Legal Implementation and Impacts of the European Green Deal

While mainstream international legal scholarship has long treated race as a peripheral concern-or a historic injustice to be remembered but not redressed-this volume argues that racialisation is foundational to the discipline, underpinning its doctrines, epistemes, and interlocutors. Emancipating International Law explores the many ways racial hierarchy, systemic oppression, and global white supremacy shape international law. Bringing together leading and emerging scholars, the collection moves beyond qualifying whether international law is racist to explore how racial hierarchies are embedded in its structures and continue to evolve through legal and institutional practice. Divided into five sections, the book begins by situating international law's racialised boundaries within its colonial, capitalist, and chauvinist afterlives, exposing how white ignorance and race-thinking underpin legal norms, from sovereignty to jus cogens. It then examines racial stratification across legal institutions, including investment law, refugee law, and the Genocide Convention. The third section extends this critique to human rights, revealing the ways in which even an emancipatory paradigm can bolster racial injustices. The penultimate section unpacks racial hierarchies in disparate societies, including Brazil, India, and Japan, as well as the frontiers of nation-states. The volume concludes with a powerful discussion of the role of activism and alternative epistemologies in racial justice struggles, and the limits of international law's capacity for anti-racist transformation. Aimed at scholars, practitioners, and students of international law, critical legal studies, and anti-colonial theory, this book advances an understanding of international law that is aimed at dismantling its racialised structures. Governments around the world are privatizing everything, with dramatic but largely ignored negative consequences for human rights. This open access book outlines the response that is urgently needed. Corporations are being given control over water, healthcare, housing, public transportation, child welfare services, aged care, and much else. Privatization is promoted by international financial institutions, consulting firms, and development actors as the answer to public finances devastated by the very tax cuts insistently pushed by these groups. Their pitch is based upon a mythology that extols the virtues of an idealized market while ignoring the heavy human rights costs incurred. Building on the latest evidence and on specially commissioned case studies, this book shows how the touted 'efficiency' of the private sector is often predicated on higher charges and/or reduced services, destructive employment practices, and the highly predictable exclusion of many users. Privatization generally costs states more money, marginalizes democratic decision-making, and transforms citizens from rights-holders into customers while sidelining accountability. The authors develop an approach designed to enable human rights actors, including courts, UN treaty monitoring bodies, and NGOs to move beyond their longstanding agnosticism towards privatization. It starts with a presumption that privatization is inherently retrogressive in human rights terms. Whatever mix of public and private is reflected in any given arrangement, governments must retain the degree of control necessary to ensure respect for rights, and the legal, financial and administrative ability to do so. The book charts a new direction for responding to the ever-growing threat that privatization poses to human rights. Chris Himsworth analyses the text of the 1985 European Charter of Local Self-Government, traces its historical emergence and explains how it has been applied and interpreted throughout Europe, including the 2014 'Local and regional democracy in the United Kingdom' report published by the Council of Europe in March 2014. Locating the Charter's own history within the broader recent history of the Council of Europe and the European Union, the book closes with an assessment of the Charter's future prospects.

This volume brings together the contributions of early career scholars at the 5th Young Scholars' Conference on Private International and Procedural Law, held in Heidelberg in 2025 under the theme "Digitalisation and PIL: Local Connections in Boundless Spaces." The authors explore how digital technologies challenge the foundations of conflict of laws and procedure. Johannes Weigl and Loïc Bréhin analyse the conflict-of-law dimensions of the EU's digital regulatory framework, from GDPR and the DSA andDMA to the Data Act, DGA and AI Act, and demonstrate how classical methods may still offer solutions. Christina Lemke proposes an innovative application of the lex monetae to the digital euro. Piotr Wilinski, Maciej Durbas and Agatha Brandão investigate the use of artificial intelligence in cross-border legal services, alternative dispute resolution and academic research. Naivi Chikoc Barreda turns to online notarisation, a phenomenon still unfamiliar in Germany but of increasing relevance in transnational practice. Finally, Linda Kuschel and Adrian Hemler emphasise that issues such as electronic service of documents and the exercise of judicial functions abroad require international procedural law to reaffirm its foundations in public international law. The volume demonstrates how digitalisation not only generates technical and regulatory questions but also prompts fundamental methodological questions within private international law.
