washington Post columnist Eugene Robinson tells our nation’s torturous racial history through his own family’s story, starting with his great-grandfather’s freedom from slavery and threading his way to his own narrative and reaching today’s Black Lives Matter movement, asking whether this time will be different. On March 27, 1829, a wealthy white planter and entrepreneur named Richard Fordham purchased four enslaved African Americans from a woman named Isabella Perman. One of them was journalist Eugene Robinson’s great-great-grandfather, a boy called Harry. Starting from this transaction, which took place in Charleston, South Carolina, Freedom Lost, Freedom Won brings to life two hundred years of our nation’s history through the eyes of the remarkable family that Harry founded. Assigned a formal name—Henry Fordham—and put to work as a blacksmith, he achieved his own freedom a decade before the Civil War. He was there when victorious Union troops marched into Charleston in 1865, ending slavery and guaranteeing liberty for Black people—only on paper, though, and only for a time. Robinson traces the arc of his familial lineage through the repeated cycles in which African Americans have fought their way upward toward freedom and opportunity, been forced back down again, and renewed their determined climb. From his great-great-grandfather’s achievement in becoming a “free person of color” before emancipation to his great-grandfather’s Reconstruction-era success, from his father’s odyssey of the Great Migration to his own coming-of-age during the civil rights movement, Robinson delves into a rich archive of Black narratives, arguing that we still have a long way to go before it is possible to speak of a “post-racial America.” Setting his extensive research within the larger historical context, Robinson provides both an indictment of structural racism and an illustration of how it has been fought and, at times, courageously overcome. Freedom Lost, Freedom Won tells our country’s tortuous racial history through Robinson’s family’s story of struggle and survival, pushing us to consider how far the nation has come—willingly or not—and how far it still has to go.

This book explores how COVID-19 represents an inflection point for re-thinking and re-making democracy across the English-speaking world in an age where states are facing a future of overlapping crises. Years after the unprecedented COVID-19 pandemic started to unfold, have we yet learned the deep lessons essential to maintaining and improving democracy to meet crisis challenges? Produced with the benefit of distance from the most acute period of the pandemic, the book contextualises the COVID-19 crisis as revealing pre-existing vulnerabilities and intensifying challenges of governance, inclusion, and distrust, while also spurring democratic innovation and shifting the parameters for reform. Six national case studies - Australia, Ireland, Canada, Aotearoa New Zealand, UK and USA - reveal the heterogeneity of the Anglosphere as an imagined democratic space. Viewed in the round, pandemic responses ranged from the chaotic to the internationally lauded, although even the latter have featured acute deficiencies in democratic practice, which underscores the need to gather the lessons learned. Yet, in all states, the public and political temptation to simply move on, in an act of communal forgetting and collective return to "normalcy," presents a real risk of failing to prepare for more democratic future crisis responses. This collection takes the long view, approaching its subject from multiple perspectives that examine the heterogeneity of the Anglosphere as an imagined democratic space. Taking a cross-disciplinary approach and bringing together both leading and emerging experts on democracy, constitutionalism, and the rule of law, this book powerfully combines the insights of retrospective analysis with future-focused contemplation of where our democracies are heading.
