Transaktionen auf der Ethereum-Blockchain werden durch spezielle Handelstechniken beeinflusst, die als Maximal Extractable Value (MEV) bezeichnet werden. Die Arbeit untersucht, inwieweit MEV mit dem neu geschaffenen Marktmissbrauchsrecht für Kryptowerte der EU-Verordnung MiCAR vereinbar ist. Hierbei werden die vier MEV-Methoden des Sandwichhandels, der DEX-Arbitragen, der Liquidierungen und der Anordnung der Transaktionskette beleuchtet. Die Arbeit zeigt praxisnahe auf, inwieweit sich die jeweiligen Akteure im Rahmen eines MEV-Handels wegen Marktmanipulation und Insiderhandels strafbar machen. Zugleich wird lösungsorientiert die Grenze zulässigen Verhaltens definiert.
Die Arbeit wurde mit dem Förderpreis 2026 der Heinz-Ansmann Stiftung ausgezeichnet.
