This book investigates the structural limits of the principle of party initiative and the rule of congruence within the contemporary civil procedural system, with a primary focus on Brazilian law and a comparative outlook that resonates with other legal traditions. It critically examines how the liberal-individualist foundations of civil procedure—rooted in 18th- and 19th-century private law—continue to shape the concepts of jurisdiction, action, defense, and process, often in ways that are misaligned with the collective and complex nature of modern legal disputes.Through the lens of financial compensation for mineral exploitation, the work explores the dual role of the Public Power as both rights-holder and representative of diffuse interests, revealing the inadequacy of traditional procedural categories in addressing collective claims. This tension underscores the need to rethink the procedural framework, especially when the judiciary is called upon to act beyond the strict confines of party-submitted claims.The book proposes a shift toward a more systemic and public-oriented understanding of judicial activity, grounded in the principle of proportionality—understood here in its pan-procedural dimension. Rather than evaluating procedural guarantees solely within the boundaries of individual cases, it advocates for a broader analysis that considers the efficiency and legitimacy of the judiciary as a public service. Drawing on constitutional principles and comparative jurisprudence, it argues that judicial decisions must be guided by a balance between means and ends, ensuring that interventions are not only legally sound but also socially and economically justified.This approach is further developed through a critical analysis of the classification of legal actions and the effects of judicial decisions. The book revisits traditional distinctions—declaratory, constitutive, condemnatory, mandamental, and executive—highlighting their historical evolution and practical limitations. It challenges the rigidity of these categories, especially in contexts such as third-party embargoes and fraud against creditors, where procedural formalism can hinder effective legal protection. The discussion extends to the controversial admissibility of declaratory actions on facts, advocating for a more pragmatic and flexible interpretation that aligns with the realities of legal uncertainty and the need for judicial affirmation of rights and obligations.This work offers a renewed theoretical and practical framework for understanding the boundaries of judicial action. This book provides a multifaceted investigation into the relationship between law, normativity, and the spatio-temporal coordinates in which legal phenomena emerge and transform. It offers a cross-disciplinary and philosophically grounded perspective that rethinks the categories of space and time as fundamental dimensions of the normative experience. Bringing together contributions from legal theory, philosophy, semiotics, comparative law, and cultural studies, the volume explores how law is affected by, and in turn affects, evolving conceptions of time and space and how the legal experience belongs to human history. This book investigates the ontological status of legal norms and the implications of their despatialisation or deterritorialisation in digital and transnational contexts. Several chapters address questions about the existence and longevity of legal norms, others examine the distinction between the spatial scope and the actual validity of norms in light of the effects of political change, cyber-activities, and global regulatory trends. The temporal dimension of legal responsibility is re-examined with regard to concepts such as negligence, intention, and agency. Moreover, the book explores challenges of decision-making posed by algorithmic governance and behavioural regulation involving classical models of normativity based on rationality and chronological linearity. Furthermore, the volume draws on intellectual traditions from across the world (Western phenomenology, classical legal thought, non-Western cosmologies and ethical frameworks) for reconsidering the way normativity is shaped by paradigms of space and time related to peculiar dimensions (rhythm, ritual, kairos), which offer alternative temporalities encompassing legal practices and our understanding of some philosophical-legal categories.  in future. Judges’ judicial decision-making and sentencing practices have space to interpret it with opinions, discretion, legal consciousness and innovation for an immediate legal effect of criminal justice on society. This book applies robust judicial behavior concept to analyze how 
 Taishinin
 ’s judicial behavior of such factors rationalized its rulings on corruption cases. This is not only a matter of transplanted “Western jacket” of Germanic Penal Code, but also departmental internal instructions, integrity standards and traditional legal consciousness of unwritten codes of conduct. The original findings of this book reveal that 
 Taishinin
 ’s judicial behavior in corruption cases was subject to many non-legal considerations, such as historical development of anticorruption law, traditional jurisprudential concepts, mission of and commitment to judicial role, values, judge appointment, judicial training and the political impacts of Ministry of Justice’s administration of judiciary.&nbsp;

The book examines the practice of judicial reasoning in Tort law, understood as a process of justification, consisting of both deductive and non-deductive elements, and therefore involving a significant element of choice or discretion. The book divides the elements of judicial reasoning into four conceptual categories: factual assessments, application of legislative and judge-made rules, reliance on reasonableness, and policy considerations. To discuss these elements in a comparative perspective the book uses the English and French judicial traditions of Tort law as case studies. This enables the author to present a range of methods of establishing facts, drawing inferences, using legal sources and relying on policy arguments. By closely examining selected Tort judgments from both jurisdictions, the book elucidates the phenomenon of law-making through adjudication in both a non-codified and a codified system of liability. It offers a reflection on different approaches legal systems may adopt to the importance in the process of judicial justification of such issues as certainty and truth, common sense, consistency with previous judicial decisions and policy.
The book connects the choice of approaches in judicial reasoning in Tort law with its procedural and institutional context.

This book explores the use of the doctrine of good faith in the common law when interpreting contracts and resolving disputes.

This doctrine is well-accepted in civil law, is reflected in international commercial law, and is a fundamental aspect of private law in the USA. However, its use in the UK is extremely limited. Inconsistent application has given rise to confusion and uncertainty. This apparent antipathy is somewhat hard to fathom, given its previous widespread acceptance in English law.


The book explains in depth the history of good faith in English law, and clarifies its current status in English, Australian and international law. It explores the relationship between good faith within contractual relations and the neighbour principle in tort law, and notes the workability of good faith in the commercial context of insurance. This will be welcomed by contract lawyers in both common law and civil law jurisdictions. A subsequent volume will explore how acceptance of good faith in the law might lead to a re-interpretation of existing contract law doctrine.
