Humanity in the twenty-first century faces serious global challenges and crises, including pandemics, nuclear proliferation, violent extremism, refugee migration, and climate change. None of these calamities can be averted without robust international cooperation.&nbsp;Yet, national leaders often assume that because their states are sovereign under international law, they are free to opt in or out of international cooperation as they see fit. This book challenges conventional wisdom by showing that international law requires states to cooperate with one another to address matters of international concern-even in the absence of treaty-based obligations. Within the past several decades, requirements to cooperate have become firmly embedded in the international legal regimes governing oceans, transboundary rivers, disputed territories, pollution, international security, and human rights, among other topics. Whenever states address matters of common concern, international law requires that they work together as good neighbors for their mutual benefit. The discourse, scholarship, and practice of transitional justice have become pivotal to addressing historical systematic injustices. However, until recently, the field has largely overlooked some of the most enduring and pervasive injustices of human history: racism and the colonialism and slave-trade that both reflected and fuelled it. Race and Transitional Justice examines how race and racism interact with transitional justice mechanisms and institutions to question why this is the case, and how it could be different. Bringing together diverse perspectives to examine the historical and socio-political contexts of transitional justice, this book argues that the field remains largely inattentive to the role of race. As a result, transitional justice institutions may be sustaining the very racialization that they are expected to remedy. The contributions offer a range of responses. Some call to abandon the whole field, citing its complicity in the indefinite maintenance of settler hegemony. Others consider transitional justice an essential space to work towards a more just, non-racist, social order. The result is a sensitive reflection into emancipatory transitional justice futures.

Proceeding from Russia's ongoing aggression against Ukraine, this examination plots how memory laws have preceded, partially led to, and encouraged the outbreak of the war itself via Russian propaganda. It also offers a broader perspective looking at developments in the Baltic States, Belarus, Finland, Germany, Hungary, and Poland, as well as in European (Council of Europe and European Union) law. This book makes a simple but consequential claim: individuals who decisively influence a state's decision to use armed force should be held criminally responsible for aggressive war. Challenging the prevailing orthodoxy, it reinterprets the leadership clause in the definition of the crime of aggression and offers a new responsibility framework that reflects how decisions about war are actually made. Under this approach, liability is not confined to heads of state and top military leaders but extends to civilian power brokers, private actors, and third-state officials who are present at key moments of deliberation and, as reason-giving and reason-demanding participants, exercise decisive influence over whether a state goes to war or continues one.
