This book explores the law, philosophy, and wider implications of that brief but highly consequential moment when a judge imposes sentence on a convicted offender. Sentencing is one of the most contested aspects of contemporary criminal justice. It is an important field of study, both as an instance of coercive state power over the citizen and as the point at which the statutory purposes of punishment are given public expression. Focusing on England and Wales, with occasional comparative reference to sentencing practice around the world, topics include the legal and ethical implications of pleading guilty, the origin and development of sentencing guidelines, and the 'ordinary' language in which the sentence itself must be pronounced in open court. Tensions arise over the appropriate treatment of cohorts including the young, racialised, mentally disordered, and dangerous, and the disparate outcomes such treatment can generate. At a time of unprecedented crisis - from the phenomenon of 'sentence inflation' 50 years in the making, to the criminal court backlog, to an overcrowded prison estate - the book concludes with an appraisal and critique of the Sentencing Act 2026. The Act was pitched as a once-in-a-generation attempt at substantive justice reform, but its precise impact remains to be seen. Key Ideas in Sentencing

This open access book asks whether international economic crime can qualify as an international crime and be prosecuted as such. Taking a four-part approach to the question, it traces the origins of the concept of international economic crime, and draws the line between ordinary economic crimes and economic offences of international significance. To this end, it examines six cases involving the commissions of serious economic crimes in different regions of the world, including Europe, the Americas and Africa: the crime of grand corruption in the Petrobras case; the theft of natural resources in the Niger Delta region and Liberia; the international money-laundering scheme in the Bolichicos case; the crime of financing terrorism in the Chiquita case; the Volkswagen conspiracy case in the US and the Haarde case related to gross-negligence in preventing serious economic damage. It then goes on to discuss a potential sui generis category of international economic crimes, before considering the advantages and the challenges of the multilevel enforcement system of international criminal justice in prosecuting such crimes. This book provides an innovative and original avenue for the analysis of a controversial and yet overlooked topic in international criminal law. This is the essential practitioner's guide to animal welfare and animal protection law in the Crown Court and magistrates' courts of England. Animal law is a roughly stitched patchwork of domestic acts, regulations, orders and statutory codes, interlaced with international treaties, regulations and directives. The resultant body of law is immense: with acts still in force today dating back to the 1800s and dozens of enabling clauses permitting the tapestry constantly to evolve. This book provides the first in-depth study of the crime of bigamy from the 17th century to the present day. Between 1604 and 2024, around 30,000 individuals were prosecuted for bigamy in England and Wales. A few were able to establish a defence to the charge, but most were convicted. How they were punished varied hugely across the centuries - from execution, branding, whipping, transportation, and imprisonment through to fines and community service. Criminal Law - Sentencing, Procedure and Key Offences

Róisín Á Costello provides a critical analysis of the ways in which law is portrayed in Irish literature and argues that authors from Ireland (writing in both Irish and English) have consistently used literature as a mechanism to challenge and critique institutional power. In doing so, she argues that Irish literature, and the narratives it has created about law, have been used to re-assert and recomplicate Irish identities at sites of conflict and to interrogate the legitimacy of power and how it is exercised. Drawing on a range of texts including novels, poetry, plays, song and satire, Costello illustrates that Irish literature has acted as a decolonial and intersectional force in critiquing the institution of law and constructing national, linguistic and political identities in Ireland. She traces a pattern in which Irish authors consistently used literature as a lens for legal analysis in Ireland, using their work to address fundamental concerns about the legitimacy of law, the role of doubt in legal proceedings, the need for popular accountability, and the marginalisation of minority groups an identities by formal institutions and system.

Law in Irish Literature

The American criminal justice system is broken – and the problem is being compounded by our mental health crisis. After confronting the failures of these systems first-hand, Judge Steve Leifman realized that for things to improve, a radical change was necessary. In 2000, he created Florida’s 11th Judicial Circuit Criminal Mental Health Project, later renamed to the Jail Diversion Project (JDP). Uniting all facets of the criminal justice system from courts to clinics, the program has become one of the most impactful models for prison reform across the country.
